MPs overseeing the official brochure for the 'no' case in the Indigenous Voice to Parliament referendum are refusing to say whether it will include an inflammatory claim by Senator Pauline Hanson debunked as a falsehood by experts.

The clash over the issue puts two leading campaigners on the 'no' side of the debate on a collision course over a critical piece of public information about the referendum – but one that is not legally required to be accurate


There are less than two weeks remaining for the official 'yes' and 'no' cases for the Indigenous Voice referendum to finalise the wording of an official information pamphlet to be distributed to all Australian households

Ensuring that the hard-copy pamphlet would be sent to 12 million households was a key demand made by Opposition Leader Peter Dutton during negotiations over a recently passed bill allowing for the referendum to be held.

Politicians who voted in favour of a recently passed constitutional alteration bill can contribute to the 'yes' essay and vice versa; their contents must be authorised by a majority on either side.

Essay excerpts

Senator Hanson is pushing for the inclusion of excerpts from her own 2000-word essay on the subject.

It alleges that the Voice would "effectively undo the great achievement of the 1967 referendum" which led to Indigenous Australians being counted as people in the Census for the first time by undermining constitutional equality.

The Voice would, the essay claims "be a vehicle for constant litigation in the High Court, resulting in multiple constitutional crises".

Changes flowing from the referendum, it claims, could lead to "hundreds of millions" of dollars in legal settlements, the cost of which would be borne by "non-Indigenous taxpayers".

"As these cases are being decided, Parliament and the executive government will be left effectively powerless and constantly subordinate to the Voice," the essay asserts.


That claim is made despite the proposed amendment to the Constitution including a clause that would explicitly reaffirm the status of the Voice, an advisory body, as subordinate to the Parliament.

Legal experts agree that the Voice, if established, would not come at the expense of the sovereignty of the Parliament.

Neither of the chairs of the parliamentary group producing the 'no' case, Coalition senators Jacinta Nampijinpa Price and Paul Scarr, said on Tuesday night whether Ms Hanson's contribution could be included.

The issue could potentially create a fissure in the 'no' camp after Nationals Leader David Littleproud – who is Ms Price's party leader – previously said he did not support the inclusion of contributions from Ms Hanson of that nature.

"I'm committed to making sure that not only the tone but also the pamphlets [are] factual," he said last month.

Despite carrying the official status of public information material for a referendum, there is no obligation on the material contained within the pamphlet to be accurate.

"The Nationals have the majority on the No pamphlet committee, and we will ensure that its content is respectful in tone," Mr Littleproud told TND.
Senator Lidia Thorpe, who rejects the Voice on the grounds that it is an unacceptable compromise of Indigenous sovereignty, has meanwhile been pushing for the inclusion of a progressive case against the referendum in the official pamphlet.

Senator Hanson has been outspoken in her opposition to those arguments being carried in the publication.

Indigenous Australians Minister Linda Burney has called out Pauline Hanson and the media over racist rhetoric she says is being deployed freely by the campaign against an Indigenous Voice to Parliament

In a landmark speech at the National Press Club on Wednesday, Ms Burney, the first Indigenous woman elected to the House of Representatives, said offensive remarks made by Senator Hanson in a recent interview showed racially charged language was going unchecked.

Senator Hanson on Canberra talkback station 2CC last month, cited an account of a conversation she said took place "years ago" as evidence that a Voice to Parliament would fail to reflect the concerns of Indigenous people.

"I had a, I'll call her a true Black –  but beautiful – woman (in my office)," Ms Hanson recalled, before summarising the extent of her political concerns: "All we want is our land."

Ms Burney called the remarks "unimaginably insulting" and noted they had not been mentioned or condemned by any reporters covering the referendum.

"What she was saying is that some Indigenous people are less deserving of our identity," she said.

"To say it was an insult is an understatement. It was not called out by one media outlet. It was not written about by one media outlet."

Ms Burney said the lack of condemnation was a reflection of a 'No' campaign employing the same tone and tactics seen in American politics under former president Donald Trump, whose frequent resort to falsehoods overwhelmed the media.

'Post-truth'

"It is post-truth and its aim is to polarise – to sow division in our society by making false claims," Ms Burney said.

Reporters covering Mr Trump slowly tried to adapt the conventions of journalism in response to his inflammatory remarks over the course of his presidency. His political opponents also struggled.

Even months before the bill to hold the referendum passed the Upper House, official events for the 'No' campaign, featuring some of its leading spokespeople, dealt in racially charged politics.

Senator Hanson was present on stage for that speech, as was former deputy prime minister Barnaby Joyce.

On Wednesday, Senator Hanson did not back away from the remarks she made on radio last month.

"True indigenous Australians keep telling me something has to be done about identity fraud in this space," she said.

"It's one of the reasons I've tried to legislate a more objective definition of an Indigenous Australian: To prevent people from falsely claiming Indigenous heritage for personal financial gain."

Rising discrimination

Last month former attorney-general George Brandis warned against condemning 'No' voters because, he warned, it could energise them.

On Wednesday, Opposition Leader Peter Dutton again pitched himself as an opponent of "elites" in the business community – which supports the Voice overwhelmingly – in the lead up to a crucial byelection next week.

A yearly survey from the Diversity Council Australia released on Wednesday meanwhile recorded a nine-point jump in the number of Indigenous Australians saying they had been discriminated against in the workplace in the year to June.

UTS Professor Nareen Young, the council's former CEO, said the results reflected the effect of "racist social media campaigns on our devices during the day (and) the challenges to our identity as Indigenous peoples on the news at night".

Indigenous Australians Minister Linda Burney has accused Peter Dutton of "bully boy tactics", as she outlined her hopes for the Indigenous Voice to Parliament.

It came after the Opposition Leader urged Ms Burney "to be honest" about the Voice, and claimed that Prime Minister Anthony Albanese's "obsession" with it was fuelling Australia's cost-of-living crisis


"People are worried about their children's future, about education, about jobs, about medical services and there hasn't been one community that I haven't visited that hasn't raised the issue of housing," she said.

"Josie Douglas, who is a wonderful Australian from the Central Land Council, put it best; the Voice will be changing lives, not changing public holidays."

Ms Burney went off-script during her speech, to take aim at the "no" campaign, accusing it of bringing "Trump-style politics" to Australia.

"It is post-truth and its aim is to polarise, to sow division in our society by making false claims, including [that] providing advice to government would somehow impact the fundamental democratic principle of one vote, one value," she said.


"Do not let the 'no' campaign get their way with using Trump-style politics in Australia. Do not let them divide us. The proposed change is constitutionally sound and legally safe."

Asked about rising tensions between proponents of the yes and no sides, and if they might last beyond the referendum, Ms Burney said she had faith in Australians.

"I have a very deep commitment and a very deep view that Australians will rise to this. I have every faith, and when we think that it's going to be about practical outcomes and recognition, there is nothing to fear in what's being proposed," she said.

"We are very conscious of the issues around mental health and just where this debate could go. We've already seen some fairly unsavoury things.

Her comments about Mr Dutton came after he lashed Australian mining giants and other big companies for donating to the "yes" campaign. On Sunday, he said many big companies "lacked a significant backbone" on the upcoming referendum.

"There are a lot of people who are just craving popularity and are trying to please people in the Twittersphere," he told Sky News on Sunday.


On Wednesday, Ms Burney – a Wiradjuri woman – said business support for the Voice was not new.

"It is the business community that supports the Voice, because they know that it is about employment. It is about making sure that people stay in jobs. It is very much what they are driving through their businesses," she said.

"And I don't think the business community would be very impressed by the bully boy tactics of Peter Dutton."

Earlier on Wednesday, Mr Dutton said he had no regrets about his comments. He also tried to draw a link between cost-of-living pressures and the Voice.

"I think the fact is [that] many of the listed companies in Australia today, the CEOs are worried about ... the Twittersphere, and they're less worried about what's happening to their customer base," he said.

"I think for a company, for example to look at Wesfarmers, I think their $2 million would be better off [spent] reducing prices in their supermarkets."

Mr Dutton said Mr Albanese had an "obsession with the Voice" that was distracting him from economic policy.

"That's why you're paying more for your mortgage, it's why you're paying more for every element in your family and small business budget. And yet inflation is sticky, it's nowhere near the 2-3 per cent target range the Reserve Bank governor has in mind," he said.

He said the Voice would change Australia's system of government, without delivering practical change for Indigenous Australians.

"That's why I think Linda Burney today needs to be honest instead of trying to pull the wool over the eyes of the Australian public," Mr Dutton said.


He said there was no disputing Ms Burney wanted to help Indigenous Australians – "we all want to do that".

"But the problem is that it goes much further than what she's suggesting today, and this continuous misleading of the Australian public by Minister Burney is only making a bad situation worse for the yes case," he said.

In response, Ms Burney told the NPC she believed that Australians would "come to understand" that the Voice was two simple propositions – recognition and practical outcomes.

"People need to understand that misinformation and disinformation is damaging, and I do not apologise [for that view]," she said.

The referendum's success depends on majority support across the country and in four of six Australian states. It must be held between October and December.

The South African Truth and Reconciliation Commission is Coming to Australia!

The Truth and Reconciliation Commission was a court-like public hearing assembled in South Africa in 1996 after the end of apartheid. Authorised by Nelson Mandela and chaired by Desmond Tutu, the commission invited Black "victims" of so-called White Racism to give evidence. The White accused were then given a choice: Admit guilt and beg forgiveness, or face a prison sentence - which for Whites in South Africa, means a death sentence.

In short, the Truth and Reconciliation Commission was a method for Blacks to profit at the expense of White South Africans. The same method of accusation without legal recourse has been used throughout history: The French Revolution, Communist China and East Germany to name a few.

If Australians vote to enshrine the indigenous advisory Voice into the constitution at a referendum later this year, then a special commission known by the Aboriginal word 'Makarrata' is the next step

This Makarrata Commission would have the 'authority to facilitate the process of treaty-making and truth telling' between the two groups, according to the Uluru Statement from the Heart.

Reconciliation NSW created a 'beginners guide to the Uluru Statement', which says 'Makarrata' has 'long been proposed as an alternative name for the treaty process in this country'.

'It is a complex Yolngu word describing a process of conflict resolution, peacemaking and justice,' Gumatj woman, Merrikiyawuy Ganambarr-Stubbs says in the guide.

'Makarrata literally means a spear penetrating, usually the thigh, of a person that has done wrong... so that they cannot hunt anymore, that they cannot walk properly, that they cannot run properly; to maim them, to settle them down, to calm them — that's Makarrata.'

But she said the meaning is 'more aligned to the spirit of what many hope a treaty process would look like' is a 'negotiation of peace... where both parties agree to one thing so that there is... no other bad feeling'.

Mr Albanese outlined the responsibilities of such a future commission in a statement on November 15, 2021 . After winning the May 2022 federal election, he declared the new Labor government would adopt the Uluru Statement of the Heart 'in full' - the first time most Australians had heard of the document.

The statement was released after the four-day First Nations National Constitutional Convention on 26 May, 2017

The Makarrata Commission will be independent... and will work with a Voice to Parliament when it is established.'

Responsibilities of the commission would 'initially' include consulting with First Nations communities, recommending a 'framework for federal treaty-making' and, crucially, delivering a report within the first term of a Labor government.

By that schedule, the commission will have had to be established and had enough time to consult the community and deliberate by 2025, when the next election is due.

Mr Albanese said $26.5million would be allocated to the commission in the first two years to 'support truth-telling projects', and he hoped state, territory and local governments would match that funding.

This is in addition to the $364.6million set aside in the latest budget for delivering the Voice


ULURU STATEMENT FROM THE HEART

We, gathered at the 2017 National Constitutional Convention, coming from all points of the southern sky, make this statement from the heart: Our Aboriginal and Torres Strait Islander tribes were the first sovereign Nations of the Australian continent and its adjacent islands, and possessed it under our own laws and customs.

This our ancestors did, according to the reckoning of our culture, from the Creation, according to the common law from 'time immemorial', and according to science more than 60,000 years ago.

This sovereignty is a spiritual notion: the ancestral tie between the land, or 'mother nature', and the Aboriginal and Torres Strait Islander peoples who were born therefrom, remain attached thereto, and must one day return thither to be united with our ancestors.

This link is the basis of the ownership of the soil, or better, of sovereignty. It has never been ceded or extinguished, and co-exists with the sovereignty of the Crown. How could it be otherwise? That peoples possessed a land for sixty millennia and this sacred link disappears from world history in merely the last two hundred years? With substantive constitutional change and structural reform, we believe this ancient sovereignty can shine through as a fuller expression of Australia's nationhood.

Proportionally, we are the most incarcerated people on the planet. We are not an innately criminal people.

Our children are aliened from their families at unprecedented rates. This cannot be because we have no love for them.

And our youth languish in detention in obscene numbers. They should be our hope for the future.

These dimensions of our crisis tell plainly the structural nature of our problem. This is the torment of our powerlessness.

We seek constitutional reforms to empower our people and take a rightful place in our own country.

When we have power over our destiny our children will flourish. They will walk in two worlds and their culture will be a gift to their country.

We call for the establishment of a First Nations Voice enshrined in the Constitution.

Makarrata is the culmination of our agenda: the coming together after a struggle. It captures our aspirations for a fair and truthful relationship with the people of Australia and a better future for our children based on justice and self-determination.

We seek a Makarrata Commission to supervise a process of agreement-making between governments and First Nations and truth-telling about our history.

In 1967 we were counted, in 2017 we seek to be heard. We leave base camp and start our trek across this vast country. We invite you to walk with us in a movement of the Australian people for a better future


In Australia we already pay too much tax, this waste of money should be examined by voters and their "pie in the sky ideology" is not relevant to the modern Australia. Not our fault they are under evolved and Ill equipped to deal with a technological age mentally.

Critical tree planting events are cancelled after newly formed Aboriginal corporation demanded a $2.5million payment for approval - as frustration grows over new cultural heritage laws

Excerpt: Two major tree-planting events have been cancelled following a demand by an Aboriginal corporation for a payment of $2.5 million in exchange for their approval.

LandCare volunteers were meant to roll up their sleeves to plant 5500 seedlings along Perth's Canning River on the weekend. But the events never went ahead.

There are now grave fears the seedlings are now at risk of dying and could go to waste.

At least three community tree planting events have been shut down since the new laws came into effect a fortnight ago.

Frustrated mayors have pleaded with the WA government to step in and resolve the issue.

'The Aboriginal Cultural Heritage laws are only two weeks old, and already an Indigenous corporation is using them to demand millions of dollars.'

The last furore comes after a week after the opening of the $232million Mitchell Freeway extension spiralled into chaos when two Aboriginal elders clashed over who had the right to conduct the smoking ceremony and collect the CA$H.
