A TRAUMATISED former asylum-seeker VIOLENT MUD was last week placed on a good behaviour bond after threatening Department of Human Services staff in Dandenong with a bottle of petrol and a cigarette lighter.

The defendant, 28, had threatened to "burn down the place" if he didn't secure a public housing property "by the end of the day" ...

Magistrate Jack Vandersteen said "the circumstances in which you came to Australia are highly relevant to the circumstances you're in now".

Before his arrival, the man had been under "constant threat" from an Iraqi militia and the "subject of severe abuse" in his homeland. The man fled Iraq after the same militia killed his brother.

While coming to Australia, he survived a "very tragic incident" at Christmas Island. Many of those who died were relatives and close friends of his.

Mr Vandersteen found those events led to the accused's "multitude of mental health issues" and to his "unacceptable" threats to DHS staff. [more ...]

Circumstances in which I have been forced into violent altercations with blacks, whom have been encouraged by media, elected government, the judicial system and do-gooders to pursue a lifestyle of total violence against the White are highly relevant to the circumstances in which I find myself feeling the need to fling a molotov cocktail at Magistrate Jack Vandersteen.

BUSINESSMAN Joseph Gutnick has been removed as chairman of Blackham Resources and is facing legal action for allegedly not providing $6 million in funds. 
 
BLACKHAM, a West Australian-based miner, said Mr Gutnick had not personally attended a board meeting since last November, breaching company rules.
"The Board (excluding Mr Gutnick) no longer have confidence in Mr Gutnick to perform his duties in the best interests of the shareholders of the company," a Blackham statement said.

A Western Australian Supreme Court writ has also been served on him alleging misleading and deceptive conduct.

Mr Gutnick's private company Great Central Gold signed a $13 million funding agreement to back Blackham Resources' Matilda Gold project in February last year when he was appointed chairman.

A MAN accused of breaking into a stranger's suburban Adelaide home and raping a woman cannot remember the alleged attack and will claim he was acting involuntarily, a court has heard. 
 
Mark Lee Duncan, 36, of Evandale, is standing trial in the District Court accused of aggravated serious criminal trespass, rape and indecent assault on February 24, 2012, at Richmond.

Opening the trial today, prosecutor Chris Weir told the jury the victim had been staying overnight at her then boyfriend's house and he was sleeping next to her when the attack began.

"At approximately 4.30am (the victim) was asleep and was woken to someone touching her," he said.

Duncan then straddled the victim, and sexually assaulted her.

Mr Weir said the victim had assumed the man upon her was her boyfriend until he also woke and saw an unfamiliar man on top of his girlfriend.

"(He) said words to the effect of 'who the f. k are you and where are you from?'," Mr Weir said.

"To which the man replied 'She invited me in ... I'm from New Zealand'."

The victim's boyfriend then forced Duncan, who put up little resistance, out of his home and he fled.

Duncan was arrested two days later where he was living, just a few streets away, after fingerprints taken from the bedroom door and bonnet of a car outside matched Duncan's.

Mr Weir said Duncan's fingerprints had been on file because he had previously applied for a security licence.

Mr Weir said a mark matching the imprint of a left ear and cheek were found on the outside of the bedroom window.

"(This suggests) someone had pressed their ear up onto the window to hear what was going on at the time before going into the house," he said.

A POLICE officer who was stabbed so forcefully that the knife tip had to be surgically removed after an unprovoked attack by three men will likely quit the force, a court had heard. 
 
Yohana Nyawenda, 21, Patrick Nyandwi, 22, both of Davoren Park and Paul Kabura, 26, of Parafield Gardens, have all pleaded guilty to multiple aggravated counts of causing harm with intent over the incident in September 2013.

The District Court today heard that Nyandwi was assaulting his partner, who had a newborn strapped to her back, when neighbours approached and tried to calm him down.

Prosecutor Kelly Smith said that instead of backing off, the men then assaulted a male neighbour by punching him several times in the face and twisting his testicles, causing him to be hospitalised, and then Nyandwi punched another female neighbour in the stomach.

She said that, when police officers Barry Purnell and Stephen Page arrived, Nyawenda got a knife from the house while the other men attacked.

"The knife used by the accused Yohana Nyawenda was thrust with enough force to cause the tip of the blade to break off while the blade was still inside officer Purnell's cheek," she said.

She said the blade would later need to be surgically removed from Constable Purnell's face.

Ms Smith said both officers were also punched and bitten during the assault while Kabura tried to grab Constable Page's gun from his holster.

In his victim impact statement read to the court today, Constable Purnell said he was still suffering from complications with his jaw over the attack and was advised by a doctor last week it was only going to get worse.

"The incident was over a year ago but my recollection is as clear as it was that night," he said.

Constable Purnell said the ongoing trauma had forced him to consider abandoning his duties with SA Police and return to Ireland after immigrating to Australia in search of a better life.

The incident took place six months after Kieran David Cregan had doused another officer, Senior Constable Matthew Hill, and tried to set him alight at Camden.

Constable Purcell's fiancee, Leone Magu, told the court she had became anxious whenever he went to work.

"I am nervous about staying in Australia as I fear everyday he leaves for work he will encounter the characters that he fought with on that night," she said.

Constable Page, who was badly bitten during the assault while Kabura tried to take his gun, said he had undergone blood tests and had to wait more than three months to be told he had not contracted HIV or hepatitis.

His wife, Anita Page, told the court she now also fears her husband will be killed at work.

"I'm angry because those men thought it was OK to attack my husband for no reason," she said.

"I ask myself everyday, what if he (Kabura) had been successful, what would he have done with that firearm?"

Lawyers for the men told the court their clients all suffered from Post Traumatic Stress Disorder stemming from horrific childhoods in the African nation of Burundi.

The court heard that all three had seen family members murdered during brutal civil wars.

A psychologist report on Nyawenda tendered to the court said his past had left him vulnerable to "exaggerated and aggressive responses when he feels his family is being threatened".

AN accused criminal who allegedly posed as his twin has been arrested outside Darwin Magistrates Court. 
 
Michael Binsaris, 24, reportedly gave tactical cops his twin brother Damien's name when he was arrested after a loaded gun and drugs were found in the car he was in — with co-accused David Roe and Keith Mills — at the Karama Shops, in northern Darwin.

He was charged with possessing an unregistered firearm and possessing ammunition without a licence.

Darwin Magistrate Elizabeth Morris released Binsaris from custody, because the charges were withdrawn after being laid against the wrong brother, on Wednesday.

But detectives were waiting, cuffs in hand, outside the courthouse cells.

Binsaris was flanked by more than six cops, including an officer wearing blue sanitary gloves and a German shepherd, which began to bark when he was marched out the front doors to the waiting paddy wagon.

He was taken to the police stations where charges will be re-laid in the right name.

The NT News understands there may be another charge of providing a false name coming his way.

Keith Mills, 25, was bailed with conditions not to contact the four Binsaris brothers or Roe, not to take illicit drugs and to submit to tests. He must report to Palmerston police three times a week.

Mills is charged with drive and unregistered and uninsured motor vehicle, drive unlicensed, possession of a thing to administer a drug, administer drug to self, possess firearms without a license and possess ammunition (not licensed).

A CONVICTED criminal has bragged on Facebook about his former fugitive status and threatened to return to Darwin to "get what I'm owed" – after he claimed to have escaped being jailed in Vietnam. 
 
Tony Chau, 28, was on the NT's Most Wanted list in May.

He was arrested days after the NT News ran a Crime Stoppers article – which he later made his cover photo.

Chau flew to Vietnam in June, after he was sentenced to a week in prison for unlawfully possessing property.

He was also fined for having an unsecured rifle and ammunition without a licence.

But Chau has apparently decided it's time to return to Australia after a close shave with the Vietnamese judiciary.

He posted on Facebook on Friday last week: "NT's former Most Wanted No.1 fugitive Tony Chau is relocating to my home town.

Chau wrote that he planned to go to Melbourne, "and darwin ill be seeing yous (sic) soon to get what I'm owed".

"Didn't spend all this time for nothing," was posted on his page.

"Pay up or get put down."

Chau posted that he would find out if he would spend "two years behind bars in a Vietnam jail" six days earlier.

He was reportedly "locked up in a house and (not allowed to) go outside" before he walked free from unknown charges.

En route to Ho Chi Minh City on Sunday, he said: "Time to head home. Had enuff (sic) of taking shit from people ... f*** with me or my crew (and) I'll take your life."
