A black HR manager has lost a race discrimination case after her boss asked her about her 'inner chimp' during a meeting about 'Chimp Paradox' theory

Lindani Sibanda was offended when Clinisupplies chief executive Paul Cook asked her in a meeting how she kept 'the chimp at bay', an employment tribunal was told.

The question was a reference to the 'Chimp Paradox', a mind management tool used to differentiate between irrational, emotional thoughts and rational ones.

It was coined by psychiatrist Steve Peters and has been used to help Olympic gold medallists Victoria Pendleton and Sir Chris Hoy to victory on the cycling track.

But Miss Sibanda claimed to be unaware of it and, after she left the firm, took them to the tribunal claiming she had faced racial discrimination. However, the tribunal rejected her case, concluding the question by Mr Cook was 'not related to race'

Nevertheless, it did note that 'potential offence is clear' and should be 'born in mind' by bosses when discussing the theory which divides inner feelings into the rational (human) and irrational (chimp)

The hearing was told Miss Sibanda earned £37,000 a year working as an HR manager for Clinisupplies, which manufactures and markets healthcare products

The theory divides inner feelings into the rational (human) and irrational (chimp), and aims to help people work out how their mind is working, and understand and manage their emotions and thoughts.

The chimp aspect of humans is seen as the part of humans that thinks and acts for them without their permission; while the human aspect comprises the rational, compassionate and humane thoughts that are the real person

Well blacks aren't rational. They are emotional "Hulk smaaassh" creatures when things don't go their way. They look like Chimps too!

The government's China scare campaign against Labor could have serious consequences for Asian people in Australia.

As the federal election looms, the government has repeatedly highlighted several minor links between Anthony Albanese and the Chinese government.

The rhetoric, such as when Peter Dutton called Mr Albanese "China's pick" or when Scott Morrison dubbed deputy Labor leader Richard Marles a "Manchurian Candidate", can have the effect of branding anyone associated with China as bad or untrustworthy

"The problem with the government's language is that it lacks a lot of nuance and it's actually very lazy," Erin Chew, founder of the Asian Australian Alliance, told The New Daily.

"When someone that high up – a senior minister – is using lazy language like that, what happens is there is going to be a racial backlash against people like myself who look Chinese."

Ms Chew has compiled more than 600 cases of anti-Asian racism in Australia since the pandemic began, and says the reality is likely much more widespread.

With this context, she believes the government's anti-China rhetoric gives certain people "a green light to be racist

Jennifer Hsu is a research fellow with the Lowy Institute's public opinion and foreign policy program who worked on the Being Chinese in Australia report last year, and she also saw a similar spike in racist incidents.

"We found that there was a surprising number of people – 18 per cent – who self-reported that they've been physically threatened or attacked attacked because of their Chinese heritage," Ms Hsu told TND.

Ms Hsu said more people could feel emboldened to racially attack Asian-Australians during the upcoming election campaign.

"In some ways, the current tone of the political debate around China and Australia-China relations, I'm scared to say, might give those who are on the extreme ends of the political spectrum reason to voice and act upon their dissatisfaction with a state of Australian politics, Australian society and community at large," she said

The three white men convicted of chasing down and murdering a young black man, Ahmaud Arbery, as he was out jogging in their suburban Georgia community, have been found guilty of committing federal hate crimes and other offences in the 2020 killing

A predominantly white jury deliberated for about four hours over two days before returning the verdict against Travis McMichael, 36, his father, former police officer Gregory McMichael, 66, and a neighbour, William "Roddie" Bryan, 52, in US District Court in Brunswick, Georgia.

All three men were found guilty of violating Mr Arbery's civil rights by attacking him because of his race, and of attempted kidnapping, capping the latest high-profile trial to probe issues of vigilantism and racial violence in the US.

The McMichaels were additionally convicted of a federal firearms charge.

Bryan was not charged with a weapons offence.

The hate-crimes felony, the most serious of the charges the defendants faced, carries a maximum penalty of life in prison.

The three men were convicted last year of murder and other crimes in state court and sentenced to life terms for the shotgun slaying of Mr Arbery, 25, a onetime high school football star who worked for a truck-washing company and his father's landscaping business.

Prosecutors in the state trial avoided characterising the killing as racist, seeking only to prove that the McMichaels and Bryan were responsible for his death.

Mr Arbery was shot to death on February 23, 2020, by the younger McMichael after all three defendants had chased him down in pick-up trucks as the victim was out for an afternoon jog through the community of Satilla Shores, near the southeastern coastal town of Brunswick.

The McMichaels insisted they did not act out of racial animus but out of self-defence and a belief that Mr Arbery appeared suspicious when they saw him running through the streets after a series of neighbourhood break-ins.

But trial testimony revealed there had been no burglaries but thefts from unlocked cars.


And federal prosecutors presented testimony from 20 witnesses and other evidence they said showed that the three men had long histories of using slurs and making racist statements.

The defence rested its case after calling just one witness.

There was never any dispute that the younger McMichael fired his shotgun three times at Mr Arbery at close range.

The killing was captured in a graphic mobile phone video recorded by Bryan, stoking public outrage when it surfaced on social media more than two months later with no arrests yet made, even though Travis McMichael had admitted to police at the scene that he gunned down Mr Arbery.

Civil rights activists pointed to the lag time in arrests of the three men as the latest example of law enforcement allowing white perpetrators to go unpunished in the unjustified killing of black people.

Mr Arbery's name became entwined with a host of others invoked in a summer of protests against racial injustice across the US after another unarmed black man, George Floyd, was killed by a white police officer kneeling on Floyd's neck until he could no longer breathe in May 2020.

The federal prosecution of Mr Arbery's killers is the first in which those who committed such a high-profile murder are facing a jury in a hate-crime trial.

The two McMichaels had agreed last month to plead guilty to the federal hate-crimes offence, and the son acknowledged at a federal court hearing that he singled out Mr Arbery because of his "race and colour".

But Judge Lisa Wood rejected the plea bargain because it bound her to a 30-year sentence that prosecutors had agreed would be served in a federal lock-up before the men were returned to the Georgia prison system, widely perceived as a tougher environment for inmates compared with federal penitentiaries.

The plea deals were then withdrawn and all three defendants proceeded to trial.

As Ukrainians flee Russian invasion, ordinary Australians are opening their homes
Non-White Ukrainians denied entry to EU and Moldova.

Inna Ilyenko and her eight-year-old son Andrii have fled war in Ukraine not once, but twice.

In 2014, when Russian-backed separatists took over her home town of Donetsk, the family was forced to relocate to the capital Kyiv.

Now, eight years on, the mother and son have just touched down in Sydney after Russia began bombing the country in February.

"The further away from the war we are, the better," Ms Ilyenko told The New Daily through an interpreter.

The 45-year-old mother had wanted to come to Australia for years, particularly to meet her online friend of two decades Anastasia Cortez, a Sydney-based motivational coach who grew up between Ukraine and Russia.

However, her visa application had been knocked back every time until now.

When Russia invaded Ukraine, her friend, Ms Cortez, raised money to pay for the mother and son's airfares.

But first they had to escape to Poland under the cover of night

But as masses of people flee across the border into Poland, Romania and Moldova, very few of them will make it to a faraway country like Australia.

It's not an easy process, and President Volodymyr Zelenskyy put a ban on men aged between 18 and 60 from leaving the country last month.

Some Black and brown residents even faced racism and were turned back by European border authorities, regardless of their citizenship.

The Australian government has pledged to send visa applications from Ukrainian refugees "to the top of the pile" after the Russian invasion.

More than 4000 visas have been issued to Ukrainians since the war started in February, The Sydney Morning Herald reports.

Most of these visas are temporary, and many applicants have existing connections to Australia.

Ms Ilyenko, for example is on a tourist visa.

This means she's not allowed to work, and her son can't go to school permanently.

She now hopes the government will be lenient enough to let her start a life here, at least for the time being.
