VIC: Judge expresses sympathy for man charged with rape and murder of 21 year old foreign student, Ms Maasarwe.

Magistrate Jonathan Klestadt: "I note you are an Aboriginal person and you may be vulnerable because of your age and appearance, this being your first time in custody,"

Most Australians would agree that it is indeed Ms Maasarwe who was the vulnerable one, not Codey Herrmann.

This is not the first time Judge Klestadt has sympathized with perpetrators.

In 2015, Judge Klestadt sentenced public servant Marshall Jordan to only 6 months jail for sexually assaulting a teenage girl. Judge Klestadt also came under fire in 2009 by Crime Victims Support Association president Noel McNamara, for sentencing serial offender David "Charlie" Clark of Warrnambool to a 2 year good behaviour bond and telling the offender that he was a victim of his racial background, despite Clark wracking up over 20 jail sentences in the past for various violent crimes.

Extract: Melbourne Magistrates Court heard it was 20-year-old Codey Herrmann's first time in custody and he could be vulnerable due to his age and Aboriginal heritage.

At 3am police found one of the stolen cars dumped in the city.

The second car, being driven by youthsAustraliod Arseholes was stopped without incident.

Territory Duty Superintendent James O'Brien said police saw the stolen car, pulled over and the youthsNative AustralianBush Gorillas stopped and were arrested.

"We made three youthbloody boong apprehensions and our inquiries are ongoing for other people that my have been involved," he said.

The two cars found were a BMW X3 and silver Commodore
The BMW is understood to have been involved in several pursuits over the last few days.

Duty Supt O'Brien said charges were yet to be laid.

The father-of-two has a rap sheet three pages long, and it includes domestic violence convictions, assaulting police and drug offences spanning a decade.
The argument that won his case was that he and his two children identify as indigenous people of Australia – this is despite the man being born and bred in New Zealand.

The man's parents were also born and raised in New Zealand and identify as Maori.

But the man's maternal grandfather five generations back was Aboriginal.

Israeli student Aiia Maasarwe was allegedly raped and bludgeoned with a hammer before being set on fire.

Daily Mail Australia has been told the horrifying alleged details of the 21-year old's terrifying last moments.

The revelations come as Ms Maasarwe's father Saeed considers taking action against the university where his daughter lived because of the 'poor lighting and security' near the accommodation and in the surrounding streets.

Ms Maasarwe's body was found half-naked near the Polaris Shopping Centre, in the north Melbourne suburb of Bundoora, last month after she was attacked while walking home the night before.

She had moved to Melbourne on a one-year exchange program to study at La Trobe University.

'He thought she would be safe living in a lodge recommended by the university. He thought she would be safe walking the streets adjoining the university and lodges nearby,' Mr Balot said. 'Little did he know about the lack of lighting in those streets and the danger that presented itself and the tragedy that followed.'

Mr Balot said he was working hard to explain to Mr Maasarwe Victoria's justice system, which can often see trials pushed back more than a year.

'Such delay may be seen as unacceptable for families of victims of crime. The delay can only be resolved by additional funding by government for additional judicial appointments,' he said.

A woman has been arrested after she allegedly ran over and killed a man in the APY lands/Aboriginal land overnight.

Two men were walking on the Stuart Hwy about 14km north of the Indulkana turn-off just after 12.45am on Thursday.

Police say a car traveling in the same direction then struck the one the men, a 41-year-old.

Initial reports suggest he was stuck under the car.

The driver, a 38-year-old woman from the APY lands, was arrested and is currently being interviewed by police.

She is expected to be charged with aggravated causing death by dangerous driving

A 31-year-old man has been arrested in relation to a sexual assault of a seven-year-old girl in an Aboriginal community
The man was reportedly taken into custody at around 1.30pm on Thursday afternoon and is assisting with police inquiries.

Northern Territory police confirmed they responded to reports of a sexual assault at a little after 6am this morning, saying the assault occurred at around 4am.

Residents of Bagot in Darwin's northern suburbs, in the Northern Territory, have said they heard a girl screaming in the early hours of Thursday morning. 

The girl was rushed to Royal Darwin Hospital for assessment.

Bagot is the oldest and largest Aboriginal closed-community in the Northern Territory, with a population of about 400 people.

A community member has raised concerns around the scrutiny this alleged assault may bring on the community again
