THE Aboriginal corporation watchdog has defended its decision not to pursue criminal proceedings against an indigenous organisation accused of misappropriating funds. 
 
It's the same watchdog recently brought into question by the prime minister's chief indigenous adviser, Warren Mundine, who has called for an overhaul to make the office tougher.

Complaints were made to the Office of the Registrar of Indigenous Corporations about the misuse of funding by the Jawoyn Association in February last year, prompting an investigation.

Allegations by former employees, including the purchase of a home for former-chief executive Preston Lee, personal use of a helicopter and payments to lawyers to defend assault changes, were aired by ABC's Four Corners in October.

These employees say the expenses forced the organisation, set up to represent traditional owners and manage profits generated by the land, to the brink of insolvency.

ORIC's decision not to proceed with criminal charges following its investigation was questioned by Independent senator Nick Xenophon in a Senate estimates hearing on Friday.

Registrar of Indigenous Corporations Anthony Beven said there was insufficient evidence to refer the matter to the commonwealth director of public prosecutions.

An independently appointed criminal barrister also came to that conclusion, Mr Beven.

However, his office issued Jawoyn with a notice of compliance - and they did.

"How a corporation spends its private money, not sourced from government funds, is a matter for the corporation and its directors," Mr Beven said.

Senator Xenophon also questioned recent revelations by The Australian newspaper that another unnamed organisation had been misappropriating funds.

Mr Beven said his office had also investigated those allegations and found no breaches.

He has "more than sufficient staff" numbers to deal with potential prosecutions and is confident his office can fully deal with any complaints made.

However, Mr Beven admitted there were circumstances involving trusts not linked to Aboriginal corporations where his office had no jurisdiction.

Senator Xenophon asked whether that was a loophole allowing directors to channel millions into trusts that couldn't be investigated.

"There are situations where I have no powers," Mr Beven said.

Indigenous Affairs Minister Nigel Scullion said he was not particularly concerned about the statutory powers of ORIC, but he would seek further information on the matter.

Northern Territory politician Larisa Lee has avoided jail after pleading guilty to assaulting her niece for having an affair with her partner. 
 
Lee, 31, faced the Katherine Magistrates Court on Tuesday, having told reporters as she arrived that she felt "it will all come to an end, finally ... it will be a good outcome".

She pleaded guilty to assault and disorderly conduct charges.



The court heard that on April 24, the Palmer United Party MLA found out her niece Sherese Dooley, 20, was having an affair with her partner, Benjamin Ulamari after finding photos on his phone. She tracked her niece to the Katherine Centrelink(LIKE WHERE ELSE COULD YOU FIND A COON FAMILY MEMBER?) and called her outside to discuss the affair, before assaulting her.

"Instead of talking through the issues, you responded in a different way," Magistrate Elisabeth Armitage said.

"You got out of the car when you saw her, you went up to her, grabbed her by the hair and dragged her across a concrete driveway. "You didn't stop there, but then proceeded to punch her a number of times to the head with a closed fist. You swore at her and threatened her." Ms Dooley escaped the assault with a cut to her knee and many people witnessed the incident.



Lee's lawyer Ron Hope said her "emotions boiled over" and that she had been "totally humiliated" by the events leading up to the assault, known of by all in the small Katherine community.

But Lee was not seeking special treatment due to her role in public life, he said.

Ms Armitage said Ms Dooley was also humiliated by the attack, and had filed a domestic violence order against Lee.

"Jealousy is not an extenuating circumstance," she said, but noted Lee was unlikely to ever commit such an offence again, had no prior criminal history and had contributed significantly to the community.



Lee was convicted of aggravated assault and received a $1000 good behaviour bond, with no jail time to be served.

She received no conviction for the charge of disorderly conduct, but received a $300 fine along with $300 to be paid as a victims' levy.

Ms Peris, who was working as a communication officer with the Australian Institute of Aboriginal & Torres Strait Islander Studies at the time and as ambassador for Athletics Australia, sought funds from Athletics Australia and other sources to pay for Mr Boldon's trip to Australia from Los Angeles to take part in a 10 day official "Jump Start to London" program for young athletes.

In other emails obtained by the NT News, Ms Peris sends multiple nude pictures of herself to Mr Boldon and speaks candidly about her views on race relations in Australia.

"...You should be compensated for your long haul travels across the pacific.. sexually of course... but only .. a tired traveller should kick back for a few days," Ms Peris says on Feb 28, 2010.

In other emails, Ms Peris details how she was working to obtain additional money for Ato Boldon from various other sources including indigenous groups, Commonwealth Bank, Collingwood Football Club and Channel 10 in Melbourne.

The exact total of money Mr Boldon received is unclear but in an email from mid-March, Ms Peris writes that she had managed to round up $22,000 for him, on top of the money Athletics Australia paid.

"It's not that I don't think it is unreasonable, and i totally agree you should be paid up front, its just that the money is government funds, with govt funding here, the normal procedure is to apply for grants, and because the money is discretionary funding they pay to an organisation then they pay you ..." she wrote.

"...this is all black money babe.....but rightly so being used for the interest of indigenous kids babe....white people hate black people in this country, and don't like for things to happen if there is no salt in the mix...."

Readers, note that in the mainstream press there is no outcry about this Indigenous, hateful, conniving thief, Peris being "RACIST!" There is no immediate demand she stand down. There are no claims that she is unable to serve the majority White public that she has such a hatred for. Yes, her emails are printed in part, but there is absolutely no judgement. No trial by media as there would be should the races were reversed. Instead, it is simply talk of misappropriation of funds and a request for an explanation. This has resulted in accusations by Peris, of stolen emails and blackmail, thereby turning her into the victim.

Why? Because only White people are racist. Accusing non-Whites of racism is itself racist. If you don't believe it, just ask any school teacher, any police officer, any mainstream journalist, any politician or fatheaded self appointed, liberal champion of this jumped up, hypocritical society we live in. And if you do actually have the balls to ask the hard questions, expect to accused yourself of racism for merely ASKING THE QUESTIONS THAT NEED TO BE ASKED!

MORE leaked emails relating to Labor senator Nova Peris have surfaced online, raising new questions about her allegations of extortion.

The new turn came as Tony Abbott declared that the allegations against the senator had been "answered" and Communications Minister Malcolm Turnbull questioned the media's role in the sex scandal.

Mr Turnbull questioned the decision to publish intimate details not directly linked to the suspected wrongdoing.

She was appointed by the Northern Territory Legislative Assembly to fill the casual vacancy created by the resignation of Senator Bob Collins. Crossin was Deputy Opposition Whip in the Senate 2001–2004.

Crossin was informed by the Prime Minister Julia Gillard on Monday 21 January 2013, before a public announcement a day later, that she would not have her backing as the Senate candidate for the Australian federal election, 2013, and that the Prime Minister would be supporting the former Olympian Gold Medallist and Aboriginal activist Nova Peris.



It is clear she isn't suitable for a political role! how about they just demand she stand down.. you can't have coons running the place they are just :- corrupt, child like, hot headed and incompetent! So what if they were here first.. they never did anything but make 3 different sticks!
