A refugee with a history of violence is facing deportation from Australia after losing an appeal over a brutal assault that left a man with a severed earlobe

Jok Gar, 21, was sentenced last December to two years in prison with a non-parole period of 16 months for the unprovoked attack, in which he and another man savagely beat a man in Melbourne and stole his phone.

A knife was used in the September 6, 2022 attack, with the victim's face slashed and his earlobe partially severed.

Gar and his co-accused Tyler De Silva left the man unconscious and bleeding, with police discovering them in the toilets of Southern Cross train station at 4.30am.

De Silva was handed a lighter sentence of six months due to having an intellectual disability - he has an IQ of 48 - childhood epilepsy and 'severe neglect issues' in his upbringing, the Geelong Advertiser reported ~ Standard Abo!

Gar's appeal cited the 'manifest' differences in the two sentences, but Supreme Court justices Karin Emerton and David Beach said Gar's initial sentence had been 'lenient'.

The judges said the attack was 'both dangerous and callous', and that 'it was not the applicant's only act of random violence against a stranger on the streets of Melbourne.

They also said there was 'no reason to believe that (Gar's) prospects of rehabilitation are other than very poor'.

A decision on the case had been reserved following a hearing on April 16, but in the meantime Gar was told his refugee visa, which he received in 2009, had been cancelled.

His lawyers said the visa cancellation and the risk of deportation after he has served his time behind bars, were grounds for another appeal.

But the judges disagreed, saying Gar still can apply for the visa cancellation to be reversed.

'We see no good reason to reduce (Gar's sentence) on the ground that the visa cancellation will make the applicant's imprisonment more burdensome,' justices Emerton and Beach wrote.

The judges also cited Gar's history of violent crime

In January 2023, he pleaded guilty to the aggravated assault of a woman in Geelong West, and four months later in May he was convicted of attacking a stranger 'without provocation' in Melbourne's CBD in the early hours of New Year's Day, 2022

That assault caused fractures to the victim's skull and facial bones.

Gar went into prison as a medium security prisoner but has been reclassified as maximum security due to his behaviour in jail, which has involved assaults, fights, verbally abuse and spitting on guards.

He also 'stomped on another prisoner' and poured milk and urine under another inmate's cell door.

A  (*Black) man who allegedly fatally stabbed a 22-year-old in the chest was freed from immigration detention and deemed to be at 'low' risk of reoffending just a month before the alleged murder

Police will allege in court that Saki stabbed Mr Minyurano in a park on Mortimer Rd at Acacia Ridge, in Brisbane's south shortly after midnight on Mother's Day.

Mr Minyurano, of Acacia Ridge, died at the scene, despite the efforts of emergency responders to revive him.

The pair were allegedly known to each other.

Saki faced Richmonds Magistrate Court on May 13 for the first time since being charged with murder

It's since been revealed that he had only been in the community for one month after he was released from Yongah Hill Immigration Detention Centre in Western Australia in early April, Nine News reported.

Born in Khartoum, Sudan, Saki's Australian humanitarian visa was cancelled in October 2019 due to his failing the character test.

Saki had been jailed on several occasions between 2017 and 2018 for violent offending, including choking a person unconscious, assault occasionally actual bodily harm and assault.

However, Administrative Appeals Tribunal overturned the 2019 decision and ordered he be released from detention

Nine News reported AAT deputy president Stephen Boyle determined that Saki was 'now a low risk of reoffending'.

'I also accept that the applicant's risk of reoffending is low, that he now accepts responsibility for his actions and is remorseful for the harm that he has caused,' Mr Boyle said in his ruling.

'I am also mindful that ... a higher level of tolerance would be shown to non-citizens who have lived in the community for most of their lives or from a very young age.

'In particular, I find that the considerations of the strength, nature and duration of the applicant's ties to Australia, the best interests of minor children, the legal consequences of the decision and the impediments to the applicant establishing and maintaining basic living standards if he were to be returned to South Sudan, outweigh those considerations weighing against the revocation of the cancellation of the visa.

A migrant who had sex with a 12-year-old girl who he claimed to believe was a married 18-year-old will be deported back to India.

The 33-year-old - whose name has been suppressed - was jailed in February last year for 10 months after he admitted committing six sex offences on the night he met the girl in April 2021, the Mercury reported.


The man pleaded guilty to five counts of penetrative sexual abuse of a child or young person and one count of indecent assault.

The sex offender's visa was cancelled in August last year, with the case brought up again during an Administrative Appeals Tribunal hearing last week.

The tribunal heard that the man met the girl on the dating app Grindr before picking her up at a Kmart in Hobart, Tasmania.

When he arrived to pick up the girl at 2am, the man claims he found the woman talking to another man who she said was her husband.

He claims she also told him he was a prostitute, which gave him confidence she was above the age of consent.

'I knew to be married you had to be 18,' the man told the tribunal.
'Unfortunately, this happened ... I had no intention of harming a child. I was purely looking for an adult. There was no criminal intent.'

The tribunal found it 'difficult to accept' the man did not realise the girl's young age when he saw her naked body in a bedroom.

Excerpt: A Queensland nurse has been charged with fraud and stealing after she allegedly used the bank card of a hospital patient to treat herself to a spending spree.

Melelani Crelley, 42, allegedly racked up a $7,000 bill as she shopped around the Gold Coast while the elderly woman who owned the card lay in Robina Hospital and later Gold Coast University Hospital battling a serious illness.

The woman's son from Mackay, Daren Kirby, noticed dozens of transactions at supermarkets, cafes and bakeries had been billed in April and May this year while his mother was stuck in bed and did some sleuthing.

Mr Kirby found one transaction for a Varsity Lakes hair salon and brought in police, reported The Gold Coast Bulletin.

Detectives found the salon customer used a second card to pay for part of the bill after the cost exceeded the tap-and-go limit on the first card.

Officers on Thursday swooped on Crelley's Varsity Lakes home where they allegedly found the elderly woman's purse and bank card.
