Hunt for 'dark-skinned' suspect who raped teenage boy on Cairns highway

A teenage boy has been sexually assaulted by a "dark-skinned" man while walking along a highway in the aboriginal crime-ravaged city of Cairns in Far North Queensland.

Detectives from the Cairns Child Protection and Investigation Unit (CPIU) are appealing for public assistance, and said the boy was approached and attacked by an unknown man on the Captain Cook Highway in Smithfield at about 6.30pm on Tuesday.

The attacker fled on foot after the sexual assault.

"The male is described as having a dark complexion, black hair with a fade cut, and was wearing a black t-shirt with graffiti-style writing on it, black shorts and slides," police said.

"Police are appealing for anyone who saw the male or has relevant CCTV and dashcam from the Captain Cook Highway between Reed Road and McGregor Road between 5.10pm and 5.50pm."

A teenager has been arrested over the "prolonged" alleged sexual assault of another boy in a highway underpass in the aboriginal crime-ravaged city of Cairns in Far North Queensland.

Last week police made an appeal to track down a suspect, then believed to be an adult, with a "dark complexion [and] black hair with a fade cut" after the alleged attack on the Captain Cook Highway in Smithfield at about 6.30pm on October 14.

Queensland Police said on Wednesday they had arrested a 17-year-old and charged him with three counts of indecent treatment of a child under 16, three counts of making child exploitation material, possess child exploitation material, taking child for immoral purposes, stealing and graffiti.

The teenager, who cannot be named due to his age, then appeared in Cairns Magistrates Court, which heard allegations he filmed the alleged attack and had a criminal history, the Cairns Post reported.

Magistrate Sandra Pearson described the allegations as "abhorrent" and noted the accused had been convicted of "similar conduct" in 2020 and placed on a restorative justice order, and again in 2023 when he was given probation.

"It's that level of sinister behaviour that causes me a huge amount of concern ... He's not just a risk to this young boy, he's of a generalised risk to the community over all," she said.

"I have to take into account the allegations – these are extremely serious – it was quite prolonged. It's quite predatory, I have to say, waiting where he was, allegedly, and undertaking various acts – the recording of it and parts of the footage is located ... in my view at this point it is a strong prosecution case.

"It also, on the allegations, would have been very clear to (the accused) fairly early on in the event that this young boy was not a willing participant and was being traumatised by what was happening. and he persisted, allegedly, and there have been some threats made about telling people, and what the consequence might be."

The boy's lawyer Katherine Shepherd applied for bail on her client's behalf, saying he had a supportive family would comply with any conditions.

Magistrate Pearson refused bail and the teenager was remanded in custody to face court again on December 2.

A psychotic African thug who was jailed for just one year for bashing three strangers in a violent rampage on the day he was released from a mental health ward in Bendigo while out on bail for assault and robbery has lost his bid to avoid deportation.

Prosecutor David Cordy said Mhindurwa, who has already spent 304 days in custody, should be refused a community corrections order as it would be "totally inadequate", and called him the "author of his own doom", the Herald Sun reported.

A thug's desperate bid to have his jail sentence reduced to dodge deportation back to New Zealand has been shot down after he attacked two people in Bendigo with such "ferocity" that he was arrested covered in his victim's blood.

Tafadzwa Mhindurwa, 24, was sentenced in September to two years' jail with a 12 month non-parole period after pleading guilty to three, "unprovoked" attacks on random people in Melbourne and Bendigo.

After serving 304 days in custody Mhindurwa played the last card in his hand amid a County Court appeal on Wednesday, arguing that if he wasn't let out in the next 52 days he would likely be deported.

Non-permanent residents who spend more than 12 months behind bars are usually deported, unless they can prove exceptional circumstances.

Mhindurwa, who is a diagnosed paranoid schizophrenic, believed he was "some sort of secret agent carrying out some sort of mission" when he attacked a man on the 7.52pm V/Line in November 2024 at Bendigo railway station, a court previously heard.

Mhindurwa had been released from the psych ward just hours before CCTV footage captured his "violent, sustained and ferocious" attack while the victim's partner screamed and begged Mhindurwa to stop.

After brutalising the man, Mhindurwa jumped off the V/Line at Kangaroo Flat and proceeded to immediately randomly attack another man on the street – breaking his nose and leaving him with "significant bleeding".

He was arrested nearby "covered in the blood of both victims".

The thug was also sentenced for a random, vicious attack on Chapel St, Prahran where he broke a man's nose and eye socket when he smashed him in the face in May last year – leaving him requiring surgery and with ongoing brain injuries that had impacted his daily life.

Mhindurwa's lawyer Daniel Ajax blamed the offending on his client's mental health issues and drug abuse and argued for him to be released in to the community to seek mental health treatment – despite the court hearing evidence that Mhindurwa had been non-compliant with mental health services and medication in the lead up to the assaults. Police prosecutors said he had failed to comply with mental health treatment and abused meth and cannabis.

Prosecutor David Cordy said Mhindurwa was the "author of his own doom" and the court needed to uphold the prison sentence because a community corrections order would be "totally inadequate".

Mhindurwa was on appeal bail at the time that had been granted by the County Court for "very similar offending", which made the matter more serious.

Judge Kevin Doyle said Magistrate Trieu Huynh's sentencing for the "very serious, random attacks on members of the public" had been appropriate, declining to decrease or increase the sentence.

Mhindurwa now faces the possibility of being detained by immigration and held in immigration detention ahead of deportation to New Zealand.
