SA Full Court rules Aboriginal men who assaulted, robbed taxi driver 'less morally culpable' for crimes because they're boongs of dysfunctional childhoods

THE state's highest court has ruled two young men who assaulted and robbed a taxi driver were "less morally culpable" because of their impoverished and abusive upbringings.

The Director of Public Prosecutions appealed against the "manifestly inadequate" non-parole periods granted to Aboriginal men David George Rigney-Brown and Ethram Ronald Hughes by District Court judge Paul Muscat.

Rigney-Brown, Hughes and another man assaulted and robbed an Indian taxi driver in August 2015, and Hughes used a tyre lever to rob a Caltex service station at Grange three days later.

Rigney-Brown was jailed for four years, two months and 12 days, with a non-parole period of 18 months, while Hughes received a seven-year sentence with a non-parole period of two-and-a-half years for the two robberies and other offences.

The DPP argued the lower-than-usual non-parole periods failed to take into account the men's lengthy criminal records and apparently poor prospects of rehabilitation.

But the Full Court, led by Chief Justice Chris Kourakis rejected those arguments, ruling the men should be given the chance to turn their lives with an extended period around on parole. {Sic}

Chief Justice Kourakis said that while the non-parole periods were lower than usual for offenders with uncertain prospects of rehabilitation, there were other compelling reasons for the judge allowing the men extra time in the community under parole conditions.

"Through no fault of their own, (the men) did not develop adult insights, values and responsibility because of their social deprivation and marginalisation. For that reason their moral culpability is relatively less," he said.

Rigney-Brown, 20, was badly assaulted as a baby and taken to hospital with two broken hips and a broken leg, before spending his childhood in a series of foster homes.

He was smoking cannabis by age nine, became homeless and addicted to amphetamines by 18, by which time he had racked up a number of juvenile convictions, including for robbery.

Rigney-Brown spent time in juvenile detention centres from the age of 10 and had been released from prison for robbery and assault three months before robbing the cabbie.



So the boongs got a lighter sentence. Cause they were:-poor, hard done by boys with a bad family and they weren't taught better?

Being bullied as a child by my father, I learned that the only way to beat a bully was to stand up, never back down; fight and win. I will never back down.

Can you imagine a judge saying about me that the person I beat half to death was a bully whose sustained behaviour over a period of time followed by a physical threat triggered an immediate emotional response caused by my traumatic upbringing? Meaning, it is really their own damn fault they copped a steel-capped boot to the head and are now only capable of sitting and dribbling.

Of course not; there is absolutely no way that you can imagine such a scenario ever really happening. I'm White; I live a privileged life ... or so say the social reconstructionists and their libtard pals. But that is precisely what they are saying about the victims in the crimes described above. Why doesn't the judge be absolutely honest and just say to the victims: "Get over it. Your status on the ladder of political correctness is far too low. Your well-being matters less to society than that of your assailant ... You don't matter."

And that I've seen too many times already.

Still, I will not back down. They can shove their ladder of political correctness where the sun doesn't shine. We follow our own moral codes, and we pursue our own justice.

A WHITE WOMAN was burnt with a cigarette and punched before being robbed of cash and her watch at Ingle Farm.

She was seated at a bus stop on Bridge Rd between Montague Rd and Dirante Dr just before 3pm on Friday.

The victim managed to take this quick but blurred photo of the suspect when she was robbed at an Ingle Farm bus stop.

A man approached her and asked for a cigarette.

The woman shared her own cigarette with the man who said "that's not good enough" and butted the cigarette on the woman's thigh.

The offender grabbed her by the hair and punched her before stealing money from her wallet and the watch from her wrist.

A man driving a 4WD stopped to intervene and then left.

Police are seeking the man who stopped to help the victim, or anyone else that may have seen the incident, to please come forward and contact police via Crime Stoppers on 1800 333 000.

The victim managed to take a quick but blurred photo of the suspect, who is described as caucasian, about 35 years old, 190cm, tanned complexion, short brown hair in a mohawk style.
