China's deputy ambassador has lashed Australia for banning Huawei in a fresh attack accusing the government of illegal and immoral conduct.


Australia was the first country to ban the Chinese communications behemoth from its 5G network in 2018, with the move a key turning point in souring diplomatic ties.

Wang Xining, who is China's deputy head of mission in Australia, questioned why intelligence forces had the "guts" to claim Huawei posed a threat


"Australia connived with the United States in a very unethical, illegal, immoral suppression of Chinese companies," he told the National Press Club on Wednesday.

Mr Wang said Australia was among western nations with a strong tradition of eavesdropping and "digging into others' houses".

He said if Australia believed in a barbaric model of devour others or be devoured it should be honest.

"Don't try to pretend that you have the moral high ground," the high-ranking diplomat said.

"The Huawei Australia company suffered a lot because of the unethical deeds by your government."

The deputy ambassador said he didn't see any obstacle for the resumption of normal China-Australia relations if Canberra stopped interfering in Beijing's affairs.

Australia has been a strident critic of human rights abuses that have been documented against Uighurs in Xinjiang.

Foreign Minister Marise Payne has condemned restrictions on the freedom of religion, mass surveillance, extra-judicial detentions, forced labour and sterilisation but stopped short of sanctions

In addressing the issue, Mr Wang referenced a Chinese science-fiction movie about aliens invading the earth and putting two billion people in Australia to use as food.

"There's a scenario where people got very nasty in Australia, because there are two billion people here," he said.

"So think about putting every Australian in Xinjiang, which is identical to the land size of Queensland and have a vast occupation of desert. The issue is far more sophisticated in Xinjiang."

Australia has a similar population to the Chinese region.

In another sign Beijing would retain its muscular approach to criticism, Mr Wang said the Chinese people saw themselves as hard-working cattle, like ox – the zodiac sign of 2021.

"We like to share our yoke with all partners to plough through the difficulties caused by COVID-19 and sail through this trying time," he said.

"But at the same time, China is not a cow. I don't think anybody should fancy the idea to milk China when she's in her prime and plot to slaughter it in the end.

"So we are open for collaboration and cooperation, but we'll be very strong in defending our national interest."

He said Australian media oversimplified China's politics and lacked a truthful, objective or sophisticated understanding of the country.

But he also expressed sympathy with Australian correspondents who left China after pressure from security forces

"We'll continue to discuss and we'll find out a solution for this."

It is the first time since the mid-1970s no Australian media company has a presence in China

China has slammed Australia's "provocative" decision to tear up Victoria's Belt and Road Initiative agreement with Beijing, warning the move will further damage bilateral relations.

Foreign Minister Marise Payne announced on Wednesday night that the infrastructure deal had been cancelled under new foreign veto powers.



It is the first time the Commonwealth has used new powers that allow it to cancel agreements that state and territory governments, local councils and public universities strike with other countries

China's embassy in Australia responded swiftly, expressing "strong displeasure and resolute opposition" to Senator Payne's announcement.

"This is another unreasonable and provocative move taken by the Australian side against China," a Chinese embassy spokesperson said in a statement.

"It further shows that the Australian government has no sincerity in improving China-Australia relations.

"It is bound to bring further damage to bilateral relations, and will only end up hurting itself.

In December, the Morrison government granted itself the ability to torpedo deals between individual states and foreign powers under the Foreign Relations Act.

The foreign minister can assess such arrangements to check if they align with Australia's foreign policy goals.

Senator Payne said four agreements would be cancelled, two of which related to Victoria's Belt and Road deal for infrastructure investment.

"I consider these four arrangements to be inconsistent with Australia's foreign policy or adverse to our foreign relations," she said in a statement

Victoria signed a memorandum of understanding in relation to the Chinese regional infrastructure initiative in 2018 and then signed a "framework agreement" with Beijing in 2019.

Areas of cooperation included increasing participation of Chinese companies in Victoria's infrastructure program and promoting cooperation of Victorian businesses in China.

It also allowed Victoria's engineering and design firms to bid for contracts for Belt and Road Initiative projects around the world

Victorian Premier Daniel Andrews has previously advised against the cancellation of the deal, saying it would place Victorian jobs at risk.

A state government spokeswoman told AAP the Foreign Relations Act was a matter for the Commonwealth.

"The Victorian government will continue to work hard to deliver jobs, trade and economic opportunities for our state," she said in a statement on Wednesday.

Beijing has previously raised Canberra's veto power as one of 14 grievances damaging to bilateral relations.

China has in the past 12 months launched a series of damaging trade strikes against Australia after Prime Minister Scott Morrison called for an independent inquiry into the origins of the COVID-19 pandemic.

The Chinese government also remains furious with Australia over foreign interference and investment laws and the decision to ban Huawei from the country's 5G rollout.

Australia fears projects used to project China's power

The BRI is a massive network of Chinese-funded infrastructure projects – including new ports, pipelines, railways and highways – stretching from Asia to Europe.

Australia has become increasingly anxious that it has been used as a vehicle for cementing the Chinese government's influence and commercial interests across a vast swathe of the globe.

Victoria's BRI agreements do not commit the state government to specific projects and are not legally binding. But federal government ministers have privately complained the agreements allowed China's government to split the Australian domestic consensus on the BRI, handing Beijing an easy public relations win.

They've also warned it might dilute Australia's attempts to press other regional countries to tread warily before signing investment deals under the BRI, and complained federal officials were not shown the final version of the agreement before it was signed by the Victorian government.

When the federal government introduced the veto legislation last year, Prime Minister Scott Morrison denied the laws were aimed primarily at Victoria's BRI agreement with China

But the two other agreements scrapped are both relatively obscure.

One is an agreement between Victoria's Department of Education and Training and an Iranian government agency, while the other is a 1999 memorandum of understanding designed to encourage scientific co-operation between Syria's Ministry of Higher Education and the Victorian Ministry of Tertiary Education and Training.

A Victorian government spokeswoman said: "The Foreign Relations Act is entirely a matter for the Commonwealth government."

The Morrison government's latest stunt – tearing up Victorian government "deals" with China that weren't really deals – achieved its aims of near-universal positive media coverage.

They provided a deflection from the government's more obvious recent failures, wedging the Labor Party into following suit and perhaps embarrassing Daniel Andrews a fraction, that bit pushed along with an inspired follow-up report that the "deals" had been all the Premier's "closely-guarded" work.


Too bad about further escalating the battle we're losing with our most important economic partner for zero gain.

The best excuse Sunday's Insiders panel could come up with was that it was a "propaganda" measure. Such is Australian diplomacy these days.

As a follow up to her blunder of undiplomatically leading the charge for an international inquiry into the pandemic's origin, Marise Payne adds to her claim to be the Foreign Minister who has done the most damage to Australia's interests.

And never mind that the Victorian "deals" were a practically meaningless memorandum of understanding and a "framework" of roughly equal substance.

The pack of China hawks dominating media coverage care little for such details.

Sooled on the Belt and Road stunt, there's been a predictable and painfully ignorant chorus calling for the government to scrap the Northern Territory's lease of the Darwin port to a Chinese company, Landbridge.

On Thursday Liberal backbencher Dave Sharma was telling Fox News the 2015 Darwin deal "needs some further scrutiny".

While it's hard to believe, Mr Sharma allegedly had a spell in our diplomatic corps before politics.

The ABC's Insiders panel stirred the Darwin pot, along with Defence Minister Peter Dutton giving it a nudge while carefully leaving it as a matter for Minister Payne.

That's a change from him having no concerns about the lease in 2015 when he was opening a new Border Force berthing facility in Darwin.

Back then, Mr Dutton and the rest of the government were fully briefed by our security and defence chiefs that concerns about the port lease were a ridiculous beat-up by the usual suspects who apparently had no idea what they were talking about.

But never let facts get in the way of a scary China story – the "Reds under the wharf!" brigade were given and are still given uncritical coverage by credulous media. What's more, their nonsense seems to live on in popular and media memory.

Professor James Laurenceson, director of the UTS Australia-China Relations Institute, summarised the Senate estimates destruction of the Sino fantasies in a 2018 paper. (If you want the full recount of who made fools of themselves, the relevant chapter starts on page 65 – they are familiar names for China hawk watchers.)

In the Professor's own words:

If anyone would be expected to weigh seriously concerns about the security implications of the Darwin Port deal, it would be the heads of the Department of Defence, ASIO and the ADF. Yet all three rejected suggestions that Landbridge operating Darwin Port could facilitate spying.

At the Senate estimates hearing on October 21, 2015 the chief of the ADF, Mark Binskin said, 'If [ship] movements are the issue, I can sit at the fish and chip shop on the wharf at the moment in Darwin and watch ships come and go, regardless of who owns it'.

In comments on November 19, 2015, secretary of Defence Dennis Richardson said that he supported Binskin's fish and chip shop assessment and added, 'It's as though people have never heard of overhead imagery'.

When challenged at estimates about Uhlmann's report (Chris Uhlmann, then ABC reporter, now Channel 9) that concerns were being expressed at the 'highest levels of the ADF', Secretary Richardson said that his experience had shown that, 'anyone who spoke to the media ... was immediately described as a senior diplomat, even if they were quite a junior person'. In any case, 'the most senior people in the ADF are the Chief of the Defence Force], the Vice Chief of the Defence Force and the services chiefs, and I am not aware of any concerns'.

On November 19, 2015 Secretary Richardson told The Australian that Defence and ASIO had looked 'very carefully' at the Darwin Port deal. Both organisations were 'at one' that Landbridge's bid 'was not an investment that should be opposed on defence and security grounds'.

He described spy claims as 'amateur hour' and that 'when you examine them, melt like butter sitting on a car bonnet on a hot day'.

He also put on the record that any claim that Defence had not exercised due diligence was 'based upon ignorance not on fact'.

Secretary Richardson's testimony followed Jennings (Peter Jennings, Australian Strategic Policy Institute executive director) at the Senate inquiry's public hearings on December 15, 2015. He said Jennings' specific claim that the Chinese could monitor the signals that ships were emitting was 'absurd' because any naval vessel entering a commercial port would turn them off as standard operating procedure.

What about the 'strategic' concerns associated with the Darwin Port lease? The Australian National Centre for Ocean Resources and Security's Bateman, also a former Royal Australian Navy Commodore, has noted that ports are a highly regulated industry.

Owning the lease to operate a port means being subject to this regulation, not escaping it. As with any lease, the Darwin Port one came with conditions. If lease conditions are breached, the port's owner, the Northern Territory government, is entitled to step in ...

Yet another layer of protection is given by the Department of Defence having 'step-in rights'.

At Senate Estimates on October 21, 2015, Secretary Richardson cut short Senator Lambie's musings about whether 'the Chinese' could close down the port, interjecting, 'It would be illegal...we have some overriding powers under the Defence Act. So that is not a possibility'.

Secretary Richardson described Wade's claims (Geoff Wade, briefly an ANU visiting fellow, now a Parliamentary Library researcher) that the north of Australia would be opened up to the PLA Navy as 'alarmist nonsense' and that it was 'without foundation in any way'.

He said, 'Anyone who knows the ABC knows it is not the gift of the operator of a port to invite foreign naval vessels to visit'. Naval vessels require diplomatic clearance, provided in Australia's case by the Department of Defence. The idea that Chinese company Landbridge could provide this clearance was 'simply absurd' and 'not factually based'.

If Landbridge does run into financial trouble, Jennings' claims that Darwin Port could fall into the hands of the Chinese government defies basic facts. The land and infrastructure at Darwin Port is owned by the Northern Territory government and accordingly, cannot be mortgaged or put up for sale by Landbridge. If Landbridge defaulted on its lease to operate the port, the terms of the lease specify that its operation would return to the Northern Territory, or be resold to a new buyer who would have to satisfy the Northern Territory government, and if they were from overseas, the Foreign Investment Review Board.

That a six-year old lease deal continues to bubble as a media issue says more about the quality of reporting on relations with China than a minor port's strategic significance

Former prime minister Kevin Rudd says the federal government should conduct a cost-benefit analysis to determine whether the 99-year lease of Darwin Port to a Chinese company is justified on national security grounds.

Landbridge secured the long-term operational control of the commercial facility in 2015 as part of a $506 million deal with the Northern Territory government.

The lease has been controversial from the outset and has remained in the national spotlight amid rising diplomatic and economic tensions between Australia and China


In March, a federal parliamentary committee recommended the Commonwealth consider reclaiming Australian ownership of the port if the lease was deemed to be against the national interest.

The Joint Standing Committee on Trade and Investment Growth, chaired by a Coalition MP, suggested the federal government provide a report on whether the port lease should be subject to Australia's recently enacted Foreign Relations Act
Questions about whether the Morrison government would act on the committee's recommendation intensified last week after it used the new legislation to void a Belt and Road Initiative agreement signed between Victoria and China.

On Sunday, Defence Minister Peter Dutton told the ABC's Insiders program the government was assessing "thousands" of foreign agreements signed by states, territories and universities.

But he remained noncommittal as to whether the port agreement, which is a commercial contract, would come under scrutiny.

"I'm not pre-empting or suggesting that [Foreign Affairs Minister Marise Payne] is looking at it," Mr Dutton said.

"I think it's a question for Marise to look at these individual cases.

"If it's not in our national interest, then, obviously, she'll act

Speaking on ABC Radio Darwin on Tuesday, Mr Rudd said the public deserved to understand whether the lease arrangements were in the public interest.

"The federal government [should] produce a cost-benefit analysis on national security terms as would justify the retention of the existing lease arrangements so that the Northern Territory public, the Darwin public and the Australian public can have a basis for analysing what decision should now be taken," Mr Rudd said.

"My prediction, by the way, is this is exactly the direction that Morrison will now take it.

"He will seek to tear up the lease, in my judgment, because it's hurting his government politically."

The lease was signed by former CLP chief minister Adam Giles, but Mr Rudd said key ministers within the federal Coalition government were also responsible for the outcome.

"[It was] all approved, all let through, by Morrison when he was Treasurer [and] Frydenberg was then Minister for Northern Australia," Mr Rudd said.

He added that former minister Andrew Robb also took on a lucrative consulting job with Landbridge after he left office.

"For all those political reasons, Dutton, Morrison, Frydenberg know that they are deeply exposed on this issue.

"Hence, my prediction is that they will seek to scupper the lease and then there'll be a huge financial liability on the part of the taxpayer

Chief minister Michael Gunner has repeatedly said buying out the lease at a cost of almost half a billion dollars would not be a good use of taxpayer spending.

Mr Rudd said it would be up to the federal government to pay, should they decide to revoke the lease.

"If the feds are going to do this, I imagine they will have to stump up the cash themselves," he said.

Mr Rudd said he was not privy to current intelligence briefings, but he was aware of concerns raised by the US after the deal was signed.

"My understanding from Washington, for example, is that the US administration at the time was absolutely ropeable by the dim-witted nature of this particular decision back in 2015."

The ABC has contacted the Department of Foreign Affairs and the office of Minister Marise Payne for comment.

DFAT has previously said the Darwin Port lease was not within the scope of the Foreign Relations Act.

NT CLP senator Sam McMahon said the lease differed from Victoria's recently revoked Belt and Road Initiative memorandum of understanding with China.

"It is a commercial arrangement with a company; it's not a direct arrangement with the Chinese Communist Party, so it does fall outside those terms," she said.

Ms McMahon said she was not in favour of revoking the lease on national security grounds.

"As far as I'm aware from a Defence point of view, there are no security concerns," she said.

"That's on public record, that Defence currently have no security concerns."

She said the lease should not be "arbitrarily torn up".

However, she said she had recently asked Senator Payne to assess whether Landbridge was meeting its lease obligations in terms of infrastructure upgrades at the port.

"We have an obligation on our part to honour our side of the contract.

"But if there has been a breach of those terms of the contract, then we definitely need to look at whether we can take some sort of action

China's government has announced it is indefinitely suspending all activities under the China-Australia Strategic Economic Dialogue – the first formal freeze of a diplomatic mechanism since relations between the two countries soured.

China's main planning body, the National Reform and Development Commission, announced the move in response to actions by the Australian government.

Beijing accused Australia of carrying out a "series of measures to disrupt normal exchanges and cooperation" and said the Commonwealth government had a "Cold War mindset" and practised "ideological discrimination


High-level ministerial communication had already been frozen by China's government and this latest move comes after the Morrison government last month cancelled a Belt and Road agreement between China and the state of Victoria.

"Recently, some Australian Commonwealth Government officials launched a series of measures to disrupt the normal exchanges and cooperation between China and Australia out of Cold War mindset and ideological discrimination," the National Development and Reform Commission said in a statement explaining the decision.
