TERRITORY Senator Nova Peris is under investigation for claiming "family travel" allowance on trips to Canberra at the same time as she was attending last year's Garma festival in Arnhem Land. 
 
The Department of Finance has also carried out recovery action against Ms Peris for an unspecified amount for other trips her family members took to Cairns and Alice Springs late last year.

Public travel documents show Ms Peris charged taxpayers two airfares from Darwin to Sydney and a further two airfares from Sydney to Canberra on August 2 last year under her parliamentary allowance. Ms Peris, however, was at Yirrkala for the Garma Festival at the time. On August 4, she appeared on national television from Arnhem Land on a special episode of the ABC program Q&A.

Parliamentary travel rules state "family reunion travel" can only be claimed where children or spouses are travelling to meet politicians working away from home. Parliament was in the middle of a four-week hiatus at the time and Ms Peris was on the other side of the country.

HOUSING Minister Bess Price excluded two indigenous-owned businesses and ignored Commonwealth and Territory procurement principles to gift nearly $16 million of work to two regional councils. 
 
Contracts to upgrade more than 180 remote homes across Central Australia were given to MacDonnell Regional Council and Central Desert Regional Council last month without tender, despite Aboriginal-owned, non-government operators in the region claiming even better capabilities.

Ms Price's decision came at the expense of indigenous business enterprises (IBE), Ingkerreke Commercial and Tangentyere Construction, which had expected to be given the opportunity to bid against each other for the lucrative contracts.

In emailed responses, Ms Price said she used a Certificate of Exemption to gift the work because of previous "excellent work done at Docker River by MacDonnell Regional Council and the opportunity for local employment".

She based the validity of the Certificate of Exemption on a Territory Government procurement direction stating governments should ensure regional councils had "adequate opportunity'' to get work if they could guarantee a minimum of 30 per cent indigenous employment.


But Ms Price's call runs counter to stated procurement principles of "open and effective competition'' and "enhancing the capabilities of local business and industry''.

Procurement directions also state "Government-owned businesses; Local, Territory, State and Federal Government Agencies and Authorities are not to operate in competition with the private sector on Government-funded projects without the prior approval of the Procurement Review Board".


Ms Price said changes to procurement rules implemented on July 1, 2014, meant the department was no longer required to obtain PRB approval.

She said the IBEs had been reasonably excluded from the process because the regional councils had a shown a "proven commitment and ability" to do the work and meet the 30 per cent employment target.

The regional councils will now subcontract most of the work – in the communities of Kintore, Docker River, Areyonga, Nyirippi and Mt Liebig – to businesses based in Alice Springs. Central Desert has said it planned to include work-for-the-dole participants at Nyirippi, which Ms Price said would provide "CDP participants a great opportunity to enter the workforce''.



So even boongs don't wanna give the other boongs the work.

Member for Nhulunbuy says he doesn't feel qualified to make decisions for the town the electorate is named for.

The township of Nhulunbuy is one of the biggest populations centres in the electorate. Home to about 4000 people in 2011, its population has dwindled significantly since the aluminium refinery, which was its major employer, closed in 2014.

Speaking to the NT News before the outcome of the election was known, its now-local member Yingiya Mark Guyula said he didn't want to govern for the community.

"This (the remote communities) is where I want to work. I don't want to make decisions for a white community," he said.

When asked to elaborate, Mr Guyula said he wanted to work with Nhulunbuy residents to govern for the town.

"I'd rather let them make the decision and then we can sit down together and listen to those people," he said.

Mr Guyula narrowly beat former Labor deputy Lynne Walker to win the seat.

Labor president Syd Stirling yesterday said the party would not contest the close election result that Mrs Walker reported lost by eight votes.

Mr Guyula said too many decisions relating to indigenous residents of remote communities were made in the past by outsiders purporting to speak for senior elders. He said he didn't want to do the same thing to the predominantly white Nhulunbuy community.

"That is the mistake that made me stand up put my hand up and say 'no you are not really representing us, you are not telling the right story that we want you to tell'," he said. "I'm not going to speak up for them, but speak up with them."


Mr Guyula campaigned on the promise to fight for a treaty and the recognition of customary law.

"People have been afraid in the town of Nhulunbuy when they hear treaty," he said.

"We are only saying let Nhulunbuy stay as Nhulunbuy and be how they want it to be."

In the remote wilderness of East Arnhem Land, a quiet political revolution had been brewing.

A traditional man named Yingiya Mark Guyula, a pioneering pilot with family members scattered across the vast tropics off the Gulf of Carpentaria, was campaigning through the bush, preparing to make his entrance into parliament.

He made headway in July's federal election. By August, he was ready. What happened next rocked Territory politics.

Yolngu voters — Guyula's countrymen — were to play a part in the greatest upset of the 2016 Northern Territory election and help hand what was believed to be a safe Labor seat to this widely unknown independent.

Guyula won the seat of Nhulunbuy in spectacular circumstances. Perhaps, it now appears, in controversial circumstances. And he did it by just eight votes.

In taking this triumph for the bush, feathers were substantially ruffled in the region's biggest township.Guyula's slim victory meant the incumbent of eight years, respected Nhulunbuy local and would-be deputy chief minister Lynne Walker, was knocked out of office. The townsfolk were aghast.

The bush was elated. An Aboriginal leader from a remote community was to become the highest authority over the sprawling electorate — including the majorly white populated mining town.But in a twist to the saga, a possible NT Electoral Act breach could see Guyula turfed out before he's even gotten started.Now, people on both sides of the fence — the town and the bush — fear their isolated region could become racially divided over the issue."There are a lot of concerns from people in town that unless we're very, very lucky, this will play out as black versus whitefella," one Nhulunbuy resident told NT News. "And nobody wants that."

AUTHOR and advocate Richard Trudgen picked up his phone this week to the bewildered voice of a senior Yolngu elder. The man was confused. Why were rumours swirling that Mark Guyula might not be leader? Even though we voted for him — and he won? "Don't elections work? Doesn't their Whitefella law work? That was where the old man was (coming) from," Trudgen said yesterday.

Countrymen were shaking their heads, mystified.They couldn't understand how, through a fine print clause — a possible breach of law — Guyula's election could be, as the NT Electoral Commission wrote in their submission to the Court of Disputed Returns, "wholly void".In his Milingimbi homeland prior to the election, Guyula had been signed up as a paid member of a local authority which, regulation suggests, he would've had to officially resign from to legally run for the seat of Nhulunbuy."In Mark's mind, he wasn't on the committee," Trudgen said."He hadn't been to so many meetings ... he assumed he wasn't on the committee."

He then, as I understand, went to a special meeting which they called him to, to deal with post-cyclone plans. Now, they probably paid him a sitting fee for being there ... but in his mind, he wasn't a committee member."Whether or not this was so, the matter now sits before the court, awaiting resolution.The case against Guyula has triggered widespread animosity across the homelands, says Trudgen."There's a lot of anger out there now ... I say to them, 'why do you hate balanda (whitefellas)?'

And they're saying 'because balanda hate us ... every time we win, they push us back'."A bearded scholar, Trudgen has been closely connected to the Guyula campaign.The groundswell in the bush, he says, was more than anything stirred by the candidate's impressive background."He is the only Yolngu person who ended up with an engineering certificate in aircraft engineering, the only Yolngu person that's had a pilot licence," he says.

"He's been a major achiever, a very quiet major achiever."Lynne WalkerTrudgen's son, Kendall, has been an integral figure in Guyula's election — he's taken on the role of his electoral officer and spokesman.The younger Trudgen has become a somewhat divisive figure in Nhulunbuy — some in the town view his role as a sort of puppeteer, essentially acting on the MLA's behalf.Kendall, who himself took a tilt for the seat of Nhulunbuy as an independent in 2012, disputes this notion.

"They don't understand that Yolngu people can think for themselves and speak for themselves, they think I'm the mastermind," he said."I didn't get him elected ... it's not my agenda. It is hard work what I do — I play an intermediary role."Central to the argument is a view of many in Nhulunbuy that Guyula doesn't represent their interests — with his headquarters in Milingimbi, he won't be as present in the town as Walker was.

"Yingiya is intimately connected to the (bush) community in the electorate," says Kendall. "And that's just life, what can you say."FOR months, if not years, a clock tower stood in the centre of Nhulunbuy town square, devoid of any faces — just a hollowed out metal head on a stand.

Then, early in 2014, the timepieces were finally restored; fresh new faces were inserted and the long-missing clock finally began ticking.This repair coincided with an ending era — the closure of Gove's Rio Tinto alumina refinery.The plant's wind down had been formally announced in November 2013, rounding up months of tense speculation.Once booming at around 4000 people — the NT's fourth biggest town — more than 1000 workers were to lose their jobs, take their redundancies and families, and move on.This month marks three years since the announcement and, despite the population drop, Nhulunbuy is still ticking along.But some amenities have been stripped away; local newspaper the Arafura Times, the newsagency, IGA supermarket and private doctors' clinic are all casualties.With the dwindling numbers, Guyula's time had arrived — and the townsfolk were taken by surprise.

"Kendall and Mark ran a very good, quiet race," said Dave Suter, a committee member of East Arnhem Chamber of Commerce.A major blow to Walker's chance was the redistribution of electoral boundaries in 2015 which, to account for the slipping population of the town, were widened to take in the remote hubs of Ramingining and Milingimbi — Guyula's heartlands.

"She was a new face to a couple of these communities where she hadn't represented before," Suter says."And they didn't know what she could do for them."Lynne was well-respected by a lot of people in the town for the tireless work she had done in Nhulunbuy ... but also out on the communities, she's worked very hard out on the communities."Despite this, Walker was destroyed by the remote vote.

The bush mobile polling stations, plus booths on Elcho Island, saw Guyula storm home with 1181 first count votes compared with Walker's 481.In the township, a relatively low voter turnout — blamed now on the complacency of those who thought she was a shoo-in for the seat and failed to vote — saw her poll less than 1000. Guyula scored just over 100 votes in Nhulunbuy.As the final postal votes trickled in, and with a margin of less than 20 votes between the two candidates, Walker posted a subtle message to those who forgot to cast their ballots: "Please, no more calls or PMs telling us you forgot to vote and asking is it too late ... you are waaaaay too late to vote."

In the final count on September 10, post-preferences, Walker was defeated 1648 votes to 1640.IF the court finds Guyula's candidacy was void, a by-election for Nhulunbuy could loom in 2017.Or, in what would no doubt be judged harshly by pundits across the homelands, Walker could be restored to the seat as the legitimate victor."At the end of the day, he won by the votes — whether it was one vote or 5000 votes, mate, he won, and people should get behind him," Dave Suter says."

Then again, if he's done something wrong, then the electoral commission needs to do what they have to do."Because whether he was a black candidate or a white candidate, or a yellow candidate or a green candidate, those rules apply to everybody.

INDIGENOUS groups say Scott Morrison's Federal Budget has failed Aboriginal people.

Australians for Native Title and Reconciliation director Andrew Meehan said little had been done to meet the government's closing the gap targets, despite Prime Minister Malcolm Turnbull acknowledging earlier this year "at a national level, progress needs to accelerate".

"The government is failing to adequately address the disadvantage experienced by the nation's First Peoples, failing to inject any sense of urgency in turning around these issues, and failing to adequately listen to and work with First Peoples," Mr Meehan said.

He said if the government was serious about ending disadvantage, it needed to be prepared to cough up cash to fix problems in health and housing, and pay for a national inquiry into racism in the health system.

The Budget's indigenous strategy was largely business focused, extending support for indigenous entrepreneurs.

It also outlined a plan for the Productivity Commission to evaluate policies affecting indigenous people through a specialist commissioner.

The Budget also sets out a plan to subject welfare recipients to drug tests. If they fail, they could be booted off the dole or have payments quarantined. Social Services Minister Christian Porter said unemployed people were 2.4 times more likely to use illicit drugs than those with jobs.

The new compliance regimen was expected to save the government $632 million over four years.

A GOVERNMENT program aimed at providing incentives to companies that hire indigenous workers has been suspended over allegations of fraud.

The full extent of the fraud is unknown at this time, but is suspected to involve tens of thousands of dollars, but most likely more.

Infrastructure Minister Nicole Manison suspended the Indigenous Employment Provision Sum program Friday afternoon after being informed of "potential widespread fraud" by the Department of Infrastructure, Planning and Logistics following an audit.

Ms Manison said six companies have been referred to NT Police for investigation. More could be referred later.

"The program was well intentioned, well meaning and was all about ensuring we had more indigenous Territorians in jobs," she said.

"However, there have been cases brought forward that the Department has now had to refer to police.

"In the meantime, we are working to look at what can replace this program.

"We're still targeting making sure we are enhancing employment opportunities for indigenous Territorians."

It is alleged companies were improperly claiming indigenous employees who weren't indigenous in order to qualify for construction contract tenders.

Ms Manison said there was no independent oversight of the program to check on the individual companies' employment claims.

"However some questions have been raised around that," she said.
