A ban on flying Nazi swastika flags and other symbols will be several months away at least, with the state Labor government cool on Sunday to opposition calls for swift action.

The government says it will wait for a review of Victoria's hate-speech laws already under way in the state Parliament before it considers new bans or crackdowns.

But the state Liberal opposition, backed by Jewish and anti-racist groups, say that urgent action is needed to combat what it calls a rising tide of hatred in the community.

The Liberals plan to bring laws into the Parliament that would give Victoria police the power to tear down Nazi flags and with potential criminal penalties of up to six months in jail for extremists caught flying the hate symbol.

The Nazi insignia pushed itself onto the agenda last month when local and states authorities found themselves powerless under the law to act against a householder in the remote Mallee town of Beulah who flew a flag emblazoned with the Swastika above their home.

The Anti-Defamation Commission's Dvir Abramovich, who has campaigned for two years to criminalise the public displays of the Nazi swastika and other Third Reich insignia, welcomed the Liberal party announcement on Sunday.

"The alarming spike in anti-Semitism in our nation, and the recent savageries in Christchurch, Pittsburgh and San Diego are a wake-up call that all legislative and policing measures must be marshalled to combat the white-supremacist threat lurking within our midst," Mr Abramovich said.

"The time for action is now.


"I call on Premier [Daniel] Andrews and his government to rise to the challenge and to pass these proposed laws because fighting vicious incitement and violent bigotry, no matter the source,  should never be a partisan issue."

The co-president of Melbourne's Jewish Holocaust Centre, Sue Hampel, also backed the calls for ban.

"The fact is that the swastika represents industrialised mass murder of people considered subhuman," Ms Hempel said.

"It symbolised it 90 years ago, and it still symbolises it today."

Her co-director of the Elsternwick museum, Jayne Josem, said a ban would send a strong message.

"Banning the swastika will be an important gesture demonstrating that our government finds it abhorrent in 2020 in Australia to see such vile symbols," Ms Josem said.

"Banning the swastika will not solve anti-Semitism, but it will curb its visibility and it is this visibility which has the potential to encourage anti-Semitism among people who would otherwise not consider it."

Mental Health Minister Martin Foley, out in St Kilda for Sunday's Pride march, said that he and his colleagues condemned any display of Nazi propaganda and any other forms of racism or intolerance.

But the minister said the government wanted to wait until the Parliamentary committee process, which has several months to run, was finished before it made a move

"Any expression of Nazi propaganda and any offensive anti-Semitic, racist paraphernalia, has no place in Victoria," Mr Foley said.

"We are working through the processes, through the racial vilification act review that's currently being led by a Parliamentary inquiry and we look forward to that committee reporting to the Victorian government and the government acting on those recommendations."

'For that to appear in 2021 in Brisbane over a synagogue is just atrocious.'

Queensland Police confirmed they went to the apartment, seized the flag and issued the resident a notice to appear for public nuisance.

However Mr Steinberg wants the state's laws modified to make it clear showing the symbol is unacceptable.

'The state parliament is reviewing the hate crime legislation as we speak,' he said.

'We called on the banning of the swastika to be displayed and Nazi flags like this because at the moment ... it doesn't breach the serious hate or vilification law

Brisbane Lord Mayor Adrian Schrinner labelled the display as 'sickening' and 'pure evil'.

'Under the current inadequate laws, this is likely to be classified as nothing more than a low-level 'public nuisance'. Not good enough!' he posted to Twitter on Sunday

Queensland Multicultural Affairs Minister Leanne Linard also took to social media to call out the 'disgraceful' act.

'Incidents like this are why the Palaszczuk Government launched an inquiry into serious vilification and hate crime,' Ms Linard posted on Facebook on Saturday

Public rallies on polarising issues have become platforms for far-right extremists to gain screen time and attract new members, experts in right-wing extremism have said

Experts told The New Daily that neo-Nazi groups feel emboldened and beyond the reach of law enforcement, but said their increased visibility was not a sign of rising Nazism.

"These extremists are not trying to change the political landscape, but rather to project strength and group cohesion as a recruitment drive," Deakin University associate professor of politics Josh Roose said.

Although most Australians were disgusted by their actions, the extremists targeted a small percentage of people, particularly men, who may be attracted to their message, he said.

Far-right extremism is not limited to urban areas. It is also prevalent in rural regions where young men are disengaged due to growing inequality and insufficient social institutions, Dr Roose said.

The combination of patriotism and identity politics found in far-right ideology can resonate with people who might not be exposed to diversity.

Dr Roose said the rise of far-right extremism was a global phenomenon, and was particularly common in the United States.

Both European and US traditions have influenced Australia, and the rise of social media and encrypted messaging apps has made it easier for extremist ideas to spread

Tom Tanuki, a commentator on fringe and radical politics, said that a climate of fear and scarcity was contributing to Nazism in Australia.

He said real-world concerns such as climate change, economic disparity and growing distrust in institutions of power, exacerbated by the COVID-19 pandemic, have created an environment ripe for fascist recruitment

"Fascists thrive on a climate of fear and scarcity. They capitalise on these fears by inventing common enemies to blame for a sense of scarcity, galvanising people behind a shared fear of other groups," he said.

"The enemies are rarely [anything] more than demonised individuals making up powerless, marginalised minorities."

The recent protests have raised concerns about the handling of such events by Victorian police, with some accusing law enforcement of protecting neo-Nazis.

"The optics of them being protected by Victorian police does not look good," Dr Roose said.

"[Police] may well be doing their job and keeping the peace, but there is certainly a level of outrage amongst the wider community and awareness of what [Nazism] entails and the need to reject it."

He said it was important for law enforcement to effectively manage protests to prevent violence and conflict in the streets.

"[Neo-Nazis] are drawing their directions and tactics directly from the United States where far-right extremists are targeting trans events ... they are actually going and patrolling and literally seeking to physically intimidate and coerce people, who are trans rights activists, into shutting down their events.

Dr (((Andre Oboler))) - former president of the Jewish Community Council of Victoria - is the CEO of Online Hate Prevention Institute and he said governments needed to enact laws banning the glorification of Nazism urgently.

Nazi salute ban

The Victorian government announced it would fast-track a ban on the Nazi salute following the weekend's rally.

"We need to move beyond banning individual symbols. So long as we stick with this approach, the Nazis can stay one step ahead of the law," he said.

"We need to tackle the spread of the underlying ideology. Other countries have laws that ban the glorification of Nazism and use of Nazi symbols. They give police the discretion to determine when actions may breach such laws, and let the courts judge the breaches. We should do the same."

Mr Tanuki argues against expanding legislative and police powers to address this issue.

He said such measures have historically been used against progressive movements rather than thwarting fascists.

"The brutality and over-reach of law enforcement and government officials often enflame the anxieties that fascists use to recruit with," he said.

"We need to stop daydreaming that more laws will fix the problem of these scumbags for us.

"We need a healthier, organised, activist left. Anti-fascists need to bind together and show up more because we ruined the patriot movement, which was enormous, so yes, we can definitely annihilate a scattering of violent neo-Nazis, too."

A furious Peter Dutton has rejected any suggestion he has been less than forthright in condemning extreme right-wing behaviour, in a fiery passage of question time on Tuesday.

Federal Attorney-General (((Mark Dreyfus))) accused the federal Opposition Leader – "the most senior Liberal in Australia" – of being all but invisible in a public debate on neo-Nazism after an anti-transgender rally in Victoria drew displays of the Nazi salute and calls for it to be banned.

"I won't take a moral lecture from that man [Mr Dreyfus] or indeed, that one [Prime Minister Anthony Albanese]," he said in response.

Victorian Liberal MP Moira Deeming's involvement in organising, promoting and attending last Saturday's Let Women Speak rally in Melbourne was swiftly condemned by state Liberal leader John Pesutto.

He is seeking to expel Ms Deeming after she spoke at the rally on the steps of the Victorian parliament. It was organised by British anti-trans activist Kellie-Jay Keen-Minshull and attended by neo-Nazis, who repeatedly performed the Nazi salute.

Victorian Liberals are at odds over the expulsion push, with several voting against the idea on Tuesday. Mr Pesutto prevailed, and the motion will be voted on next Monday.

His move has also drawn criticism from the far right of politics, including from former Liberal senator Cory Bernardi. He said Mr Pesutto's authority in the party had been wounded by statements against the rally that Mr Bernardi criticised as "woke".

On Tuesday, Mr Dutton told the House he resented being linked to the debate on Nazi symbols after what he said had been a long record in public life of clamping down on extremism.

"I want to join with the Attorney-General in the remarks that he's made, so far as they go to condemnation of any use of Nazi symbols – of the salute, of any glorification of that period of history," he said.

"I would support any legislation in this parliament that you choose to move, noting you have not chosen to move any legislation ... to make illegal in our country the display of any aspect of Nazi glorification.

"The slaughter of Jews and the treatment by the Nazis of people during the Second World War, the treatment today of people of the Jewish faith is an abomination.

"It is equally condemned that it would be used for political purposes in this place; it is a very poor reflection on you.

"As minister for home affairs and as the minister for defence, as a member of the national security committee, I supported every decision – in fact, encouraged, to the nth degree – [by] the director-general of ASIO to use every resource at his disposal to make sure that those who seek to propagate this to be prosecuted under the law."

Debate following Saturday's scenes at the Victorian parliament has led the state government to begin moving to outlaw the salute. Victorian attorney-general Jaclyn Symes has admitted it will take "some work" to get legislation right.

Victorian Premier Daniel Andrews said banning the Nazi salute, also known as Sieg Heil, would be complex and the government would carefully draft the bill.

"There are some other jurisdictions, some European countries who have successfully been able to do this," he said.

On Tuesday, Mr Andrews said the anti-trans rally was a "nasty" and "hateful" event long before masked men used the Nazi gesture.

"Why would you make it harder for trans Victorians? The notion that people are choosing this for fun ... it's so offensive, it's so cruel, it's not mainstream thinking," he said.


So ... what did so many Europeans hate Jews for? Could it be they couldn't prosper because Jews parasited their homelands for themselves and corrupted their home states? Hmmmm?!

Australia was never a place where you would see swastikas flying in the wind. It was always just one or two here and there and nothing more. NO NEED TO ADD TO HATE CRIME LAWS! Then along came a bunch of kids playing at Neo-Nazi, led by a TRAITOR with a history of denouncing genuine White Activists as Neo-Nazis. Just a few swastikas and Hitler posters here and there were enough for the Jew, the MSM and the JOG working together, and now it's years in prison if you're caught displaying swastikas anywhere in Australia - and that includes online too.

Australians who display Nazi insignia will face up to a year in jail as a new ban on the fascist symbols is brought in - but the Hitler salute will not be outlawed.

The federal government will introduce new legislation to parliament next week banning the Hakenkreuz or swastika symbol, along with the insignia of the Schutzstaffel (SS) - the paramilitary wing of the Nazi party.

The Australia-wide ban will outlaw the display of these symbols on flags, armbands, clothing, and will extend to posting the insignia online.

The federal government cannot prohibit Nazi salutes, as that falls under the jurisdiction of states and territories.

Selling Nazi memorabilia will be made an offence, and will be banned in retail and online stores.

The proposed law will not prevent private ownership, including items taken as war souvenirs, or artefacts displayed in museums.

But anyone seeking to pass on items will not be allowed to accept payment in return.

Attorney-General Mark Dreyfus, whose Jewish father George fled Nazi Germany, said the new laws will send a strong message about the 'evil symbols'.

'There is no place in Australia for symbols that glorify the horrors of the Holocaust,' he said.


'The Albanese government is sending the clearest possible signal to those who seek to spread hatred, violence and anti-Semitism that we find these actions repugnant and they will not be tolerated.'

Executive Council of Australian Jewry chief executive Peter Wertheim welcomed the move, but was concerned that fascist groups will get around the legislation by using other symbols associated with the Nazi regime such as the death's head and sun wheel.

'We have urged the government to review the legislation periodically so that if our concerns are borne out, the prohibitions may in due course be extended to the display of other Nazi symbols,' he said.


Mr Wertheim said the council was also worried about the lack of any prohibitions on the performance of Nazi gestures such as the salute.

'This will leave a gap that will need to be filled by state and territory legislation,' he said.

Displaying symbols for religious, educational, or artistic purposes are among a range of exclusions from the ban.

It will not affect the use of the swastika for people observing Hinduism, Buddhism and Jainism - the original symbol from which the Nazi flag was derived.

Mr Dreyfus said the government had been responsible in taking the time to get the bill right, describing it as 'well-targeted and effective'.

Labor MP Josh Burns, who is Jewish, said recent demonstrations of the Nazi salute outside Victorian parliament showed the need to act on the laws.

'To see the displays in our city and outside our parliament of these neo-Nazi thugs, parading with a sort of renewed brazen confidence, was really confronting,' he told Sky News.

'What has happened since is the governments around the country have really been galvanised into finding the laws and ensuring that this sort of brazen display of neo-Nazism can't happen in Australia.'

Australia/Israel & Jewish Affairs Council (AIJAC) director of community & international affairs Jeremy Jones described the new laws as "welcome steps in line with the recommendations of AIJAC and other Jewish community groups".

The Zionist Federation of Australia (ZFA) welcomed the Government's decision to introduce legislation to ban the Nazi symbol. ZFA President Jeremy Leibler said, "The Hakenkreuz is a universal symbol of murder and hatred, and it's used by extremist organisations to intimidate minorities and recruit members. Violent right-wing extremism is rising in Australia. Banning the symbol sends the message that Australia rejects this hatred, and will help prevent the growth of extremist organisations and future violence."

Anti-Defamation Commission chair Dvir Abramovich called it "a resounding triumph for justice".

Melbourne Holocaust Museum CEO Jayne Josem welcomed "the clear message the banning of Nazi symbols is setting. Survivors and their descendants take heart that our federal government appreciates the messaging of hate that those symbols deliver".

Sydney Jewish Museum CEO Kevin Sumption saw it as "an important step forward in ensuring the safety of all Australians".
