Illegal immigrant raped Maryland girl, 16, at knifepoint in her bedroom, police say

An illegal immigrant in Maryland is alleged to have crawled into the bed of a teenage girl while she was taking a nap and placed a knife against her throat before proceeding to rapeher, according to authorities.

Federal officials have requested to keep the man in custody.

The Montgomery County Police Departmentsaid Nelson Saul Reyes-Medrano, 46, is charged with first-degree rape, sex abuse of a minor, and first-degree assault in connection with the late August 2018 attack.

A U.S. Immigration and Customs Enforcement spokesman told Fox News that Reyes-Medrano was living in the U.S. illegally and the federal law enforcement agency has lodged a detainer against him.

Local police said the victim, who was 16 at the time, was taking a nap at the apartment where Reyes-Medrano also lived when she felt someone else get on the bed. She opened her eyes and saw the 46-year-old had positioned himself on top of her.

NEW: Nelson Reyes-Medrano is accused of crawling into bed with a 16yo Germantown, Md. girl as she napped. The 46yo proceeded to rape the teen at knifepoint, police say.

"Take your clothes off," Reyes-Medrano allegedly told the victim twice according to court documents obtained by WJLA, before placing the dull side of a knife against the victim's neck.

After the victim slowly started to undress, he allegedly grew impatient and proceeded to rape her.

The victim told detectives she was in pain during the entire assault, which only ended after a noise was heard outside the apartment and Reyes-Medrano got off the bed, put his clothes back on and left the apartment with the knife he allegedly used to threaten the teenager.

A rape suspect has been freed in Maryland despite a request from ICE that he remain in custody.

A Montgomery County District Court denied bond for Reyes-Medrano, citing the severity of the allegations and pending ICE detainer, WJLA reported.

"The allegations are incredibly serious," Judge Amy Bills said in court. "The allegations are that a knife was brandished and a first-degree rape occurred."

ICE detainers serve as a legally authorized request, upon which a law enforcement agency may rely, to continue to maintain custody of an illegal immigrant for up to 48 hours so that ICE may assume custody for removal purposes, according to the federal agency.

Maryland jail ignores ICE detainer request, releases illegal immigrant arrested on rape, assault charges

Marc Elrich, executive of Montgomery County, defended his police department's decision; reaction and analysis from Fox News contributor Tom Homan, former acting ICE director.

"Pursuant to ICE policy, all ICE detainers are submitted with an accompanying administrative arrest warrant or warrant of removal depending upon the circumstances of the individual case," an ICE spokesman told Fox News.

The latest arrest comes after another illegal immigrant accused of rape was released from the Montgomery County Detention Center just three days after being arrested. At the time, county officials said they notified ICE that the suspect was being processed for release that day, even after the federal agency filed a detainer.

Montgomery County, Md., designated itself for “sanctuary” status in July, according to FOX5.

The order signed by County Executive Mark Elrich says no county agency – including police departments – can cooperate with ICE. Immigration agents are now barred from entering secure portions of county jails, and now have to take custody of illegal immigrants in public areas, such as jail parking lots.

Seventh illegal immigrant accused of sex crimes in Maryland county since July 25

A Honduran national in the United States illegally has been accused of raping his 15-year-old stepdaughter in suburban Maryland, the seventh such case in the area over the past five weeks.

Emilio Carrasco-Hernandez, 37, is charged with second-degree rape, sex abuse of a minor, third-degree sex offense and fourth-degree sex offense, according to WJLA.

The alleged victim spoke to Montgomery County police and claimed that her stepfather sexually assaulted her multiple times between Aug. 16 and Aug. 25. She alleged that she was unable to use the bathroom after one of the assaults because it was "very painful" and left her with a "stinging" feeling.

"Victim A stated that she could not move and Emilio Carrasco-Hernandez was squishing her with his body," detectives reportedly said of the incident. The 200-lb. Carrasco-Hernandez allegedly kissed the girl's body and even bit her shirt in one incident.

The victim's mother reportedly booted Carrasco-Hernandez from their Wheaton home after finding the two of them together in a bedroom. While the age of consent in Maryland is 16 years old, the mother said she believed it was a consensual act fueled by alcohol.

In a statement to WJLA, U.S. Immigration and Customs Enforcement (ICE) said that Carrasco-Hernandez was previously deported in April 2017, but re-entered the United States "sometime thereafter."

Carrasco-Hernandez could face up to 56 years in state prison in convicted on all charges. He also faces up to 20 years in federal prison for re-entering the U.S. having been previously deported, an ICE official told WJLA.

The agency reportedly placed a detainer on the Honduran national and he was put in jail without bond. He faces charges of second-degree rape, third and fourth degree sex offenses, and sex abuse of a minor.

Since July 25, Montgomery County Police have arrested at least seven confirmed undocumented immigrants for alleged rapes and sexual assaults. Montgomery County Executive Marc Elrich signed an executive order last month designating the county a "sanctuary" jurisdiction.

The order states that no county agency – including police departments – can cooperate with ICE. Immigration agents are barred from entering secure portions of county jails, and must take custody of illegal immigrants in public areas, such as jail parking lots.

Earlier this month, another undocumented immigrant was arrested on second-degree rape and assault charges but was released days later after the Montgomery County Jail ignored ICE's detainer request.

An ICE officer tried to stop a truck outside a Tennessee grocery store. Then he opened fire

Nashville, Tennessee (CNN) — An ICE officer opened fire in a Tennessee grocery store parking lot as he attempted to make an immigration arrest there Thursday.

The officer fired two shots after a driver he was trying to arrest during a fugitive operation drove toward the officer while fleeing the scene, ICE spokesman Bryan Cox said, citing initial reports.

While ICE operations are a regular occurrence across the United States, it's rare to hear of shots fired in public places as they unfold.

It's unclear if anyone was injured in the confrontation, which occurred in a Food Lion parking lot outside Nashville in Antioch, Tennessee.

An FBI spokesperson said the agency is now investigating a possible assault on a federal officer.

The FBI is the lead agency in the investigation, Cox said, and federal prosecutors will decide whether any criminal charges are filed.

ICE's Office of Professional Responsibility, which looks into all officer-involved shootings involving ICE, is also investigating, Cox said.

Investigators cordoned off the parking lot with crime scene tape Thursday and combed the scene for evidence.

The target of Thursday's ICE operation was a 39-year-old Mexican national who'd been deported multiple times, Cox said. He remains at large.

The truck he was driving is now in FBI custody, said Matt Foster, assistant special agent in charge of the FBI's Nashville office. The vehicle was found abandoned with blood inside, an ICE official said.

Nashville Mayor David Briley slammed the shooting in a statement Thursday, CNN affiliate WZTV reported.

"This is exactly what we don't want happening in our city," he said, adding that police are currently "looking for the victim...so that he may receive any needed medical assistance."

Cox declined to comment on the mayor's statement. He noted that Nashville is a jurisdiction that doesn't cooperate with ICE.

"Any time an officer has to pull over a vehicle and make an arrest on the street," Cox said, "that is the most dangerous way. ... This is a rare example, but it's nevertheless an example of the increased dangers that take place when this agency is forced to do more at-large arrests to take persons into custody."

6 MS-13 gang members, illegal immigrants involved in deadly Maryland stabbing, ICE says

Six of the seven people charged in the stabbing death of a man in Maryland in July have been identified by federal officials as being part of the MS-13 gangand in the country illegally, according to U.S. Immigration and Customs Enforcement.

The Baltimore County Police Departmentannounced Tuesday that seven suspects, including a 16-year-old charged as an adult, were charged with killing 21-year-old Daniel Alejandro Alvarado Cuellar.

Cuellar's body was discovered July 31 in the grass outside an apartment building in the Townson area and had "multiple sharp-force injuries," officials said in a news release.

Police said that Cuellar was the intended victim of a planned gang-related murder, but said a motive for the slaying remained under investigation.

“We know this group of individuals was conducting surveillance on him, they were watching him, following him. We know they watched as he left the laundromat and went back across the street to the apartment complex and that is where some of those individuals accosted him,” Baltimore County Police Officer Jennifer Peach told FOX45. “We know they used knives and multiple people stabbed him multiple times.”

The seven suspects were all charged with first-degree murder, according to police.

They have been identified as Jonathan Escobar-Hernandez, 20, of Towson, Md.; Marlon Leonardo Fabian-Flores, 20, of Manchester, Md.; Edwin Edgardo Garcia-Martir, 18, of Middle River, Md.; Hugo Portillo-Chavez, 31, of Cockeysville, Md.; Jose Fausto Rivera-Coreas, 19, of Cockeysville, Md.; Odaliz Rosas-Yanez, 20, of Cockeysville, Md.; and Leonel Alexander Velasquez-Hernadez, 16, of Cockeysville, Md.

An ICE spokeswoman told Fox News on Sunday that the agency has issued six immigration detainers. The federal agency said that detainers were lodged once the individuals entered local law enforcement custody on murder charges.

Of the seven suspects, six are in the U.S. illegally, the ICE spokeswoman added. Of the six illegal immigrant suspects, who were not named, five are Salvadoran and one is Mexican, ICE said.

All of the six illegal immigrants were identified as MS-13 members in an ICE gang database, the ICE spokeswoman said.

Investigators believe that Cuellar's killing was due to a war between two rival Latino street gangs, the 18th Street and MS-13, according to the Baltimore Sun.

The 21-year-old had been seen making a hand gesture that was believed to be “indicative of an affiliation with the 18th Street,” detectives wrote in charging documents obtained by the Sun.

The seven suspects arrested in connection with Cuellar's slaying remain held without bail in the Baltimore County Detention Center, according to police. All seven could face a life sentence in prison if they are convicted, officials said, while adding that it's possible that others may also face charges in connection to the murder.

MS-13 is active in Maryland, but is usually focused in the suburbs around Washington D.C. Earlier this year, a 14-year-old girl was killed with a machete and a baseball bat when MS-13 gang members turned on an associate "in extremely violent behavior."

That slaying came only months after authorities arrested five MS-13 gang members for the murder of another MS-13 member, Jacson Chicas, 16. He was stabbed more than 100 times and then dumped on the side of a Virginia road and set on fire.

In 2019, officials said that MS-13 has been ramping up recruitment in the D.C. area after taking a break in 2018.

"We've seen a rise in gang activity here this spring. There have been a few homicides in the region, as you've seen," Jay Lanham, director of the Northern Virginia Gang Task Force, told FOX5 in June. "Last year, we saw the gangs, especially MS-13, laying low. We arrested a lot of the program and clique leaders so their leadership was lacking."

Lanham said at the time that the 18th Street Gang is MS-13's top rival.

MS-13, also known as La Mara Salvatrucha, recruits young teenagers from El Salvador and Honduras, though many gang members were born in the U.S. The gang has been blamed for dozens of killings since January 2016 across a wide swath of New York's Long Island, the Los Angeles area, and the D.C suburbs.

The notorious MS-13 gang has been singled out by President Trump for its brutality, which has led to a series of crackdowns by law enforcement on the federal and local levels.
