Selling the Church Property

When we agreed to move the headquarters to Milwaukee, we also agreed to sell the church real estate here at Otto and turn over the proceeds of the sale to their group so that they could fund their various needs in equipment, publishing the newspaper, and other requirements in order to run their program. By June 15, we had already shipped our entire inventory of books over to their center, it was now necessary to dispose of the real estate as quickly as possible to get the funds in order to get their program into high gear. Since most of their membership consisted of skinheads and other young fellows who were next to broke, they had little ready cash, and as I have already pointed out, they did not even have enough money on hand to pay for transfer of the books over to their Headquarters. Everybody looked to me to fund everything, as if I had a bottomless gold mine at my disposal.

I have been asked by various people, why did I sell the church at all? After all, the church was consecrated ground, our starting point, our geographical Holy Center, much as Mecca is to the Moslems, Jerusalem to the Jews, and Nuremberg to the Nazis. All this is true, and it pained me more than anybody, since I had put so much of myself into the center. I hope that in some future day when we have become the worldwide religion of the White Race, we will be able to repossess it and restore it to its original pristine form. Much as it pained me to do so, there were several compelling reasons as to why I did what I had to do.

In the first place, at 74, old age was creeping up on me, and being mortal as everyone else, I did not want to kick the bucket and leave the movement floundering without a designated leader. As you will remember, I had been looking for the "great promoter' for the last ten years, without success.

Now, in 1992, 1 was determined to resign and do what I could to provide for continuity. Milwaukee seemed my best shot.
Secondly, the George Loeb case was coming to trial, and who could foresee what the consequences of that might engender. I realized that our properties were built for a specific purpose (to promote the cause of the Church of the Creator) and finding a buyer might be difficult and perhaps take years. I knew in order to make the deal attractive I would have to offer it at a price far below its real value. However, under the circumstances, time was of the essence, and in a way, was much more important than waiting for years, perhaps, in order to obtain a selling price that reflected its true value.

Fortunately, at the $100,000 asking price a bonafide buyer appeared on the scene in short order. His name was Dr. William Pierce, who had an operation similar to ours at his mountain complex near Hiilsboro, West Virginia.

Although only from a distance, I have known Dr. Pierce for about 18 years, but had met him only twice back in 1975 when he still operated on the outskirts of Washington, D.C. Our ideologies regarding race ran on a parallel course, although as far as religion was concerned, I never did understand the logic of what he called his Cosmotheism religion, no matter how many times he tried to explain it in his literature. But it has not been of any significance as far as our common goals of promoting White racial solidarity was concerned. I have always admired Dr. Pierce as a great man and an outstanding intellectual thinker, and as one of us. I had been corresponding with him, although infrequently, and off and on, as far back as 1975, and some of those letters appear in my books, The Klassen Letters.

When he moved from Washington to his mountain complex in West Virginia, I called him and had every intention of visiting him there, but somehow, I never got around to it. In early 1992 I invited him to come and visit us here in North Carolina instead, and on Sunday, March 22, 1992, he did indeed come down and spend the day here. We had lunch together, had a congenial visit, and I showed him our premises. He left me a collection of his fine magazine National Vanguard, (1982-1985), and also a 6" x 48" plastic tube for burying guns or other valuables. At that time (March 22) I had not yet given any thought to moving our headquarters to Milwaukee, or any other place.

However, about two months later, after my experience with Charles Altvater in trying him out as a succeeding Pontifex, I came to the inevitable conclusion that whereas our location here had been extremely productive, but it had, now that I was determined to retire, outlived its usefulness. I made preparations to move the Headquarters to Milwaukee, as I have described in the previous chapter, and sell the property for the bargain price of $100,000. About three weeks later, I tried to call Dr. Pierce and let him know the place was for sale and would he spread the word. Instead, I got Will Williams answering the phone and asked him to have Dr. Pierce call me back. Meanwhile, we got embroiled in a conversation, (Will Williams, you may recall, used to be my Hasta Primus at one time) and I mentioned to him that I was moving the Headquarters and putting the place up for sale at the bargain price of $100,000.

About an hour later (this was on June 6) Dr. Pierce did call back and surprised me by saying that he was willing to buy the premises at that price, and would immediately send me a letter to that effect, enclosing a $1000 in earnest money with it.
At 11 AM, on Sunday, June 21, William Pierce, his new Hungarian wife Susan, and Will Williams arrived in a big white van to reinspect the properties, to sort things out, and go over the property, including the boundary lines. Dr. Pierce and I hammered out the details of the transaction and tied them down in writing. It was to be a cash deal by Cashier's check, and the closing date was to be July 17th.

True to his word, at 9 AM William Pierce, his wife, and Will Williams arrived at my house. They had planned to be here earlier the previous night, in fact, but had had a transmission breakdown on the big white van. At 10 o'clock we all met at my attorney's office, Bobby Key, of Jones, Key, Melvin and Patton, in Franklin. The deeds were all prepared in advance and were duly signed. Everything went smoothly, except when it came to the prorationing and adjustment of taxes. The county had a surprise in store for me. The Macon County Tax Office, unbeknownst to me had the church properties divided into two parcels, Parcel One, on which the church resided, and another bill for Parcel Two, for the other 20 acres. Parcel One had been tax exempt until the last two years, but now that they deemed it taxable, they had sent the bills to Lighthouse Point, Florida, which they knew very well I had left nine years ago and the mail would not be forwarded. I'm not sure what their game plan was, but believe that they conspired that if I never saw those bills, and therefore could not take care of them, they would sooner or later foreclose on the main church building. It was undoubtedly one of Richard Lightner's tricks. However, at the closing, with the attorney inquiring into the total taxes due, they revealed that they had sent these bills to Florida, and that I was delinquent for the years 1990 and 1991, and I had to come up with an unexpected $2,133.54 in order to close the deal.

As agreed upon, Dr. Pierce came up with two cashier's checks totalling $100,000. I paid the extra taxes and signed the deeds, and the deal was completed. While in the Courthouse tax office paying the additional taxes, Will Williams said out loud "I wonder where Richard Lightner lives." Lightner was the scoundrel who had instigated the revocation of our tax exempt status, while all the other churches in the county were enjoying exemption without any hassle.

The four of us, Dr. Pierce, his wife, Will Williams and I, then went across the alley from the courthouse to have lunch at the Courthouse Plaza Restaurant. We were enjoying our meal, and were about half way through, when in saunters Sheriff Homer Holbrook up to our table with Richard Lightner at his heels, and said to me in a challenging tone, "I understand you were wondering where Richard Lightner lives. Why did you want to know?" I was somewhat surprised, since I had always considered us as being on a friendly basis in all our previous meetings. I said no, I never said that. At this point Will cut in and replied in a bravado voice "I said that." Holbrook turned on him and asked "Why do you want to know?" Will casually replied, "Oh, its just a hobby of mine." Then Sheriff Holbrook really started to chew Will out and I thought a real fight would ensue, but Will held his temper and took it. It sort of spoiled our lunch, but on the other hand, it provided unexpected entertainment. Actually, the Sheriff was out of line and out of his territory, since we were not in the county but within the city jurisdiction, and if anybody had any beef about Will exercising his First Amendment rights, it should have been the Franklin city police. I was somewhat irritated about the way they barged in on our lunch, but then, I was only an innocent bystander.

So ended our business transaction on a note of rancor and also amusement. Dr. Pierce, his wife and Will went back to the church cleaning up affairs, taking down our big eight foot logo and the large letters around it, saying THE CHURCH OF THE CREATOR. After some more cleaning up, the party of three left for West Virginia, their van loaded to the gills.

In January 2007, a spin-off calling itself the Creativity Alliance was formed. It's composed of individuals from Klassen and Hale's former groups as well as new members, but has no affiliation with the Creativity Movement. Like the Creativity Movement, the Creativity Alliance views Klassen as its founder. In many other ways, however, it differs from the Creativity Movement. It has a more informal organizational structure than the older organization, with individual members expected to find at least one receptive white person to join them in the formation of a local chapter.

The Creativity Alliance claims to eschew a future racial holy war and it has a policy of "non-participation in the 'White Power' social scene." It is hardly a benign organization, however. One of the articles featured on its website is a screed from 2008 by "Brother A.V.W." In it, the author repeatedly makes slurs against "niggers" and "the hideous Jews." He ends the piece, "White man fight! White man fight! White man fight!"

The first statement of the first paragraph, is dead wrong: the Creativity Alliance is NOT a "spin-off" of TCM. As is the first statement in the second paragraph: the Creativity Alliance does not eschew a future racial holy war, we believe we are currently living a racial holy war. The RaHoWa means far more than just a possible war of violence tomorrow or in the far flung future. It is everything from a daily struggle in one's own personal life, to a racial "cold war," individual skirmishes on the streets, AND the expected bloody racial war to come. As such, the Creativity Alliance does not and can not eschew the Racial Holy War.

FORMER Australian soldiers will be charged with manslaughter following an incident in Afghanistan last year, the Director of Military Prosecutions says.

"The accused persons will be charged with various service offences, including manslaughter, dangerous conduct, failing to comply with a lawful general order and prejudicial conduct,'' the director said in a statement.

The director, Brigadier Lyn McDade, had been considering whether to lay charges against the former commandos who conducted a night-time raid on a residential compound believed to harbour Taliban insurgents in February 2009.

Defence previously has said the deaths occurred as the soldiers conducted clearance operations using gunfire and hand grenades.

One suspected insurgent and five children were killed, while another two children and two adults were wounded.

Three former members of the Special Operations Task Group will be charged with service offences, Brigadier McDade said.

The soldiers facing charges were not named in the statement.

Brigadier McDade said her investigations had been completed only recently and only after "careful, deliberate and informed consideration''.

In a statement released the day after the attack, defence said the deaths occurred as SOTG soldiers conducted clearance operations through a number of compounds.

"During the conduct of this operation the soldiers were fired upon by Taliban insurgents,'' it said.

"The SOTG engaged the insurgents, returning fire in accordance with their rules of engagement.''

Australia: Founder Klassen mentions an Australian Minister. We of the Creativity Alliance do not consider that minister as we would any other minister. Some research has shown us that he is not right in the head and a member of a group of known traitors of which O'Sullivan is a part of.

Today I read in The Australian that the Australia Israel Chamber of Commerce has given the thumbs down for the NBN. They think it's infeasible as technology will change as the NBN is built. Not surprising since the initial cost has risen from several billion dollars to $46 billion last I looked. Even the head of the NBN claims that the NBN is a long term project that will last "years and years and years as it is upgraded." i.e. The NBN is a bottomless pit of government good will or another way to put it, tax payer dollars.

A way of looking at the NBN that most forget is to consider that it's not the immediately required communications system that we are told we need, but it is just a faster way for us to download our purchased movies and games in the new world order of globalist media through government legislated bodies that will police NBN traffic and retain a record of your actions indefinitely. Download something legally today, and when the law changes tomorrow, you may be arrested through retroactive legislation.

So who really wants what? From what I can see, groups like the Australia Israel Chamber of Commerce want broadband connections right around the world with the global governments policing everything you see an hear; but, now that they have their government of choice in power - the Australian Labor Party - they have decided to put a halt to massive government spending on the project and while continuing the Net Police system, encourage entrepreneurial expansion of the current 19th century wiring system. It does cost a lot less for the tax payer, but remember that groups like the Australia Israel Chamber of Commerce and the Marxists of the New World Order get exactly what they want on the cheap.

So why have groups like the Australia Israel Chamber of Commerce remained silent about their disapproval of the costs of the NBN until now? Simple: They had to get Labor into power to fulfil their dream of the federal government policing their customers for them. And history tells us that what the government initially sets up, the government sells to the highest bidder, who then change the rules and your information becomes a saleable item - or a means of having you arrested and fined millions of dollars for accidentally downloading that MP3 some Jewish site is giving away to every visitor that stumbles upon that page.

If that seems a bit far fetched consider that you can pick up a book from a friend or even pay cash at your local book store and nobody has any record of your personal transaction; but buy that book from Amazon.com or download that "conspiracy movie" and they - the government in the near future and the members of the Australia Israel Chamber of Commerce later on - will have a record on you that will last beyond your lifetime.

Tell your friends who voted Labor that and they'll call you a Liberal Party voting, right wing conspiracy nut - but, we know you are right. There will be no implementation of a National Broadband Network as planned, but there will be National Firewall more far reaching and deadly than any will ever admit.

Until about six months ago, I had never thought about population.  It simply wasn't in my realm of thinking.  However, one thing which gives me a little bit of solace is that most of my friends were the same.

In September 2009, my youngest daughter, Jenny, phoned me and said, "dad, they are all talking about human induced climate change, and they're all going off to Copenhagen.  Why don't they talk about the 'elephant in the room'".  I said, "Jenny, what's that?".  She said, "population!".

The instant she said the word, it was almost as if a light was turned on in my head.  Within seconds I realised how stupid I had been.  Here we were talking about problems which are facing our planet, but people weren't talking about the most obvious problem – too many people.  I knew that we had something like 6.7 billion people in the world, and this was predicted to go to over 9 billion by 2050.  But I'd never actually linked that with a great many of the problems we have in our world.

MADELEINE McCann suspect Raymond Hewlett confessed on his deathbed that he KNEW what happened to the little girl, The Sun can reveal.

In a letter to his estranged son Wayne, he denied having anything to do with Maddie's disappearance.

But he said he knew she had been stolen to order by a gipsy gang who kidnap children for wealthy couples unable to have kids or adopt.

Hewlett, a serial paedophile seen near the spot where Maddie was snatched in Portugal, said they had a "shopping list" of potential targets - such as a little girl with blonde hair like Maddie.

Private detectives working for Maddie's parents Kate and Gerry are "extremely interested" in Hewlett's claims.

A source close to their ongoing investigation said: "What he says fits the No1 theory, which is that she was stolen to order."

Hewlett died of throat cancer in April, aged 62, after persistently refusing to meet the McCanns' detectives.

He became a suspect because of his appalling record of rape and abduction of children.

And he was living as a nomad in Portugal with his second family when Maddie vanished from the McCanns' holiday apartment in Praia da Luz in May 2007.

Hewlett's letter to builder Wayne, 40, was delivered to the son by a mystery man - thought to be a solicitor or a private eye - a week after he died.

Most of it was an apology for how his vile crimes had affected his first wife Susan and Wayne.

But then he went on to write about Maddie, who was nearly four when she went missing.

Wayne, of Telford, Shropshire, said: "It was a bolt from the blue and I shook when I read it.

"He stated he didn't want to go to his grave with us thinking he had done such a horrible thing.

"He said he had had nothing to do with taking Maddie but did know who had.

"He said a very good gipsy friend he knew in Portugal had got drunk and 'let it out' that he had stolen Maddie to order as part of a gang.

"My dad said this gang had been operating for a long time and had snatched children before for couples who couldn't have children of their own.

"Maddie had been targeted. They took photos of children and sent them to the people they were acting for. And they said Yes or No.

"Dad said the man told him it was nothing to do with snatching children for a paedophile gang or for a sexual reason.

"He said there were huge sums of money involved. And he totally believed what this man was saying."

The account fits with others surrounding the Maddie mystery.

Several strange men were seen taking photos of children around the Ocean Club resort in the days before she vanished. And The Sun revealed earlier this year that a British expat thought he had seen Maddie in a white van driven by a gipsy couple the day after she was lost.

Wayne, who had no contact with Hewlett for nearly 20 years, said his father's letter seemed "very genuine".

He added: "I don't know if this is what happened to Maddie or not, but it does make sense. I can't believe he'd go to those lengths to make up some elaborate lie when he was so weak and ill."

Wayne said he considered going to Kate and Gerry with the letter but was worried it could cause them more heartache if it gave them false hope. He added: "I actually burned it because it unnerved me so much.

"To have a letter from someone you hated for so long was just mind-blowing. I couldn't deal with it."

Wayne did not contact The Sun about the message. We learned of its existence through a friend.

But now he intends to sit down with the Maddie detectives to tell them everything he knows.

The McCanns' spokesman Clarence Mitchell said last night: "We are extremely grateful to Wayne for coming forward with this information and the detective team will be interviewing him as a matter of priority."

The Church's web site <http://www.churchofthecreator.org> provides additional details, including the text of the Divine Right Order. World Church of the Creator, by contrast, does not worship God but instead depicts the "white race" as the "Creator" and calls for the elimination of Jews, blacks, and what it labels "mud races." Its slogan is: "Dedicated to the Survival, Expansion, and Advancement of the White Race." The World Church of the Creator's beliefs are explicated more fully in Nature's Eternal Religion, a book by its founder, Ben Klassen, and on its web site <http://www.wcotc.com>. The Church of the Creator is a recognized religious charity. The World Church of the Creator, as a racist group, is not entitled to that benefit, see Bob Jones University v. United States, 461 U.S. 574, 103 S.Ct. 2017, 76 L.Ed.2d 157 (1983), and has had its charitable status revoked by both state and federal governments. See Church of the Creator, Inc. v. CIR, 707 F.2d 491 (11th Cir.1983); People ex rel. Ryan v. World Church of the Creator, 198 Ill.2d 115, 260 Ill.Dec. 180, 760 N.E.2d 953 (2001) (discussing related issues following the loss of state tax-exempt status in 1995). (Note the change from "Church of the Creator, Inc." to "World Church of the Creator," an unincorporated association. This is apparently part of a judgment-proofing strategy after a court held in 1994 that Klassen's organization must pay damages for orchestrating a murder. Mansfield v. Pierce, 1998 WL 433304, 1998 U.S.App. LEXIS 17086 (4th Cir. July 27, 1998), supplies details. Klassen committed suicide in 1993, and Matt Hale became "Pontifex Maximus" of the reconstituted organization in 1996.)

What has led to this litigation between the two organizations is the little® symbol attached to Church of the Creator. (To promote clarity, from now on we refer to the Church of the Creator as "the Foundation" and the World Church of the Creator as "the World Church.") Klassen founded and named his group in 1973, while the Foundation did not begin using "Church of the Creator" until 1982. But the Foundation was first to take advantage of the federal trademark-registration system, seeking protection in 1987 for its name and symbol (a radiant dove centered on a six-pointed star with a multi-colored background):

The Patent and Trademark Office (PTO) granted the Foundation's application in 1988, though it required the Foundation to disclaim any right to the word "church." See Trademark Registration No. 1,496,724. Five years passed, during which Klassen's group did not protest this registration. The PTO then accepted and filed a declaration that the mark had become incontestable under 15 U.S.C. § 1065 — which means that it may be enforced, without proof of secondary meaning, even if it is a descriptive name for the qualities or characteristics of a good or service. See Park `N Fly, Inc. v. Dollar Park and Fly, Inc., 469 U.S. 189, 105 S.Ct. 658, 83 L.Ed.2d 582 (1985). When the Foundation began to receive protests about its supposedly racist creed — complaints demonstrating confusion between the two groups — it set out to enforce its incontestable mark by seeking an injunction against the World Church's use of what is obviously a confusingly similar name. The groups' symbology differs, as the World Church's banner shows:

But the Foundation's mark includes the name as well as the graphic presentation.

Although an incontestable mark may be enforced even if it is descriptive, it is subject to cancellation if it is or becomes generic. Section 1065, which sets out the rules for incontestable marks, begins: "Except on a ground for which application to cancel may be filed at any time under paragraphs (3) and (5) of section 1064 of this title", and § 1064(3) permits cancellation "[a]t any time if the registered mark becomes the generic name for the goods or services, or a portion thereof, for which it is registered." Thus as the Court recognized in Park `N Fly an incontestable mark does not confer any rights to a phrase that was generic at the outset or has become so through use. "A generic term is one that refers to the genus of which the particular product is a species." 469 U.S. at 194, 105 S.Ct. 658. The World Church's defense in this suit is that "Church of the Creator" is generic: that it names the genus of all monotheistic religions, of which particular creeds such as Judaism, Christianity, and Islam (and all their many subdivisions) are the species. The Foundation replied with two procedural points: first, that although generic status allows cancellation of a mark by the PTO under § 1064, it does not afford a defense while the mark remains uncancelled; second, that incontestable status provides at least a powerful presumption that the mark is non-generic, a presumption that can be overcome only by strong evidence of actual usage. The district judge brushed aside both of these arguments and, relying exclusively on dictionary definitions of the word "creator," entered summary judgment for the World Church. TE-TA-MA Truth Foundation — Family of URI, Inc. v. World Church of the Creator, 2002 WL 126103, 2002 U.S.Dist. LEXIS 1478 (N.D.Ill. Jan. 31, 2002).

On appeal the Foundation repeats its contention that the PTO, rather than a court, is the proper forum for any contention that an incontestable mark is generic. This contention, which relies principally on 15 U.S.C. § 1115(b) ("To the extent that the right to use the registered mark has become incontestable under section 1065 of this title, the registration shall be conclusive evidence of the validity of the registered mark"), finds some support in the language of Sovereign Order of St. John of Jerusalem, Inc. v. Grady, 119 F.3d 1236, 1240 (6th Cir.1997), but not in the holding of that or any other circuit — and it is untenable. Even if a mark must be canceled before enforcement may be denied, trademark law does not reserve the cancellation power to the PTO. A court may cancel a mark itself or order the agency to do so. 15 U.S.C. § 1119. So even if the sequence must be generic status to cancellation to nonenforcement, a court can handle all of the stages. This means that the generic nature of a mark may be a defense in litigation. And if a court may order a mark canceled, an incontestable registration is more like a bursting-bubble presumption of non-generic-ness than like the sort of indomitable presumption that the Foundation seeks. Like the district court, then, we proceed to ask whether "Church of the Creator" is generic.

Unlike the district court, we conclude that this phrase is descriptive rather than generic. Appellate review of a summary-judgment decision is plenary. Both sides moved for summary judgment, so each was required to introduce evidence to show that a material issue of disputed fact remained for decision. Confronted with the Foundation's motion, the World Church produced — nothing but a dictionary. It did not offer any evidence about how religious adherents use or understand the phrase as a unit. It offered only lexicographers' definitions of the individual words. That won't cut the mustard, because dictionaries reveal a range of historical meanings rather than how people use a particular phrase in contemporary culture. (Similarly, looking up the words "cut" and "mustard" would not reveal the meaning of the phrase we just used.)

Contemporary usage does not treat "Church of the Creator" as the name for monotheistic religion — or any other genus of religion. If it were, then the World Church itself would be misusing the phrase, for it is not theistic in any traditional sense and has nothing in common with Judaism, Christianity, or Islam. The World Church's web site, and much of its literature, feature one international negation symbol (a circle with a diagonal bar) superimposed over a Star of David and another superimposed over a cross. It condemns the Bible as a hoax.

A mark is "generic" when it has become the name of a product (e.g., "sandwich" for meat between slices of bread) or class of products (thus "church" is generic). But "Church of the Creator" is descriptive, like "lite beer." It does not name the class of monotheistic religions. In the contemporary United States, variations on "Church of [Deity]" are used to differentiate individual denominations, not to denote the class of all religions. The list is considerable: Church of God; Church of God (Anderson, Indiana); First Church of God; Worldwide Church of God (see Worldwide Church of God v. Philadelphia Church of God, Inc., 227 F.3d 1110 (9th Cir.2000)); Church of God in Christ; Assembly of God; Korean Assembly of God; Church of the Nazarene; Church of Christ; United Church of Christ; Disciples of Christ; Church of Christ, Scientist; Church of Jesus Christ of Latter Day Saints. There is room for extension with Church of Our Savior, Church of the Holy Spirit, Church of the Holy Trinity, Church of Jehovah, and so on. Yet all of these are recognizable as denominational names, not as the designation of the religion to which the denominations belong. No Jewish, Islamic, Baha'i, or Unitarian group would say that it belongs to a "Church of the Creator"; and a Christian congregation would classify itself first into its denomination (e.g., Baptist, Lutheran, Russian Orthodox, Society of Friends), then into one of the major groupings (Roman Catholic, Orthodox, and Protestant), and finally into Christianity, but never into a "Church of the Creator." No one called or emailed a Baptist church to complain about its complicity in the hate-mongering of the World Church of the Creator; people recognized the name as denominational, and that's why protests ended up in the Church of the Creator's in box.

What is more, as these lists show, using "Church of the Creator" as a denominational name leaves ample options for other sects to distinguish themselves and achieve separate identities. It is not remotely like one firm appropriating the word "sandwich" and thus disabling its rivals from explaining to consumers what's to eat. When the line between generic and descriptive terms is indistinct — as it is, for example, with a phrase such as "liquid controls," see Liquid Controls Corp. v. Liquid Control Corp., 802 F.2d 934 (7th Cir.1986) — it is helpful to ask whether one firm's exclusive use of the phrase will prevent a rival from naming itself and describing its product. (As far as the Lanham Act is concerned, a denomination is a producer and religious services and publications are products. Neither side has questioned the application of trademark laws to religion.) Because there are so many ways to describe religious denominations, there is no risk that exclusive use of "Church of the Creator" will appropriate a theology or exclude essential means of differentiating one set of beliefs from another.

The World Church has a fallback argument: that recognizing a trademark in "Church of the Creator" violates the first amendment. Yet as San Francisco Arts & Athletics, Inc. v. United States Olympic Committee, 483 U.S. 522, 107 S.Ct. 2971, 97 L.Ed.2d 427 (1987), observed when rejecting a similar contention, the Constitution itself authorizes Congress to create rights of this kind. Cf. Harper & Row, Publishers, Inc. v. Nation Enterprises, 471 U.S. 539, 105 S.Ct. 2218, 85 L.Ed.2d 588 (1985). Trademark rights promote the aims of the first amendment by enabling producers of the spoken and written word to differentiate themselves. If multiple businesses use the same (or confusingly similar) names, the result is cacophony rather than discussion or debate. If every candidate on the ballot ran under the same name, this would do more to befuddle the voters than to promote the candidates' freedom of expression. Cf. Grimes v. Smith, 585 F.Supp. 1084 (N.D.Ind.1984), affirmed, 776 F.2d 1359 (7th Cir.1985). It is questionable whether the World Church is a religion (not all philosophical beliefs are religious), but, if it is, still Congress need not exempt religions from generally applicable laws. See Employment Division v. Smith, 494 U.S. 872, 110 S.Ct. 1595, 108 L.Ed.2d 876 (1990). The World Church has every right to a distinctive name; it does not have a constitutional right to use some other denomination's incontestable trademark.

By this time, a reader familiar with the Lanham Act may have grown frustrated by our inattention to what must seem the most obvious argument on behalf of the World Church: prior use. Ben Klassen published Nature's Eternal Religion, and adopted the name "Church of the Creator," in 1973, nine years before the Foundation began using that phrase. Section 1065 provides that even incontestable marks must yield to "a valid right acquired under the law of any State or Territory by use of a mark or trade name continuing from a date prior to the date of registration under this chapter of such registered mark". Yet the World Church has not urged prior use as a defense, presumably because of the reorganization designed to avoid paying the judgment mentioned in this opinion's opening paragraph. The corporation that adopted the name "Church of the Creator" in 1973 no longer exists; the organization "World Church of the Creator" formed in 1996 is junior to the Foundation. It turns out that tactics adopted to avoid paying for one's wrongs have collateral costs.

The judgment of the district court is reversed, and the case is remanded with instructions to enter an appropriate judgment in favor of the Foundation.

ROMANIA'S central bank stood firm overnight against accusations of racism from the Holocaust Museum in Washington over minting a coin depicting a leader who held anti-Semitic views.

"No decision has been taken over the suspension of this coin," the National Bank of Romania (BNR) spokesman said, adding that it was still available for people to buy.

To mark 125 years since the setting up of the Romanian Orthodox Church, the central bank had minted five silver coins carrying the images of its patriarchs since 1925.

The first of the five was Miron Cristea, who led the Church between 1925 and 1939 and headed the Romanian government from 1938-39.

As prime minister, Cristea amended the citizenship law, thereby stripping 225,000 Jews (or 37 per cent of the country's total Jewish population) of their Romanian citizenship.

At the start of August, the BNR received letters of protest from the Holocaust Memorial Museum in Washington and the Elie Wiesel National Institute for the Study of Holocaust in Romania.

The BNR set up an internal commission to look into the issue.

It affirmed that its selection was "in no way and by no means intended to hurt the feelings of any community, to prejudice the interests of specific groups or to convey xenophobic, racist or anti-Semite messages".

A BRITISH man is due to face court after allegedly raiding a bank, then throwing his loot in the street and sitting down cross-legged on the sidewalk.

Police arrested Christopher Allnutt, 42, outside a branch of Barclays in Winchester, southern England, yesterday morning, only to find most of the cash had been snapped up by eager passers-by.

Detective Inspector Andy Symes appealed to people's better natures to return the notes, saying: "We would ask that any members of the public who have found money in Jewry Street [in Winchester] - or surrounding streets - to please hand the money into their nearest police station, as this money is evidence in our investigation."

Mr Allnutt, from Southampton, southern England, allegedly told the bank's terrified cashiers he was armed, but police did not find a weapon.

He was charged with robbery and is set to appear at Aldershot Magistrates Court.

Manoj Singh, 24, was found dead last night with burns to his left ear, neck and shoulders in a forest near Bandha village close to the city of Kota in the northern Indian state of Rajasthan, The Times of India said.

Police believe the youth was killed by an exploding mobile phone after finding pieces of the Nokia 1209 handset, a basic model released in August 2008, scattered nearby.

The youth had gone to the forest to graze his cattle about noon yesterday local time.

His body was recovered later that night.

In France, a writer, father of eight, is in prison for his historical research. And the so-called free press says nothing about it!

With a wife and eight children, the Frenchman Vincent Reynouard, aged 41, is a chemical engineer by training, a graduate of the ISMRA ("Institute of sciences of atomic matter and radiation") in Caen (Normandy). He readily presents himself as a traditionalist Catholic and does not hide his ultra-conservative political opinions. But, most important, he publicly disputes, in his DVDs and writings, the conventional version of Second World War history. He is one of those researchers who declare themselves to be "revisionists" and who are called "deniers" by others because they do not believe in the existence of homicidal gas chambers in the wartime German concentration camps.

In 2005, Reynouard wrote and sent to numerous tourism offices, museums and town halls a 16-page brochure entitled "Holocaust? Here's what's kept hidden from you...", in which he took a view altogether opposite to that of academic history. French justice immediately pounced upon him.

His trial in 2007 at the criminal court in Saverne (Alsace) resulted in a sentence of one year's imprisonment, a fine of 10,000 euros and an order to pay damages of 3,000 euros to the antiracist league "LICRA". In June 2008 the court of appeal in Colmar upheld the prison sentence and ordered him to pay a total of 60,000 euros (a 20,000 euro fine, damages, mandatory publication of the ruling and court fees). Severity as never seen before.

Since he resides in Belgium, France launched a European arrest warrant for Reynouard in order to make him serve the prison sentence ordered by the Colmar court. On July 9th he was imprisoned by the Belgian police, pending his extradition to France. All of which leads him to say: "When people can think of no other way but imprisonment to get rid of a verbal opponent, it's because they have no arguments."

Conclusion: A 41-year-old father of eight is currently in prison for his historical research, because of the Gayssot Act.

This Act of the French parliament ("article 24bis" of the law governing the press), having come into effect upon publication in the Journal Officiel on July 14th 1990, prohibits the "disputing (...) of the existence of one or more crimes against humanity as defined by Article 6 of the Charter of the International Military Tribunal [known as the Nuremberg Tribunal] in annex to the London Agreement of August 8th, 1945. "

In my book Sarkozy, Israël et les Juifs (Oser Dire publishers, [Belgium], 2009), I recall that this freedom-killing law has been strongly criticized in the past by such personalities as the French academician Simone Veil; the Permanent Secretary of the French Academy, Hélène Carrère d'Encausse; the government ministers Jean Foyer, Jacques Toubon, Alain Peyrefitte; the historians Henri Amouroux, Pierre Vidal-Naquet, Annie Kriegel, Francois Furet, Alain Besançon, Jacques Willequet and François Bédarida; the founder of the Hannah Arendt Research Institute, Chantal Delsol; the 1988 Nobel laureate for economics, Maurice Allais; the writers Michel Tournier, Louis Pauwels, Michel Houellebecq, Philip Murray, Jean Daniel, Vladimir Volkoff, Michel Rachline and Alain Robbe-Grillet; the judges Philippe Bilger, Alain Marsaud and Raoul Béteille; the legal scholars Olivier Duhamel, Anne-Marie Le Pourhiet, Emmanuelle Duverger, André Decoq and Guy Carcassonne; the lawyers Jacques Vergès and John Bastardi Daumont; the philosopher Paul Ricœur; the comedian Bruno Gaccio; defenders of the freedom of expression like the founder of Reporters Sans Frontières Robert Ménard (who denounces it as a "thought police") and Gabriel Cohn-Bendit; the journalists Dominique Jamet, Delfeil de Ton, Alain Rollat, Albert du Roy, Philippe Tesson, Jacques Julliard and Ivan Rioufol; also by the former president of the Ligue des droits de l'homme, historian Madeleine Rebérioux. Abroad, the American linguist Noam Chomsky has declared himself an absolute opponent of it. For the Belgian physicist and intellectual Jean Bricmont, "the Gayssot Act is a legal regression of several centuries". As for Presidents Hugo Chávez and Mahmoud Ahmadinedjad, they have strongly condemned the repression resulting from this law.

Henceforth it falls to us to defend free expression in deed and not just in theory. Why is no one heard publically denouncing the present fate of Vincent Reynouard? What are Reporters Sans Frontières, Amnesty International and Human Rights Watch doing? No organ of the media, either French or foreign, has informed public opinion of this case. Such silence is abnormal.

Personally, I have decided to act as a historian and as a citizen, and to make it known, through this press release, how appalled I am at the fact that, in our country, we have a man thrown into prison for his opinions, however unusual, shocking and controversial they may be. Such treatment is not worthy of France or her intellectual tradition. It is not for the law to say how historical truth is set down: in a free country, that is the task of historians.

The Gayssot Act, which restricts the historian's freedom, is unworthy of a democratic State; it is a wicked law. I therefore ask for its immediate repeal.

I hope to be joined soon by dozens, hundreds, thousands of other people unable to remain indifferent in the face of a scandal that seriously harms the image of France and flouts the spirit of the Republic.

A SOUTHPORT magistrate has found the terms 'sandnigger' and 'nigger' are not offensive to a reasonable person.

Magistrate Michael O'Driscoll made the ruling yesterday when he dismissed a case against a Gold Coast retiree charged with sending an offensive facsimile to a local politician.

A staff member working for Broadwater MP Peta-Kaye Croft complained to police after receiving the document from 62-year-old Denis Mulheron of Labrador on June 30 last year.

Christie Turner, 28, told Southport Magistrates Court she was deeply offended when she read the one-page fax which called on the Labor Party to tighten immigration laws against 'niggers' and 'sandnigger terrorists' and Muslim women with circumcised genitals.

The fax also made reference to indigenous Australians as 'Abos'.

Mr Mulheron told the court he believed he was using 'everyday English' in the fax.

He said he had grown up with the slang terms for Arabs and black Africans and did not believe they were offensive.

"I'm not a member of the cafe, chardonnay and socialist set ... to me that is everyday language," he said.

He argued in court the slang terms were no different to calling a New Zealander a 'Kiwi' or an American a 'Yank'.

Barrister Chris Rosser said his client had been raised in a different time when the words were not as frowned upon.

Ms Turner said to her, as a young woman, Mr Mulheron's words were both offensive and disturbing.

"There are appropriate ways to express opinions about immigration policies and this was not one of them," she said.

Mr Mulheron was charged with using a carriage service, namely a fax machine, to menace, harass or offend -- a offence which carries a maximum penalty of three years jail.

After lengthy consideration, Mr O'Driscoll ruled that Mr Mulheron's words were not enough to invoke criminal sanctions.

"The words used were crude, unattractive and direct but were not offensive to a reasonable person," he said.

But he made it clear the court in no way condoned Mr Mulheron's comments.

He invited Mr Mulheron to seek legal advice before using the terms in a public forum again.

The court was told that over the years Mr Mulheron had sent repeated faxes to Ms Croft's office complaining about the Labor Party, immigration and land taxes.

He pleaded guilty in 2006 to sending a personally abusive fax to Ms Croft.

The case comes after a judge in the Queensland city of Townsville ruled last Thursday that it was acceptable for people to tell police officers to "f*** off."

Townsville judge Peter Smid threw out a case against Bardon Kaitira, 28, who swore at a female officer outside a nightclub on December 20 last year in the early hours of the morning.

Judge Smid said: "The defendant spoke normally, he had his hands in his pockets and walked away. It's not the most polite way of speaking but those who walk the beat would be quiet immune to the words."

AN Australian woman has made American magazine history - and sparked a storm of protest - by becoming the first white fashion director of iconic black lifestyle publication Essence.

The hiring of Elliana Placas in the role - after a 40-year history of having an African American as fashion director - has been met with a vicious reaction from both readers and industry identities.

Essence, dubbed the ultimate fashion and lifestyle magazine for black women, has been slammed for the decision, with the magazine's former fashion editor, Michaela Angela Davis, launching an attack against Ms Placas' hiring.

"It is with a heavy, heavy, heart I have learned that Essence magazine has engaged a white fashion director," Ms Davis wrote.

"This hurts, literally, spiritually. If there were balance in the industry, if we didn't have a history of being ignored and disrespected, if more mainstream fashion media included people of colour before the ONE magazine dedicated to black women 'diversified', it would feel different."

Ms Davis' comments resulted in fierce debate online and news organisations across the US have picked up the story.

Ms Placas' resume is impressive since moving to the US from Australia, working on a mix of mass-selling American publications including 0: The Oprah Magazine, Us Weekly, New York, More and Life & Style.

Essence editor-in-chief Angela Burt-Murray defended the hiring of the Australian, telling the New York Post she understood "this issue has struck an emotional chord with our audience" but explained Ms Placas was hired after working on the magazine on a freelance basis for six months.

Ms Burt-Murray said Ms Placas showed "creativity", "vision" and "enthusiasm and respect for the audience and our brand" while the reader response to her work had been positive.

But several African-American commentators accused the magazine of robbing a black woman of a rare job in fashion media by hiring Ms Placas.

"The fashion industry at large is a very hard place to be if you have a black or a brown face," Style consultant Najwa Moses said.

"Essence is the one place we think, 'Oh, if I keep moving up in my career, I might make it there'."
