New York Approves Driver’s Licenses for Undocumented Immigrants

New York Gov. Andrew Cuomo (D) signed a law Monday that allows undocumented immigrants to get driver’s licenses, a major win for progressives and immigrant rights advocates.

The state Senate approved the bill earlier in the day, 33-29. 

The legislation, known as the Green Light Bill, expands access to driver’s licenses to an estimated 265,000 undocumented New Yorkers. Supporters say it will create safer roads, increase state revenue and keep families together by preventing traffic violations from turning into deportations. 

“This is life-changing, and we are proud to stand on the right side of history because every New Yorker should have the opportunity to contribute to their economies and communities without fearing that they will be separated from their family because of a routine traffic stop,” Eddie A. Taveras, state immigration manager for the advocacy group FWD.us, said in a statement.

The bill, backed by immigrant rights groups and some prominent Democrats, passed the state Assembly last week. 

But it faced opposition from within the party as well. The chairman of the New York State Democratic Party, Jay Jacobs, said he warned Long Island’s Democratic senators earlier this month against supporting the Green Light Bill because of potential political consequences, Gothamist reported.

Cuomo hinted as recently as Monday that he might veto the measure, after raising last minute concerns about the possibility of federal government using DMV information to track down undocumented immigrants.

“We have to write a law that does not have an unintended consequences,” Cuomo said in an interview with WAMC radio on Monday.

The state attorney general said the bill’s safeguards prevent it from being “weaponized to be used against undocumented individuals,” Alphonso David, counsel to the governor, said in a statement.

“Governor Cuomo has supported this policy for over a decade,” David said. “The key to this bill is not the political intent but the legal effect. We hope the Attorney General’s assessment is correct for the safety of the thousands of undocumented individuals who are relying on her legal opinion.”

Despite Cuomo’s concerns, the new law won’t create a separate database, said Anu Joshi, the senior director of immigration policy for the New York Immigration Coalition.

“The privacy protections that are included in the bill’s language are the strongest of their time in any bill in the country,” Joshi told HuffPost ahead of the Senate vote.

Undocumented immigrants will be mixed in with everyone else applying for a driver’s license, and the law prevents the DMV from keeping records of original documents. Also, individual judicial warrants would be required for any federal immigration agency requesting information from the DMV.

Illegal aliens who were protected from deportation by Barack Obama's Deferred Action for Childhood Arrivals (DACA) are now suing the Trump administration so they can obtain federal welfare and secure green cards to remain in the United States permanently, Breitbart News reports.

The two illegal immigrants, with help from the open borders group CASA de Maryland, are suing the Trump administration over impending enforcement of the "public charge" rule, which will reportedly save American taxpayers billions of dollars by putting a stop to illegal aliens collecting federal welfare.

How the hell are these illegal mud races even allowed to use our court system? You would think a country's court system would be dedicated for its citizens only. It's not as if our courts aren't congested enough by the nigger and mud criminals that live in our country. Now we have to pander to the illegals to make it worse.

Thousands of migrant children and parents were “cruelly and inhumanely” separated by the Trump administration, with several parents having tried to kill themselves and at least one dying by suicide, according to a federal lawsuit filed Thursday by the American Civil Liberties Union.

“The suffering and trauma inflicted on these little children and parents is horrific,” Lee Gelernt, the ACLU’s lead attorney in the family separation lawsuit, said in a statement. “Tragically, it could take years for these families to heal. Some may never recover, but we are fighting to give them a chance.”

The lawsuit, filed in federal court in Arizona, names current and former Trump administration officials and claims the government violated the rights of the separated migrant families. The ACLU said the suit covers families separated from 2017 to the present day.

In addition to violating their rights, the separations left families highly traumatized, the ACLU said.

“Traumatized children were not provided any meaningful treatment to address the fear, isolation and abandonment they experienced or the lasting effects of their separation and confinement," the lawsuit said.

The ACLU and other attorneys are representing several migrant families and are seeking class-action status.

One little boy, Andrés, then 6, “was torn kicking and screaming from the arms of his father,” Jacinto, the lawsuit said, as the father struggled to tell the guards about his son’s heart murmur.

Jacinto was later deported without Andrés, and the two remained separated for almost 10 months, according to the lawsuit.

A little girl named Diana, then 7, fell asleep in a holding facility only to wake and find that her father, Jorge, “had been taken away in the night without a chance to say goodbye,” the lawsuit said.

Karina, then 13, was separated from her mother, Lorena, on Christmas Day and “kept handcuffed to control her as her mother was taken away,” the lawsuit said. The pair were separated for 16 months “without any regard for her pre-existing mental health issues,” according to the suit.

The lawsuit claims the migrants’ rights were violated under the Fourth Amendment for unreasonable seizure of children, the Fifth Amendment due process clause, and equal protection. The suit is seeking damages and the formation of a recovery fund to provide mental health services for the families.

The Departments of Justice and Health and Human Services did not immediately return requests for comment. The Department of Homeland Security said it was policy to not comment on pending litigation.

The Trump administration had defended the policy as part of its ongoing mission to restrict the number of Central American families coming to the U.S. border. But with intense criticism mounting from both sides of the political aisle, Trump signed an order in June 2018 stopping his separation policy.

Days later, a federal judge ordered a nationwide injunction blocking the policy and ordering the reunification of thousands of families. That suit has expanded to include families separated before the official policy was announced and remains ongoing.

If the government is willing to allow anyone to vote in our elections, then there's no reason to even call the U.S. a nation. We as a country mine as well open the borders and become a free for all. Which I wouldn't be totally against, if the White were allowed to carve out their ethnostates.

Vermont city council approves measure that would let non-citizens vote

Lawmakers in Burlington, Vt., approved a resolution Monday that would allow non-citizens to vote in city elections.

Councilman Adam Roof, who wrote the resolution which passed in a 10-2 vote, argued all residents of the city are impacted by decisions made at City Hall, and therefore should be allowed to vote regardless of citizenship status.

“The right to vote is more important now than ever before," Roof told WCAX-TV. "All residents have the right, in my eyes, to participate in the local democratic process, and the highest level of participation in that process is being able to cast your vote,"

He said the resolution aligns with the city's 2014 Diversity and Equity Strategic Plan to create a more engaged community. More than 3,000 residents are ineligible to vote due to their status as refugees, the resolution said.

One resident spoke out against the measure, accusing the council of "political pandering" to voters.

"We have 40,000-plus registered voters," the unidentified resident said.  "How many of those are nonresident college students who vote on our property taxes, our legislators, our city leadership -- which includes all of you -- and much more, and then move away?"

Burlington, the hometown of Democratic socialist presidential candidate Bernie Sanders, has a population of approximately 42,000 people. It is also home to the University of Vermont, which has more than 10,000 undergraduate students.

Council President Kurt Wright said he voted against the legislation because he believes only American citizens should be able to vote.

“I think that’s important. I would not expect to move to another country and not become a citizen and expect to be voting in their elections,” said Wright, a Republican. “We voted on this just a few years ago and the citizens of Burlington voted significantly against it so I’m not supportive of this proposal.”

The measure still needs approval from the state Legislature before it becomes law.

These illegal muds shouldn't be protected by our laws if they aren't part of the country. How hard is that to understand? And this prosecutor got fired just for asking the question of citizenship status, ridiculous.

Truthfully how sorry should one feel for this mud victim? He probably was an illegal being processed by the jail to return to our streets. Instead of returned to where it's from. And if it was a legal mud, it still was arrested for a crime and put itself in that situation.

“The assistant district attorney who failed to file charges for this crime shouldn’t be reassigned, he should be fired because he is a racist and menace to the Hispanic community,” LULAC National President Domingo Garcia said in a statement.

Late last week, a Houston police officer spotted a man at the Joint Processing Center calling for help and pointing at 44-year-old Karl Bonner, who was getting booked for drunk driving charges. Bonner was allegedly holding his erect penis as he grabbed the man next to him and pulled him closer, union officials said.

When the officer called the district attorney’s office to ask about an attempted sexual assault charge, Denholm allegedly asked whether the victim was “illegal.” The officer said he didn’t think it mattered, according to the union.

But police say Denholm asked whether the victim had a driver’s license. When the officer said he’d found only a Mexican consulate ID card, Denholm allegedly refused to press charges. Records show Bonner was charged with felony attempted sexual assault days later, after other prosecutors reviewed the case.

Houston prosecutor fired after asking about crime victim's immigration status

A Houston prosecutor was fired Friday after he allegedly refused to bring charges against a man accused of attempted sexual assault because he believed the victim was living in the United States illegally.

Harris County District Attorney Kim Ogg fired John Denholm after he had been reassigned to a different part of the office pending an investigation of the Oct. 31 incident, The New York Times reported.

“It is wrong to ask about a victim’s immigration status; it is against our policy, and it won’t be tolerated,” Ogg said in a statement. “We treat everyone equally under the law, no matter how they came to be here.”

Denholm had been with the office since January 2017 and is a retired Harris County Sheriff's deputy, KRIV-TV reported. He was questioning an officer who was present inside a Houston jail when Karl Bonner, an inmate suspected of drunk driving, allegedly tried pulling another inmate closer while exposing himself in a holding cell.

The inmate screamed for help and an officer told Bonner “to get his hand off the complainant and to pull his pants up."

When Denholm spoke with the officer, he asked about the victim's immigration status, suspecting that if he was undocumented, he wouldn't come to court to testify, according to media reports.

“The district attorney, out of nowhere, says, ‘Well, is the complainant illegal?’" Joe Gamaldi, president of the Houston Police Officers’ Union, told The Washington Post on Thursday. "He goes, ‘Because if he’s illegal, I’m not taking the charge.'"

Denholm's alleged actions were quickly condemned by immigration activists and law enforcement officials. Both groups demanded he be fired.

"An attempted sexual assault is a sexual assault, and the assistant district attorney who failed to file charges for this crime shouldn’t be reassigned, he should be fired because he is a racist and menace to the Hispanic community,” said Domingo Garcia, the national president of League of United Latin American Citizens, a Latino advocacy group.

“Unfortunately, sadly, a member of the district attorney’s office was more interested in this person’s status in terms of their immigration status,” said Houston Police Chief Acevedo.

On Twitter, the police union said: "Victims of attempted sexual assault should not have justice stolen from them because a high ranking DA wants to question their legal status."

In an email to the Post, Denholm said he was “aware of who made the inflammatory allegations” and suggested the officer's narrative was untrustworthy, according to the Post.

Aise from the Halloween incident, Denholm also butted heads with law enforcement over his reluctance to file criminal charges.

“He historically has been challenging to law enforcement and refuses to accept solid charges,” Harris County Deputies Organization president David Cuevas told the Houston Chronicle.
