Excerpt: Fani Willis, the district attorney for Fulton County, Georgia, secured the 41-count indictment from a grand jury on Monday, and told a press conference the indictment alleged 'violations of Georgia law arising from a criminal conspiracy to overturn the results of the election in this state.'

Trump called her 'an out of control and very corrupt District Attorney', and declared that the charges were part of a 'witch hunt'.

The case - relying on laws typically used to bring down mobsters - is the fourth targeting the 77-year-old Republican this year and could lead to a watershed moment, the first televised trial of a former president in US history.

He was charged along with 18 others - Rudy Giuliani, John Eastman, Mark Meadows, Ken Cheseboro, Jeffrey Clark, Jenna Ellis, Ray Smith III, Robert Cheeley, Michael Roman, David Shafer, Shawn Still, Stephen Lee, Harrison Floyd, Trevian Kutti, Sidney Powell, Cathleen Latham, Scott Hall and Misty Hampton.

Willis said she wants to try them all at the same time. They have until noon on August 25 to turn themselves in, or else an arrest warrant will be issued.

There are also 30 'un-indicted co-conspirators' - people accused of being part of the plot but not named or charged.

RICO: The federal Racketeer Influenced and Corrupt Organizations Act originated in 1970 as a tool to fight organized crime. The law enabled prosecutors to target people in positions of authority within a criminal organization, not just lower-level people doing the dirty work.

Within a few years of the federal law taking effect, states began passing their own RICO laws. Generally speaking, RICO laws allow prosecutors to charge multiple people who commit separate crimes while working toward a common goal.

Georgia's RICO Act, adopted in 1980, makes it a crime to participate in, acquire or maintain control of an "enterprise" through a "pattern of racketeering activity" or to conspire to do so. It´s important to note that the alleged scheme does not have to have been successful for a RICO charge to stick.

An "enterprise" can be a single person or a group of associated individuals with a common goal. "Racketeering activity" means to commit, attempt to commit - or to solicit, coerce or intimidate someone else to commit - one of more than three dozen state crimes listed in the law. At least two such acts are required to meet the standard of a "pattern of racketeering activity," meaning prosecutors have to prove that a person has engaged in two or more related criminal acts as part of their participation in an enterprise to be convicted under RICO.

The U.S. Supreme Court has said that federal RICO allegations must show continuity, that is to say a series of related underlying acts over an extended period of time, not just a few weeks or months. But the Georgia Supreme Court has made clear there is no such requirement in the state law.

Electoral challenges have long been part of American history.

Only now are they being criminalized.

A margin of less than 600 ballots determined that Governor George W. Bush rather than Vice President Al Gore won the state and, thus, the electoral college vote.

No one was indicted, disbarred, disciplined or even much criticized for those efforts, yet here we stand today.

President Donald Trump and 18 other defendants has been charged with election fraud, conspiracy, racketeering and more, under a law designed to take down criminal organizations, known as the RICO Act.

But if similar behavior was legal in 2000, how could it be illegal in 2023?

In the end, all those efforts in Florida failed when the Supreme Court in a five-to-four vote ordered the recounts stopped thereby turning the election over to President George W. Bush.

What's different today is that many observers do not believe that Trump and his advisors were sincere when they declared that he had won the election. But that doesn't make what they did a crime.

The Georgia indictment hinges on the allegation that Trump was lying in order to corruptly prevent the inauguration of the candidate who won the election fair and square.

In fact, every single Democrat president since 1977 has questioned the legitimacy of U.S. elections, according to the Republican National Committee. In both 2013 and 2016, Biden claimed that Al Gore won the 2000 presidential election. In May 2019, Biden said he "absolutely agrees" that Trump was an "illegitimate president." Biden cast doubt on the legitimacy of the 2022 midterms this year.

In 2006, then-DNC Chairman Howard Dean stated that he was "not confident that the [2004] election in Ohio was fairly decided." Rep. Nancy Pelosi (D-CA) said it is "appropriate" to have a debate concerning the 2004 election and claimed that there were "legitimate concerns" regarding the "integrity" of U.S. elections. Then-Rep. Bernie Sanders (I-VT) cast doubt on the security of electronic voting machines in the 2004 election, saying he was "worried" that some machines do not have a paper trail.

Democrats also cast doubt on the 2016 election. Seven House Democrats tried to object to the 2016 election electoral votes. After President Trump's victory in 2016, 67 Democrats boycotted his inauguration, with some claiming Trump's victory was not legitimate.

In September 2017, Hillary Clinton said she would not "rule out" questioning the legitimacy of the 2016 election. In October 2020, she added that the 2016 presidential election was not conducted legitimately, saying, "We still don't really know what happened."

In addition, Democrats supported Stacey Abrams in her stolen election claims. Hillary Clinton said Stacey Abrams "would have won" Georgia's gubernatorial race "if she had a fair election" and that Stacey Abrams "should be governor" but was "deprived of the votes [she] otherwise would have gotten."

Sen. Cory Booker (D-NJ) said, "I think that Stacey Abrams's election is being stolen from her." Sen. Sherrod Brown (D-OH) contended that "if Stacey Abrams doesn't win in Georgia, they stole it." Sen. Elizabeth Warren (D-MA) said, "the evidence seems to suggest" the race was stolen from Stacey Abrams.

"We won," Abrams falsely claimed about the 2018 election. "I didn't lose; we got the votes," and "we were robbed of an election." She also called it a "stolen election" multiple times and argued, "It was not a free and fair election."

The history of the Democrat Party questioning the results of an election is long.

Remember Al Gore's "hanging chads?" And what about leading leftists calling for a "faithless" slate of electors to reverse the results of the 2016 presidential election and so stop President Trump? As recent as October 2020, Hillary Clinton was still publicly questioning the legitimacy of the 2016 election, which countless Democrats claim was "stolen" from her by the Russians.

None of these people have been charged with a felony, let alone ended up in prison.

Why? Because they are Democrats, and the First Amendment guarantee of freedom of speech applies to them, not to President Trump or anyone associated with him.

In the latest Soviet-style theater of police-state tactics from Georgia—which follows a federal FBI raid on Mar-a-Lago and arraignments against Donald Trump in New York, Miami, and D.C.—the president and 18 other Americans have been indicted for taking actions that are protected by the Constitution.

These include charges that Mark Meadow's, the president's then-chief-of-staff, sent a text asking: "Is there a way to speed up the Fulton County signature verification in order to have the results before Jan. 6 if the Trump campaign assists financially?" (Act 96); and that someone else sent an email to an "un-named co-conspirator" asking them to "touch-base" with presidential elector nominees" (Act 67); and that America's Mayor, the man who put five mafia dons behind bars, retweeted a post asking voters to "call your state Senate & House Reps & ask them to sign the petition for a special session." (Act 38).

These are all felonies in the United States if done by Republicans like Rudy Giuliani or anyone associated with a man who collectively won 137 million votes from the American people in two national elections.

This, despite the fact that the First Amendment of our republic is unequivocal in protecting freedom of speech, the press, assembly, and the right "to petition the Government for a redress of grievances."

President Trump and his lawyers committed no crime. They didn't privately fund local election officials and place ballot-harvesting drop boxes in predominantly Democrat districts.

President Trump solicited actions to guarantee our 2020 elections were fair and transparent. That was his "crime." That is why he was charged at midnight by a radical district attorney who is the daughter of a member of the Black Panthers.

It is said that Lavrentiy Beria, the founder of the proto-KGB, had a motto: "Show me the man, and I will find you the crime." We have arrived that point in America.

The fact that this Georgia indictment was accidentally posted on the Fulton County Court website — then deleted — hours before the secret Grand Jury even voted on what the charges should be, means KGB tactics are here.
