JUSTIN Osborne waved his arms above his head and shouted a "yeeha" 
 
after he bludgeoned a man to death with a sledgehammer in a case of

mistaken identity, a court has heard.

NT Supreme Court Justice Stephen Southwood has confirmed that Osborne

will remain behind bars on a custodial supervision order.

He was found not guilty by mental impairment of the brutal murder of

Ron "Speedy" Donaldson at Katherine.




Osborne mistook the victim for Les Pearce, a man he had travelled with

from Brisbane before the pair had a fist fight at the Katherine BP

servo on December 2, 2013 and Mr Pearce left town.

The next day, Osborne ambushed the innocent Mr Donaldson who was

working on a boundary fence at Ryan Park.

It bordered a school.

He grabbed the victim in a headlock from behind and threw him to the

ground where he kicked him repeatedly.

He struck Mr Donaldson in the head with the 2.2kg sledgehammer about five times.

"He stated he struck him to kill him, and again to make sure he was

dead," Justice Southwood said.

"It was deliberate and forceful."

A powerless witness yelled at Osborne to stop the attack from the

other side of an eight foot high cyclone mesh fence topped with barbed

wire.

Osborne waved his hands over his head and shouted "'yeeha', as if

celebrating", and stole the victim's glasses as a "souvenir" of the

killing.

Police found him 30m from the body.

He told them: "I smashed his head in, the peadophile c ...".

The court head Osborne was "adamant" he had killed Mr Pearce.

Justice Southwood said he would have imposed life imprisonment with

the standard non-parole period of 20 years, backdated to Osborne's

remand on the day of the killing, if Osborne had been convicted of

murder.

He said Osborne was likely to endanger himself and others if he was

release into the community on a non custodial supervision order.

The case will be reviewed in December 2015.

A MAN allegedly bit a cop while being arrested over a domestic dispute. 
 
The man, 30, fled when police turned up on his doorstep at Undoolya Rd, in Alice Springs, where a woman alleged she has been assaulted by the him about 5.20pm on Saturday.

Watch Commander Darryl Kerr said police chased down the man and caught him.

"The offender punched a police officer in the head several times and bit his left arm," Senior Sergeant Kerr said.

"The police officer was able to subdue the offender."

The man was charged with assaulting police and aggravated assault — among other offences — and was refused bail.

He was face Alice Springs Magistrates Court on Monday.

Police are gobsmacked by the actions of a group of people who threw rocks at paramedics and police when they arrived to save the life of an 18-year-old hit by a slow-moving freight train yesterday morning.

Police said the victim "didn't move at all" in the seconds before the 1.2km train severed the Aboriginal man's legs and dragged him 10m under the carriage.

"His torso was in between the two train lines. When my officers arrived he was virtually unconscious," Taree Inspector Allan Fidock said.

"Everyone assumed that he was deceased but then he has murmured and moved.

During the night the same group of about 30 people had already knocked down a fence which separated homes from the train line.

"We are trying to find people and get an ID on a couple who threw rocks and smashed windows.

"It is horrific to have to deal with that and then deal with alcohol-induced friends and family.

And they are having a go at the cops and ambulance officers.

"Initially we had two officers out there. We had to close the station down then because we had five people (at the scene).

"Then there was three or more police who rushed out there when they started in the morning. All up there would have been a maximum of eight police."

The train driver, a 33-year-old man from Queensland, was taken to Manning Base Hospital for mandatory blood and urine testing.

He was also attacked with rocks by the mob and had to take cover in the train carriage with police and paramedics.

Police have put out an appeal for witnesses who can help them with information about the incident and the events surrounding it.

THE mother of seven of the eight children found stabbed to death at a home in Cairns Friday has been arrested for their murders overnight.

The eight children, aged between 18 months and 15 years, were found dead yesterday morning by their 20-year-old brother who raised the alarm with police.

The suspect is 37-year-old Mersane Warria — the mother of seven of the eight children and the aunt of the eighth victim.

The murders occurred in a suburban house in Cairns, a northern coastal city and popular holiday destination in the state of Queensland. A 34-year-old woman was reportedly injured and taken to hospital.

A cousin of the family said the victims were all siblings from a family that was "mostly" indigenous. She said the slain children were discovered by an older brother, aged 20.

FED up with rampant crime and turnstile justice for young offenders, Darwin and Palmerston residents have formed night-time street patrols and online "vigilante" groups. 
 
The page "Darwin and Palmerston Vigilante Justice" has attracted almost 100 members in less two days. It was created on Christmas Eve after a spree of car thefts the previous night.

The most shocking account came from former Darwin alderman and Larrakia elder Dorothy Fox, whose uninsured disability-access van was stolen and trashed.

Ms Fox cares for a severely-disabled nine-year-old girl who requires frequent trips to hospital.

"I don't know what I'm going to do without it," Ms Fox said. She summed up the frustration created by nightly break-ins and car theft in the Palmerston area.



"People out here are very angry," she said. "They're getting angrier and angrier.

"(Residents) do patrols every night and they just weren't in my area when it happened. The police can't be everywhere.

"Why aren't these kids locked up? Where are their parents?"

Ms Fox said her grandson was punched after he disturbed about eight youths late on Tuesday night.

"It was about a quarter to 10, I'd gone to bed but my grandson was up watching TV," she said.

"He heard the gate open. When he went outside it was too dark for him to see them but he said there were about eight kids there. Police said the little buggers used scissors to turn the (ignition)."

Ms Fox said she was supposed to insure the van on Christmas Eve but "didn't get the chance".

Several online community groups have been posting nightly updates about crime in Palmerston for the past few weeks. It is a rare night that doesn't result in two or three reports about stolen cars.

Within an hour of Ms Fox writing a short post about her stolen van, the vigilante group was created. The group's founder wrote: "Criminal punishments are either non-existent or insufficient.



"We are dissatisfied with the current penalty implemented on offenders.

"We members of the community can respect that the police are currently trying their best in relation to the crime ... but without more officers to enforce the law it is not being implemented to full efficiency."

Police typically discourage people taking the law into their own hands. But NT Police did not respond to several calls by the NT News this week to discuss the concerns of residents and how they might more appropriately respond.

Ms Fox said she wanted to put pressure on the NT Government to hold parents financially responsible for damage caused by kids in their care.

"They should also meet the costs incurred to transport my disabled child to and from hospital, therapy or wherever she needs to go," she said.

"Let's get serious."


We all know in the Palmerston and Darwin areas it is the local abbos doing all this! The parents are just out drinking doing whatever and if they were to be held accountable for the damages.. nothing would happen. They havn't got any money.. it all comes from the welfare mob and they still get $ for booze!

The Police aren't going to fix the Abbos.. so the local residents have to do what it takes to stop them! Appauling!  So we have all the Ambulance personell quitting because of these Apes.. the Police and courts won't do a lot.. so yes... good hard working people have to do a DIY on them all.. and you can bet they'll be in the wrong after they defend themselves and their property.
