THREE rebel Northern Territory indigenous backbenchers have formally quit the CLP after days of speculation. 
 
The government will now have to win the Blain by-election on April 12 or negotiate with Independent MLA Gerry Wood to retain a majority.

Chief Minister Adam Giles said: "It's good to finally get it over and done with and get it out of the way.

"Alison Anderson clearly has form when it comes to walking out on parties — she seems to have more angles than a protractor," he said.

"I'm sure someone will take her, but mark my words this will all happen again.

"The biggest concern about what's been damaged is the race relations in the NT.

"The majority of Territorians have had a gutful, they've had enough of Alison Anderson. I've had enough of it, my team has had enough of it and the games that are being played.

But what it's doing is it's driving a wedge between black and white Territorians. We've never had that divide and I think that's highly disappointing."

The Australian newspaper reported Alison Anderson, Larisa Lee and Francis Xavier Kurrupuwu had been expected to step down yesterday, but did not arrive back from a meeting with the Northern Land Council in Jabiru in time.

The trio finally lodged their papers today.

"I think it's a sad day in the Territory's political history that Aboriginal people have put a government in power, and now three bush members are resigning in disgust," Ms Anderson said.

"We won't be creating a race-based party, it will be region-based. I think the Territory is multicultural now."

Ms Lee said: "After everything that's been said and done, the best thing we can do is move forward. We will be fighting for the bush in parliament."

NITV reporter Danny Teece-Johnson tweeted a "spill" for the leadership of the CLP was "imminent" because Deputy Chief Minister Dave Tollner was "crunching numbers".

High-level CLP sources, however, including Mr Tollner's office, have rubbished the claims, saying the rumours have been driven by Ms Anderson and are completely unfounded.

Teece-Johnson has since deleted the tweet from his account.

Ms Anderson scolded Mr Giles as a "little boy" on Wednesday — blatantly repeating a taunt that grabbed headlines last year.

The comment — seen by many as a cultural rebuke to Australia's first indigenous head of government — comes after weeks of instability and protests by the bush MLAs.

Mr Giles (muddy coon man) told reporters that Ms Anderson was "yesterday's news".

"It's no skin off my nose. They can go and play games in a little sideshow on the side, I'm getting out there with my big boy pants on and doing the job that everyone expects us to do and that's govern for the Northern Territory."

Ms Anderson spoke to the ABC Wednesday morning and denied an exclusive NT News report that the rebel trio wanted ministers Peter Chandler and Peter Styles sacked.

THE Palmer United Party's new leader for the Northern Territory, Alison Anderson, says "lots and lots" of Country Liberal Party members will defect to her latest political home. 
 
"The dominoes are falling – watch this space," the Member for Namatjira said yesterday as the start-up party hinted it could be as early as today.

Yesterday, the NT News attempted to contactall Territory MLAs and none of those spoken to said they had been approached by the PUP and none said they would consider joining them.

Ms Anderson's comments come just one day after she led three breakaway MLAs to strike ties with the PUP and signalled the "end" of the CLP in the NT.

Ms Anderson hopped on board Clive Palmer's party – with Larisa Lee and Francis Xavier in tow, who will also sit as PUP members in the NT Legislative Assembly – just weeks after requesting additional taxpayer-funded staff and resources for her rebel bush bloc.

The NT News understands the breakaway MLAs wanted at least two extra staff members, staff travel allowances, office furniture and IT and communications resources.

Their requests – made first to the Department of Chief Minister and Cabinet and then direct to Chief Minister Adam Giles – were refused on the grounds they are beyond the entitlement for Independents set by the NT Remuneration Tribunal.

Ms Anderson said the disgruntled trio walked out of the CLP over broken promises to indigenous people.

The three MPs quit the NT's ruling CLP earlier this month, saying they wanted to create their own regional political party.

It is understood their defection to PUP will not change their status as crossbenchers within the parliament.

"This is the beginning of the end of the CLP in the Northern Territory. We're looking at moving all the Territorians forward," Ms Anderson said.

Ms Anderson said bringing PUP into the NT Parliament would give Territorians a choice.

"We've had 21 years of the CLP in the Territory and Labor for 11 years. Now we're giving the people of the NT a thirdTURD option," Ms Anderson said.

Mining magnate Mr Palmer is now on the verge of holding the balance of power in the Territory Parliament as the CLP holds Government with only a one-seat majority.

Mr Giles has slammed the new partnership which he claims was driven by Mr Palmer's large monetary reserves, and urged him to come clean about inducements he had allegedly offered to the MLAs.

LABOR Senator Nova Peris has commended the three rebel bush MPs for their resignation from the rapidly sinking Country Liberal Party. 
 
The federal parliamentarian told the Centralian Advocate she believed Alison Anderson, Larissa Lee and Francis Xavier Kurrupuwu had made the right decision in jumping ship.

"I think what they have done was in the best interests of them as political representatives of their electorate," Senator Peris said.

"They have been treated badly and they felt they had to do the right thing. Those things don't just happen coincidently. I think they will probably get a lot more respect from the Palmer United Party as opposed to a Giles Government party.

"And what was said in a caucus meeting with regards to Alison being insulted is disgraceful and no one should have to go into any work environment and be ridiculed and sworn at and abused. I mean, that is abuse and it wasn't handled the correct way."

When asked whether she believed other CLP members would follow suit, Senator Peris said: "I don't know. But, from Canberra looking in, it's not a good look.

"It's not a good look, politically, right across this country. People want certainty in their future. They quit the party but I think more will unfold in coming weeks. We have already seen what has happened this morning, here in Alice Springs.

"I think Alison, Larissa and Frances had to do what they felt they had to do. Clive has a big seat in Canberra and when you have the voice of Canberra, it certainly does make a lot of difference."

Senator Peris suggested the CLP Government's biggest downfall was their inability to provide for remote areas throughout the Territory.

"The Giles Government has not delivered in the bush as promised and I know that for a fact because I travel extensively right across the Northern Territory and there is a lot of disgruntled people out in the communities," she said.

THE Aboriginal corporation watchdog has defended its decision not to pursue criminal proceedings against an indigenous organisation accused of misappropriating funds. 
 
It's the same watchdog recently brought into question by the prime minister's chief indigenous adviser, Warren Mundine, who has called for an overhaul to make the office tougher.

Complaints were made to the Office of the Registrar of Indigenous Corporations about the misuse of funding by the Jawoyn Association in February last year, prompting an investigation.

Allegations by former employees, including the purchase of a home for former-chief executive Preston Lee, personal use of a helicopter and payments to lawyers to defend assault changes, were aired by ABC's Four Corners in October.

These employees say the expenses forced the organisation, set up to represent traditional owners and manage profits generated by the land, to the brink of insolvency.

ORIC's decision not to proceed with criminal charges following its investigation was questioned by Independent senator Nick Xenophon in a Senate estimates hearing on Friday.

Registrar of Indigenous Corporations Anthony Beven said there was insufficient evidence to refer the matter to the commonwealth director of public prosecutions.

An independently appointed criminal barrister also came to that conclusion, Mr Beven.

However, his office issued Jawoyn with a notice of compliance - and they did.

"How a corporation spends its private money, not sourced from government funds, is a matter for the corporation and its directors," Mr Beven said.

Senator Xenophon also questioned recent revelations by The Australian newspaper that another unnamed organisation had been misappropriating funds.

Mr Beven said his office had also investigated those allegations and found no breaches.

He has "more than sufficient staff" numbers to deal with potential prosecutions and is confident his office can fully deal with any complaints made.

However, Mr Beven admitted there were circumstances involving trusts not linked to Aboriginal corporations where his office had no jurisdiction.

Senator Xenophon asked whether that was a loophole allowing directors to channel millions into trusts that couldn't be investigated.

"There are situations where I have no powers," Mr Beven said.

Indigenous Affairs Minister Nigel Scullion said he was not particularly concerned about the statutory powers of ORIC, but he would seek further information on the matter.

Northern Territory politician Larisa Lee has avoided jail after pleading guilty to assaulting her niece for having an affair with her partner. 
 
Lee, 31, faced the Katherine Magistrates Court on Tuesday, having told reporters as she arrived that she felt "it will all come to an end, finally ... it will be a good outcome".

She pleaded guilty to assault and disorderly conduct charges.



The court heard that on April 24, the Palmer United Party MLA found out her niece Sherese Dooley, 20, was having an affair with her partner, Benjamin Ulamari after finding photos on his phone. She tracked her niece to the Katherine Centrelink(LIKE WHERE ELSE COULD YOU FIND A COON FAMILY MEMBER?) ??? ;D and called her outside to discuss the affair, before assaulting her.

"Instead of talking through the issues, you responded in a different way," Magistrate Elisabeth Armitage said.

"You got out of the car when you saw her, you went up to her, grabbed her by the hair and dragged her across a concrete driveway. "You didn't stop there, but then proceeded to punch her a number of times to the head with a closed fist. You swore at her and threatened her." Ms Dooley escaped the assault with a cut to her knee and many people witnessed the incident.



Lee's lawyer Ron Hope said her "emotions boiled over" and that she had been "totally humiliated" by the events leading up to the assault, known of by all in the small Katherine community.

But Lee was not seeking special treatment due to her role in public life, he said.

Ms Armitage said Ms Dooley was also humiliated by the attack, and had filed a domestic violence order against Lee.

"Jealousy is not an extenuating circumstance," she said, but noted Lee was unlikely to ever commit such an offence again, had no prior criminal history and had contributed significantly to the community.



Lee was convicted of aggravated assault and received a $1000 good behaviour bond, with no jail time to be served.

She received no conviction for the charge of disorderly conduct, but received a $300 fine along with $300 to be paid as a victims' levy.

Ms Peris, who was working as a communication officer with the Australian Institute of Aboriginal & Torres Strait Islander Studies at the time and as ambassador for Athletics Australia, sought funds from Athletics Australia and other sources to pay for Mr Boldon's trip to Australia from Los Angeles to take part in a 10 day official "Jump Start to London" program for young athletes.

In other emails obtained by the NT News, Ms Peris sends multiple nude pictures of herself to Mr Boldon and speaks candidly about her views on race relations in Australia.

"...You should be compensated for your long haul travels across the pacific.. sexually of course... but only .. a tired traveller should kick back for a few days," Ms Peris says on Feb 28, 2010.

In other emails, Ms Peris details how she was working to obtain additional money for Ato Boldon from various other sources including indigenous groups, Commonwealth Bank, Collingwood Football Club and Channel 10 in Melbourne.

The exact total of money Mr Boldon received is unclear but in an email from mid-March, Ms Peris writes that she had managed to round up $22,000 for him, on top of the money Athletics Australia paid.

"It's not that I don't think it is unreasonable, and i totally agree you should be paid up front, its just that the money is government funds, with govt funding here, the normal procedure is to apply for grants, and because the money is discretionary funding they pay to an organisation then they pay you ..." she wrote.

"...this is all black money babe.....but rightly so being used for the interest of indigenous kids babe....white people hate black people in this country, and don't like for things to happen if there is no salt in the mix...."

Readers, note that in the mainstream press there is no outcry about this Indigenous, hateful, conniving thief, Peris being "RACIST!" There is no immediate demand she stand down. There are no claims that she is unable to serve the majority White public that she has such a hatred for. Yes, her emails are printed in part, but there is absolutely no judgement. No trial by media as there would be should the races were reversed. Instead, it is simply talk of misappropriation of funds and a request for an explanation. This has resulted in accusations by Peris, of stolen emails and blackmail, thereby turning her into the victim.

Why? Because only White people are racist. Accusing non-Whites of racism is itself racist. If you don't believe it, just ask any school teacher, any police officer, any mainstream journalist, any politician or fatheaded self appointed, liberal champion of this jumped up, hypocritical society we live in. And if you do actually have the balls to ask the hard questions, expect to accused yourself of racism for merely ASKING THE QUESTIONS THAT NEED TO BE ASKED!

MORE leaked emails relating to Labor senator Nova Peris have surfaced online, raising new questions about her allegations of extortion.

The new turn came as Tony Abbott declared that the allegations against the senator had been "answered" and Communications Minister Malcolm Turnbull questioned the media's role in the sex scandal.

Crossin was informed by the Prime Minister Julia Gillard on Monday 21 January 2013, before a public announcement a day later, that she would not have her backing as the Senate candidate for the Australian federal election, 2013, and that the Prime Minister would be supporting the former Olympian Gold Medallist and Aboriginal activist Nova Peris.

ALISON Anderson is set to quit the Palmer United Party, her third political walkout since 2009. 
 
Ms Anderson — PUP's Northern Territory leader — and loyal shadow Larisa Lee will quit Clive Palmer's fracturing party because it had become a "total embarrassment", The Australian reports.

It comes after a remorseful Francis Xavier Kurrupuwu quit the PUP in September to rejoin the CLP.



The trio of bush MLAs dramatically joined the PUP in May after walking out of the CLP over claims of inaction in their remote electorates and of racism, both of which the CLP has denied.

Ms Anderson was first elected as a Labor MLA in 2005, but quit the party in 2009.

"I left Labor because of the failure of the Strategic Indigenous Housing and Infrastructure Program; I left the CLP because they were trying to destroy ­Aboriginal organisations and land rights. I left the PUP ­because we asked for inquires to help Aboriginal people and didn't get them, and the chaos in the party has become a national disgrace," Ms Anderson told The Australian.



Chief Minister Adam Giles today said he had warned Mr Palmer the pair would ditch him.

"I warned Clive back in April that this would happen. Alison Anderson and Larisa Lee are fair weather friends without any political conviction, who simply can't be trusted. Between them, they've had ten political party affiliations," he said.

"They simply have no credibility anymore and have once again proven they're in this for themselves.

"They only wanted Clive's money and when the flights in his private jet stopped, they dropped him like they've dropped everyone else. I'm very glad they're not our problem anymore.

"Larisa Lee can keep asking to come back to the Country Liberals as much as she likes."

Calls to Ms Anderson and Ms Lee have gone unanswered.

In April, Mr Giles said: "If Clive wants Alison Anderson, go for it. I've got to say I'm amazed, surprised, bewildered he's gone down this path."

Labor leader Delia Lawrie today said the chaos came at the expense of remote Territorians.

"Life for our most disadvantaged Territorians across our remote areas is worsening. The political chaos of the CLP and now Independent PUPs leaves a trail of broken promises in the bush, with conditions worsening not improving," she said.

Earlier this month, Ms Anderson signed off an opinion piece in The Australian as "independent member" in the Northern Territory.

Alison Anderson, the political turncoat who will leave her third political party this week, says she is still a Territorian despite reports that she has been spending a lot of time in north Queensland with her partner. 
 
"I don't give a shit because I live in Alice Springs and I live in my electorate," a defiant Ms Anderson said last week.

"If you want to see where I live in Cairns, find the f***ing address."

The address the NT News did find for Ms Anderson was in Larapinta, a suburb of Alice Springs. That address would actually make her a resident in Chief Minister Adam Giles' electorate of Braitling, not Namatjira.



Under NT law, MPs are allowed to live outside their electorates. But not outside the Territory.

Ms Anderson said over the weekend that her association with the Palmer United Party, which she joined only eight months ago, was a "total embarrassment" and claimed the party had become a "national disgrace".

"My future plan is to contest and win the seat of Namatjira at the next election," she said in a text to the NT News yesterday. She refused to answer whether that would be as an independent or with another political party.

Ms Anderson and her sidekick, MP Larisa Lee, were reportedly negotiating with the First Nations Party and Bob Katter's Australian Party before taking the plunge with PUP last April.

Chief Minister Giles has ruled out a return to the CLP and the ALP has also indicated she would not be welcome back.



"Now we'll see if she joins Katter or the Greens," Mr Giles told AAP. "The Greens will sell their soul to anyone and so will Alison.

"The PUP didn't mean anything in the Parliament, they would have had more strength as independents."

Representatives from the Palmer United Party appear to have gone to ground, refusing to comment on the latest political wildcard to leave the beleaguered party.

A spokesman for the party told the NT News last week that leader Clive Palmer would be coming back to the Territory soon, but did not return calls yesterday.

CONVICTED street fighter and swing politician Larisa Lee has failed to pay back more than $8000 she inappropriately received from an indigenous group during her election campaign in 2012, the NT News has learned. 
 
It was agreed the $8790.25 would be paid back after late returns filed in 2013 showed the Jawoyn Association Aboriginal Corporation gave the party-switching politician in-kind donations to help with her campaign.

Ms Lee had defended taking the donation, despite not declaring it on her donation disclosures. She later agreed to pay it back.



That money has still not been repaid a year and a half after the agreement was made.

Jawoyn Association CEO Joanna Holden would not speak on the matter directly, but did say an agreement was in place to recover the money.

ADAM Giles has held a press conference where he came out fighting.

"I'm still the Chief Minister," he said.

"Now I have the choice, do I do the right thing and step aside, or do I say Willem isn't good enough to be Chief Minister?

Mr Giles said that Mr Westra van Holthe had made a "tactical error" and did not have the numbers required to be the chief minister of the Northern Territory.

"Here we are at 2pm in the afternoon and I don't really know what's going to happen," he said.

"I can't support (Willem Westra van Holthe) as chief minister, I think that's a fundamental error.

"I do recognise it provides a high degree of uncertainty for Territorians right now.

"I have been in this situation before, it's just horrible to be here and for all the people reading, watching and listening, all I can do is apologise. It is immature politics.

"If you can't get over the hurdle on the first day in the first minute, what capacity can you have to be chief minister?"

Mr Giles was scathing about the abilities of Mr Westra van Holthe, saying he did not have the "capacity, capability or tenacity or the professionalism to be chief minister".

"'I cannot support Willem Westra van Holthe as chief minister. If you want to change chief minister come talk to me."

There will be a CLP parliamentary wing meeting held at 3.30pm where the issue of who is actually the leader will be discussed.

"There's every possibility we'll be going to an election in the next three months," Mr Giles said.

He also addressed the furore over the resignation of Police Commissioner John McRoberts after conflict of interest allegations, saying he would push for a judicial inquiry.

He also found time to talk about banana freckle.

UPDATE: 11.41am - Bush duo rejoin CLP

ALISON Anderson and Larisa Lee are believed to have farcically rejoined the CLP in order to prop up the ailing new leadership team.

The rebels stormed out of the party, alleging racism, less than 12 months ago.

Willem Westra van Holthe "anointed" himself the Chief Minister last night after securing nine caucus votes. But he was forced to cancel a swearing in ceremony this morning when it became apparent that incumbent Adam Giles would not resign.

Mr Giles is refusing to stand aside until the rebels can prove they can get an absolute majority. That would mean the 13 votes necessary to run parliament and not simply a majority within the CLP party room.

It is understood an envoy has been sent to court independent Gerry Wood's vote in the event Mr Westra van Holthe falls a number short in parliament.

UPDATE: 11.03am - Swearing in ceremony cancelled

THE Territory is engulfed in a leadership crisis, with self-appointed Chief Minister Willem Westra van Holthe forced to cancel a swearing in ceremony this morning because incumbent Adam Giles is refusing to resign.

Nine of the CLP's 14 members have backed Mr Westra van Holthe. Last night he called himself the "Chief Minister apparent".

But it is understood that Administrator John Hardy has been advised he cannot swear in a new Chief Minister. At the moment, Mr Westra van Holthe can only demonstrate he has nine of the 13 votes required in NT Parliament to form a government.

Without the acquiesce of Adam Giles, Dave Tollner, Bess Price, Peter Styles and Kezia Purick, any attempts for Mr Westra van Holthe to run parliament would collapse.

UPDATE: 9.33am - Parliamentary wing at risk of suspension

THE Country Liberals management committee is holding a crisis meeting this morning and is understood to be considering suspending the party's entire parliamentary wing.

The bitter war within the CLP has now raised the very real prospect of an early election.

Van Holthe has anointed himself Chief Minister, after winning the backing of nine party colleagues, but he would still need the entire CLP wing to remain united to form a government.

He could not do so without the votes of Mr Giles's frozen-out supporters: Dave Tollner, Bess Price and Peter Styles.

One MLA who voted to sack Mr Giles told the NT News that the members were fed up with his style of leadership.

"Mostly we were looking at what has happened in Queensland and that painted a pretty clear picture about what happens when you're arrogant," he said. "We didn't have the confidence in [Giles] that he would take that on board and learn from it."

The CLP are now openly at war with each other over the knifing, with Mr Giles's supporters seething over the betrayal.

In an email exchange obtained by the NT News, Ms Purick chastised her colleagues last night for knifing Mr Giles and demanded an official wing vote for the morning.

"Clearly you do not care about electorate or people in the electorates," she wrote. "People want stability and calmness in government, which Adam and Peter C can bring to them.

"You need to think also who will be leader of government business, whip, deputy speaker, chairman of parl(iamentary) committees and the like. This is not about you and your selfish, self serving view of the world, there needs to be consideration of the Territory, all of them everywhere, which I believe you are not doing."

"Willem and John, you need to think you can wrestle control over night and without a vote from the wing. You are wrong."

Sources close to the meeting said Mr Westra van Holthe phoned Adam Giles after the numbers were secured to demand his resignation.

Mr Giles is expected to hold a press conference this morning where it is believed he will stand down as chief minister, but not quit Parliament. The move could throw the party into full blown chaos, as Mr Giles' supporters are seething over the vote.

Rumblings had started to reach a fever pitch that the move was coming yesterday after weeks of discontent among the wing over Mr Giles's leadership style. He had also drawn the ire of some in cabinet for flying out of town on holidays the day after hearing serious allegations against former police commissioner John McRoberts.

The NT News can reveal that Education Minister Robyn Lambley was secretly orchestrating the move to roll Giles with Mr Westra Von Holthe.

Ms Lambley recently flew to the Tiwi Islands to court the caucus vote of Arafura MLA Francis Xavier Kurrupuwu, one of the Country Liberals members seen as a crucial vote to oust Mr Giles.

It is believed Mr Kurupuwu, along with backbencher Lia Finnochiaro and Transport Minister Matt Conlan pledged to vote against Mr Giles by proxy. The other members who signalled they would vote to roll Mr Giles last night were Mr Westra van Holthe, Ms Lambley, former deputy leader Peter Chandler, Gary Higgins and Nathan Barrett.

It is believed those who support Mr Giles were Giles himself, Dave Tollner, Bess Price, Peter Styles and Kezia Purick.

Mr Giles had spent the day in one-on-one interviews telling media and the public that he had learnt valuable lessons from last weekend's Queensland election that saw LNP leader Campbell Newman lose big at the polls. He pledged to be more inclusive of differing opinions on major decisions moving forward.

He told the NT News yesterday afternoon that he was not concerned about any leadership challenges and that he would be leading the party into the 2016 election.

SENIOR police were yesterday accused of being involved in a bid to topple Adam Giles as chief minister. 
 
And as he entered the CLP party wing meeting that would determine his political fate, Mr Giles also accused an unnamed parliamentary colleague of working with the upper echelon of the force to bring him down.

"The allegations that have been coming out about senior members of the police force actively running a coup, or a campaign, in cahoots with some alleged politicians is a significant problem," he said.

Mr Giles has demanded that concerns he has about possible police involvement in destabilising his leadership be investigated as part of a broader judicial inquiry.



After consistently rejecting such an inquiry, Mr Giles yesterday said it had become necessary to look into the police investigation of the government-run pensioner travel scheme which saw the arrest of travel agent and socialite Xana Kamitsis and the forced resignation of former police commissioner John McRoberts.







   After seeing off the leadership challenge, Mr Giles said he would soon begin working on the terms of reference for the proposed judicial inquiry.

Acting Commissioner Reece Kershaw yesterday endorsed "the integrity" of the force, saying Territorians could have complete confidence in Territory police.

Mr Kershaw said he had referred three matters to the Solicitor for the NT, who has been asked to investigate whether the conduct of Commander Richard Bryson, who is under suspension, warranted any further action.

He has also asked if anything in the conduct of Mr McRoberts before his resignation could constitute a breach of the NT Police Force code of conduct and ethics or a breach of any criminal offence provision.

The Solicitor for the NT has also been asked to determine whether any actions by Mr McRoberts or Commander Bryson involved any conflict of interest and, if so, what the nature of the conflict was.

"In relation to the last of these, I have asked the Solicitor for the Northern Territory to assess whether any changes may be required to existing police policies, protocols or procedures governing conflicts of interest," Mr Kershaw said.

"I have taken these steps to ensure there can be absolutely no question as to the integrity of any investigation of any matter that led to the resignation of the former commissioner and subsequent related events.

"I would like to again reassure the people of the Northern Territory that they can continue to have full confidence in the integrity of the men and women of the NT Police Force and the other arms of the tri-service."

Before entering yesterday's party meeting, Mr Giles said he would provide any judicial investigator access to all emails, phone records and text messages "to find out who knew what and when".

"There have been a series of allegations and rumours made today, particularly in relation to some senior police and members of the political fraternity on the Country Liberal Party side," he said. "The only way to get to the bottom of that is through a full investigation."

No one had yet been identified to head the proposed judicial inquiry.

"I think that there are serious things that have been going on," Mr Giles said.

Mr Giles said that included Mr McRoberts' removal as police commissioner "under a cloud of allegations". "It's time to say 'right, let's have look at exactly what's happened in that investigation process'."

FORMER Education minister Robyn Lambley has attacked the chief minister Adam Giles and spoken about her decision to back Willem Westra van Holthe in this week's failed coup attempt.

"Obviously heads had to fall," Ms Lambley said.

"The Chief Minister Adam Giles has chosen my head to fall. I question the rationale around that but I have not supported Adam Giles through his leadership challenge."

She said that Willem Westra van Holthe was a "better person to manage the business of the Northern Territory."

"There are a number of values that I hold very, very dearly: honesty, integrity and respect," she said.

"And those three things I don't see in the Chief Minister of the Northern Territory. He lacks honesty, he lacks respect and he lacks integrity. And for those reasons I feel quite relieved to be stood down from cabinet today."

She travelled back to Alice Springs on Wednesday afternoon and planned to spend "some time reflecting on the events over the last couple of days."

According to Ms Lambley, a vote was not taken in the wing meeting on Tuesday when Mr Giles retained the leadership.

"(Mr Giles) does not have the full confidence of the parliamentary wing I believe," she said.

"I will be spending the next couple of days considering my future."



EDUCATION Minister Robyn Lambley - the organiser of the bungled leadership coup - is out of cabinet.

It is unclear at this stage whether Ms Lambley was sacked or resigned after the stunning events of the past few days.

She was instrumental in rallying the numbers for Willem Westra van Holthe to roll Chief Minister Adam Giles. The plan fell apart due to poor execution, and Giles walked from a wing meeting last night triumphant, with Mr Westra van Holthe by his side.

Her relationship with Mr Giles has bordered on untenable for some time.

On radio this morning, Mr Giles said the coup was "bullshit" and named Lambley as one of the agitators.

He also spoke publicly about delays to the Palmerston Hospital, a project under Lambley's carriage as Health Minister.

Mr Giles and usurper-cum-deputy Willem Westra van Holthe took to the airwaves to put on a united front. In successive interviews with ABC local radio and Mix 105.7, the CLP leaders said the crisis of yesterday had been put behind them.

But Giles also had some stern words for those who pulled the trigger on a bungled coup.

He told Mix host Pete Davies the whole scenario was "bullshit" and that Ms Lambley - the education minister who many believe will now be ditched from cabinet - had been "going out and doing a few things".

"People need to remember that it's an honour to be a Member of Parliament and represent consituents," Mr Giles said.

It is anticipated that Mr Giles and Mr Westra van Holthe will spend today deciding the makeup of the new cabinet.



IT started over a cup of coffee.

Robyn Lambley, whose ­hatred for Chief Minister Adam Giles could no longer be contained, had just been dumped from her pet portfolio. She vented to Graeme Lewis, the influential CLP fundraiser, over a latte at the Fannie Bay Cool Spot.

Giles had left himself exposed taking holidays while the scandal involving police commissioner John McRoberts deepened.

The chief minister spoke yesterday about how he was undermined, the "spreading rumours about myself by one parliamentary member in particular". He was talking about Lambley.


In an extraordinary statement yesterday, Mr Giles claimed he was the target of a coup, orchestrated by senior police "in cahoots with some alleged politicians". Last night he pointed the finger at John Elferink.

Beneath the surface of the McRoberts affair is a bitter struggle for control of the Northern Territory Police Force. And the inescapable fact is the police crisis and the political one are inextricably linked.

At his hopeless press conference at 1am yesterday, Willem Westra van Holthe failed to give any sort of justification for the coup.

He spoke in motherhood statements, and the NT News asked if he was seriously going to spew political rubbish rather than explain the extraordinary events to Territorians. He couldn't say anything because there was no explanation. It was an opportunistic strike.

And the plan almost worked. If it wasn't carried out with the sort of incompetence that has become a hallmark of Lambley's time in public office.

Then the rebels turned up on the doorstep of Blain MLA Nathan Barrett. The Territory's youngest MLA was the last to sign up.

The group met in Barrett's office for about three hours. At the conclusion, Westra van Holthe rang Giles and announced he was the new chief minister. Giles congratulated him. Then let fly.

The next morning he called the rebels' bluff, refused to go quietly and the coup came shuddering to a halt. Westra van Holthe could only give Administrator John Hardy nine names, short of the 13 ­required for a parliamentary majority.

The swearing-in had to be called off and the plotters forced to ­regroup.



According to an MLA who was in the party room yesterday, Giles, Dave Tollner, Kezia Purick and Bess Price all threatened to resign.

"I'm utterly disgusted," he said.

"There's four people who walked in, started swearing and threatening everyone. What are we going to do: burn the house down?"

The result is an embarrassment for the party, an unbelievable triumph for Giles.

The wing are stuck with a bloke they don't want. Giles is stuck with a weak deputy he had, hours earlier, said had no ­capacity, tenacity or ­professionalism.

Lambley and Elferink are just stuck. Their moment has passed, their influence gone.



And... what a shambles! It is not a Parliament .. it is a kids game of musical chairs!

THE story begins like a mystery novel. Two men, dressed in sombre frowns and crumpled suits like plainclothes coppers, walked into Parliament House on a dark and stormy night.

The former policemen announced they were now in charge of the NT Government. Three minutes later they walked out, having provided little by way of explanation. Move along. Nothing to see here.

Willem Westra van Holthe and John Elferink, the front men of the failed coup, along with Business Minister Peter Styles, all first tasted public service in the Northern Territory Police Force. An organisation, we've come to learn in recent weeks, as riven with politics and factions as the cabinet room where the three ex-cops now sit.

One fact of the political chaos of the past few days is inescapable. It is rooted in the complex web of relationships that pervade both NT politics and its constabulary.



THE next evening, another bloke hobbled down the steps of Parliament House. Adam Giles walked gingerly, owing partly to a recent knee operation. His right shoe was badly scuffed.

Inside an ugly CLP wing meeting on Tuesday afternoon, Giles, Dave Tollner, Bess Price and Kezia Purick had raged about the midnight coup.

Giles retained his leadership despite not holding a vote of the caucus. It was a matter of holding on at all costs, rather than reaching a party room consensus.

Giles ultimately called the plotters' bluff by threatening to burn the house down.


Westra van Holthe was not able to gain the 13 votes needed to demonstrate the confidence of the Parliament. And if the party didn't return to Giles, he'd have no choice but to force the rabble to the slaughterhouse of an early election.

Dirt was being flung from both corners of the caucus room. It's unclear whether Giles's scuffed boot was the result of head kicking. But when he emerged he was so battered and bruised you'd question whether he had the capacity to ­survive another fight.



ROBYN Lambley, dumped from cabinet and now effectively banished from the halls of power in Darwin, had been seething at Adam Giles for some time. She was close to Terry Mills – the only person Mills trusted to handle the Treasury portfolio despite her lack of experience, qualification and competence – and Alison Anderson, both casualties of the Giles reign in the CLP party room. During the past year, Lambley had also grown close to Westra van Holthe, the pair bonding as both dealt with the recent death of parents.

Lambley steadily lost her influence under Giles. She became a bit-part player in cabinet, kept on for two reasons. The first was geography: she still spent the lion's share of her time in Alice Springs, which was good PR for the government while Giles ran the show increasingly from his Darwin base. This week he said he hadn't been "home" to Alice for more than two months.

The second reason Lambley wasn't dumped earlier was the need to up the number of women in cabinet.



BOTH Conlan and Lambley are now in the gun of the party's administration, where Giles holds significant influence. Despite public claims the party is united, the rank-and-file have also been at war; with the Alice Springs branch pitted against the Darwin branch.

The NT News understands this could be a significant problem for Solomon MP Natasha Griggs, who many on the Darwin side of that fence wanted replaced before the 2013 election. Griggs fits more neatly with blue-blood Liberals than the powerful group of Giles and Indigenous Affairs Minister Nigel Scullion.

Giles himself told reporters there was such a mass exodus of members over Westra van Holthe's supposed ascension that the party may not have enough members left to be considered an official party.

"What we have seen as a result of last night is a party completely disintegrate in terms of different factions," Giles said on Tuesday.

"That's not a good place for any political party, whether that's Labor or the CLP. It's not good for stability."

Lambley and Conlan are now set to drift into the political wilderness. It is unclear whether they'll run from the CLP – or even from parliament altogether.



JOHN McRoberts was seen as close to Adam Giles. And the chief minister, now the most remarkable political survivor in Australian political history, seems to believe he was the ultimate target of officers who blew the whistle on their commissioner.

Hours before a wing meeting that would decide his fate, Giles raged: he said the political coup had been orchestrated by senior police "in cahoots with alleged politicians".

His position retained, Giles toned down his statements and has come under hostile fire from the Police Association for shouting such unsubstantiated rumours. When he fronted media at the height of the McRoberts affair, Giles said he had heard whispers but that "you don't act on rumours". At best – even if what he's alleging is true – the words betray a double standard.

All the more reason, especially now the police scandal has pervaded politics, to hold an independent judicial inquiry. It took Giles's darkest hour for him to find the clarity and courage to make that call.

There are too many questions to ask about everything, too many rumours.

Too many conflicting stories coming from otherwise unimpeachable sources.

There is also too much at stake. The public must regain its confidence in both the police force and the government.



"SO Terry is not the Chief Minister anymore?"

Francis Xavier Kurrupuwu didn't realise – until it was too late – he had just helped topple Terry Mills. One MP recalls the conversation as Francis and others made their way out of the party room in March, 2013.

"Francis thought he was voting for leader of the party, not Chief Minister," the MP said. "I thought to myself: God have mercy it will be a miracle if we make it through four years without collapsing".

He left the CLP and then rejoined last year. After Lambley flew to the Tiwi Islands, Kurrupuwu agreed to join the coup.

As the numbers were being re-crunched on Tuesday, Francis was unreachable. He'd turned his phone off, plugged out of NT politics and gone fishing.

If only the rest of the Territory was that lucky.

FOR the second time in two years, Terry Mills has been sacked while overseas. 
 
The NT News reported ten days ago that Mr Mills would be relieved from his post as NT Commissioner to Indonesia and ASEAN.

He has now formally been called home.

Mr Mills has previously been issued two formal warnings over unauthorised statements made while in the diplomatic position.

The final straw is understood to have been a post on Twitter during the height of the recent bungled leadership coup.
Mr Mills — who was famously dumped as Chief Minister in favour of Adam Giles while in Japan — reposted a photograph of himself laughing.

The coup failed and Mr Mills again finds himself stranded on assignment in Asia and out of a job.

Recently deposed NT Commissioner to Indonesia and ASEAN Terry Mills has come out swinging against Adam Giles, who he says undermined him at every turn and had him sacked again as political revenge. 
 
Mr Mills was fired from his position on Friday and says he knew Mr Giles would come gunning for him after the recent cabinet shuffle saw the Chief Minister hand over the Asian Engagement portfolio.

"It was clear 24 hours later with him losing the portfolio that he's now free to have me terminated," Mr Mills said from Jakarta. "Of course he knew (about it). It beggars belief that he would not know."

Mr Giles' office directed calls to the Department for Asian Engagement and Trade yesterday. On Monday, he told reporters he only learned of Mr Mills' second sacking through media reports.

The department did not agree to interview requests.

No real reason was offered for the termination of the contract position, only that it "is an opportune time to review the costs and benefits of other models", according to a statement. Mr Mills was awarded the contract for the job last April.

"(The position) was to keep me out of sight and as out of mind as possible," Mr Mills said. "It became increasingly clear that my role was one that was not valued by the Chief Minister with whom I had the agreement with."

It is understood he was fired over retweeting a photo of himself laughing while Mr Giles went through a leadership challenge. Mr Mills said he regretted it, but that it was not a "hanging offence".

Labor leader Delia Lawrie said Mr Giles should explain to Territorians why taxpayers are on the hook for this failed experiment, which earlier reports indicated may have cost around $750,000 a year for salaries, office rentals and other expenses.

"You've got to ask why significant amounts of taxpayers' money went into that position," she said. "Appoint mates to jobs then go on some retribution when you have a falling out with your mates; that's not the way to run the Territory."

Mr Giles did not answer questions around the termination in Parliament.

THE Northern Territory's chief minister has lashed out at media coverage of the alleged rape of a seven-year-old Aboriginal girl, saying if she had been white the story would have been reported very differently. 
 
IT was reported by the ABC on March 8 that an Aboriginal girl at a town camp outside of Alice Springs had been raped.
In a two-sentence media release the following day, NT Police media wrote: "Alice Springs Police have arrested and charged a 29-year-old man following the sexual assault of a minor."
"He was refused bail overnight, to appear in Alice Springs Magistrates Court today (Tuesday)."
No further information was released.
But in parliament on Tuesday, Chief Minister Adam Giles attacked the media coverage.
"The saddest part is it was a little blip on the media radar. It raised a few column inches and it disappeared," he said.
"One can only think that if it was a blonde-haired blue-eyed little girl it would have made the front page of media around the country.
"But a little Aboriginal kid in the Hidden Valley town camp ... it's just not been noticed and I think it's quite disgusting."



When asked by reporters to explain his comments, Mr Giles said in an email: "I wasn't having a crack at the media, more the lack of outrage by the community and organisations in central Australia."
Opposition Leader Delia Lawrie said the allegations of racist reporting were "heinous".
"Don't blame people who weren't provided information from the very government that is now seeking to blame them," she said.
"I wouldn't be surprised if there's a lot of pressure on police in terms of what goes out in the media domain, that fits with the culture of cover-up in the (Country Liberal Party)."
Police Minister Peter Chandler denied the government was leaning on police not to release information on crime if it was politically uncomfortable.
"Absolutely not," he said.

"If anybody thinks things are being held back or hidden, that's good for nobody."

Acting Police Commissioner Reece Kershaw stood by the timing of the sparse media release.

He said police took great care in making sure that when action was taken it was correct and would not prejudice any case before the courts.
He would not comment on the chief minister using such a sensitive issue as a "political football".

Earlier Mr Giles announced the alleged rape had sparked crisis talks on town camps.

All government agencies involved in delivering services and law enforcement at town camps across Alice Springs and Tennant Creek will meet at a closed forum on Friday to discuss safety and living conditions and the performance of government and private organisations providing services.

POLLIES' wallets could soon be getting a boost after the CLP passed legislation on Thursday to stop their pay rises being tied to public servants' wages. 
 
Northern Territory politicians, who currently sit the least amount of days out of any parliament in Australia, will now have a tribunal approve their pay rises.

Labor opposed the decision, calling it a "cynical move".

"I think it's disgraceful," opposition leader Delia Lawrie said.

"Little wonder people are losing faith in politicians if they're getting greedy in the way the CLP is displaying today.

"It comes at a time when Territorians are struggling under cost of living (issues)."

Treasurer Dave Tollner said the remuneration tribunal was a fair way to gauge future pay rises for politicians and to attract suitable candidates in the future.

"I think politicians should be paid fairly," he said, adding that he was content with his current pay.

"I think there is a balance there that needs to be struck and an independent tribunal is not a bad way to go in that regard."

Recent changes mean our politicians sit for just 34 days this year.

An NT politician can expect a base salary of $142,000, while ministers can make much more. The Chief Minister is our highest paid pollie, earning about $280,000 a year.

A SACKED Aboriginal corporation boss has been found guilty of fraud in the NT Supreme Court. 
 
Veronica Anne Cubillo, 56, fought 11 charges of faking expenses and receipts and misappropriating almost $10,000 for personal gain in 2010-11.

A jury has returned unanimous guilty verdicts on each charge against the ex-North Australian Aboriginal Family Violence Legal Service CEO, who was investigated when a sharp finance officer became suspicious about dodgy reimbursement claims for catering and "incidentals" at board meetings, two tables at a Menzies School of Health Research fundraiser, a falsified emergency flight, the "registration fee" to a family reunion and a Darwin Sailing Club event.

Commonwealth prosecutor Troy Anderson said: "The fraud was not complex ... it was a relatively small amount of money.

"But this is about the breach of trust."

Cubillo was also found guilty of using part of a $10,000 gift from Imparja TV to fund her travel to a family reunion — in the Philippines — where she told staff she had been invited to give a presentation.

Corporation founder Patricia Raymond told the jury the board did not authorise Cubillo's use of the Imparja money.

But the court heard former chairman Samuel Bush-Blanasi did.

Mr Anderson said the cash was intended for a violence and substance abuse program on Groote Eylandt.

Defence lawyer Mark Johnson said a performance appraisal carried out before the scandal broke in 2011 found his client — who had been hastily appointed when the previous chief resigned — was "up to scratch".

Justice Jenny Blokland has ordered home detention and supervision reports from Correctional Services to assess potential options for Cubillo's punishment.

She will hear sentencing submissions from Commonwealth prosecutors and defence counsel Mark Johnson next week.

CLP Minister Dave Tollner has called Opposition leader Michael Gunner "repugnant, disgusting and somewhat racist" for daring to question Bess Price's $50,000 taxpayer funded trip to New York City.
 
Mr Tollner, the NT's Treasurer, said Ms Price's trip — which included seven nights at the Waldorf Astoria — was "money well spent".

"All Australians should be celebrating the fact that we have an indigenous woman like Bess Price who is more than capable of attending these high level meetings overseas," Mr Tollner said, adding it was an "incredibly important trip".

Ms Price and adviser Paul Mossman were invited by members of the Federal Government to attend the United Nations conference on the status of women in March 2014. The pair charged Territory taxpayers $40,000 in flights — including $5800 for a 43 minute trip to Washington and back — over $6000 for the hotel rooms and another $3000 to hire a driver for a daily six minute commute from the hotel to the UN.

"For Michael Gunner to now come out and say this is highly inappropriate, I think is just a rejection of indigenous women across Australia. It's totally wrong," Mr Tollner said. He added the $3000 driver was needed to gain access to the UN and that the hotel was a UN selected accommodation.

"This was an honour for the Northern Territory," he said.

"For (Mr Gunner) to come out and say that this was a junket of the highest order, well, I have absolute contempt for (that)."

On Sunday, Mr Gunner addressed Ms Price's and other CLP ministers' recently disclosed high travel costs by pledging to reveal his Labor shadow ministers' itineraries and costs prior to travel as part of his "restoring integrity in government" plan.

He did not respond directly to Mr Tollner's accusations yesterday.

"I do not intend to respond to name calling; it's not what people expect," he said.

"I will debate the policy issues as they affect Territorians. Bess Price is a Minister of the Crown, therefore she must be held accountable."

A SACKED Aboriginal family violence corporation boss has been remanded in custody while awaiting sentence in the NT Supreme Court. 
 
Veronica Cubillo, 55, calmly embraced her family in the dock after Justice Jenny Blokland made the order when sentencing submissions were completed on Thursday.

She has shown a "shocking" lack of remorse for the damage caused by her white-collar crime and is portrayed in references from her daughters as "the only victim in the case", Commonwealth prosecutor Troy Anderson told the court.

A jury found Cubillo guilty of 11 fraud charges regarding faked receipts and the misappropriation of about $10,000 from the North Australia Aboriginal Family Violence Legal Service.

Her current position as a senior alcohol management officer in the NT Department of Business will be jeopardised if she is sentenced to prison time or home detention, defence lawyer Mark Johnson has said.

Mr Anderson said Cubillo "has shown zero remorse".

"Her references describe her in glowing terms which makes the offending more inexplicable - no gambling, alcohol or drug problem, no explanation other than she thought she could get away with it.

"She saw the opportunity and she took it again and again and again.

"The conduct was out of the blue with no justification."

In a character reference tendered to the court, Cubillo's daughter Natalie White claimed that her mother had been "slandered in the media" and had lost job opportunities because of what had been "published in the news".

Her other daughter Nicole Butler said her mother was "completely despondent in acknowledging the detrimental impact a criminal conviction would have on her career".

Mr Anderson said there is a sense that Ms Cubillo is the only victim.

"These offer no insight into the damage done to NAAFVLS and the reputation of similar agencies," Mr Anderson said.

"This case has the accused as the centre of attention but it represents a bigger problem.

"It's not about her - it's about community perception of people who abuse the system for their own benefit."

Correctional Services reported that Cubillo was suitable for supervision and home detention, and that she told them the "trial was based on circumstantial evidence and she was surprised the jury returned a verdict after deliberating for an hour and a half".

"If nothing else this demonstrates how powerful the Crown case was," Mr Anderson said.

He said while the offending involved a significantly lower amount of stolen money than other white collar crime cases, Cubillo's position of authority elevated the seriousness.

"The court needs to demonstrate people who abuse positions of trust in a vulnerable organisation must be punished," he said.

Mr Johnson, for Cubillo, said his client was a "strong" and well-educated woman who was a star athlete in her youth, has battled cancer and worked at a high level in NT Government departments.

He said Cubillo had been diagnosed with kidney disease and emphysema in recent years.

Mr Johnson said the relevance of authorities that stated people who committed white collar crime were unlikely to reoffend once discovered and punished were still relevant despite his client's continued denial of wrongdoing.

Justice Blokland said she was leaning toward a partly suspended sentence and ordered Cubillo be remanded in custody until sentencing on May 12.

Housing Minister Bess Price's controversial trip to New York City at taxpayer ­expense grew murkier on Tuesday, with revelations her ­adviser brought his son on the business trip. 
 
Paul Mossman, a former CLP candidate, admitted to the NT News last night that his son did accompany the pair to New York City and that he stayed in the taxpayer-funded Waldorf Astoria.

In Parliament yesterday, ­Independent MP Alison Anderson alleged Mr Mossman exchanged his business class ticket for two economy tickets. Ms Price did not directly ­answer the question, saying she would "take it on notice".

Later, Ms Price's office ­denied Mr Mossman traded in his ticket and said he paid for his son to take the trip.

"I did not fly economy. I flew business with the minister," Mr Mossman said.

But official government records obtained by the NT News indicate Mr Mossman flew economy, while Ms Price flew business class. Mr Mossman rejected the official "movement requisition acquittal" forms that show he flew economy at a $17,000 cost.

A spokeswoman from Ms Price's office called the official report an "administrative error" and offered another form that showed he flew business class.

Mr Mossman said he paid $2500 for his son's round-trip economy class ticket to New York.

The price is in stark contrast to the $34,000 billed to the taxpayer for two tickets for Ms Price and Mr Mossman on the same flight.

Mr Mossman said his son "did his own thing" while he and the minister were at the UN women's conference in March 2014.

The Sunday Territorian first reported Ms Price and Mr Mossman billed taxpayers $50,000 for the trip, including $6000 for rooms at the Waldorf, $3000 for a driver to take them on a daily six-minute commute and another $6000 for two plane tickets to Washington for a seven-hour visit.

    West Australian Senator Michaelia Cash, who led the Australian delegation, spent a total of $22,203 on airfares, accommodation and meals for her and her chief of staff from March 8 to March 15 last year.

Ms Price, attending as the Territory's Minister for Women with her chief of staff Paul Mossman, spent more than $50,000.

They were in New York for the 58th Session of the United Nations Commission on the Status of Women.

The politicians' itineraries differed only slightly.

The Territory pair spent one more day in the US and made a $5800, 43-minute flight to Washington DC, where they spent seven hours on the ground, supposedly to meet with a staff member of US First Lady Michelle Obama.

On the return to Australia, they stayed a night in Brisbane before continuing to Darwin.



Ms Price charged $40,000 for the pair's airfares and $6000 for hotel rooms at the Waldorf Astoria.

Ms Cash spent $18,135 on flights for her and her chief of staff and $2985 for their rooms at the Hilton Hotel.


Addressing Parliament about the trip soon after her return, Ms Price made a host of initiatives centred on youth and women's issues.

None of the commitments have yet been met, although her office said learning from the trip has fed into policies.

In a statement outlining Ms Cash's achievements in the US, the spokesman said she presented Australia's priorities for the session to the commission.

She also "hosted two official Australian side events as well as speaking at an additional 12 official functions," he said.

"(She) participated in bilateral meetings with representatives of Canada, China, Denmark, Japan, the Netherlands, NZ, Norway, the Philippines, the Republic of Korea, Samoa, Timor-Leste, Tonga, Turkey and the US; attended a number of meetings and panel discussions with high-ranking UN officials; and met with a large number of Australian and international non-government representatives."

CLP Community Services Minister Bess Price's entertainer daughter has called critics of her mum's performance "racist and patronising". 
 
The comments come after deputy Labor leader Lynne Walker called for Ms Price to be stood down last week for failing to satisfactorily answer questions in estimates hearings about what she is doing to promote Territory statehood.

"I see it as bullying," Jacinta Price said in an interview with the Centralian Advocate.

"At the very end of the day, when things are winding up and there's five minutes to go, to come out and attack her with a question regarding statehood, for no particular reason but to try and make her look like a stupid bush blackfella.




"It's racist ... I think what you have to realise is that if Aboriginal people are going to be represented in Parliament then they're going to be represented by people who have a different way of doing things, approaching media ... the way in which mum talks ... English is a third language to her."

Ms Walker rejected Ms Price's comments.

"Criticisms toward Bess Price has nothing to do with race, gender or the car she drives — this is about her failure to perform," Ms Walker said yesterday.

"Ministers of the Crown are not immune to criticism. They are on taxpayer-funded salaries and must be answerable as to how they perform."

Ms Walker said her call for Ms Price to be terminated was not just over statehood, but also for her repeated refusal to answer simple questions around her other portfolios, including housing.



"In the bush the Government is failing to deliver on housing numbers and it is all being presided over by a minister who cannot give the department the stamp of authority it needs," she said.

Bess Price told the Advocate Ms Walker's call for her to be stood down could be detrimental to achieving self-determination in the bush.

"How are we supposed to encourage people from the bush to become leaders to represent their people when as soon as they stumble, or get nervous, they are publicly attacked and told they are useless or incompetent?" she said.

"We need to judge people on their achievements, not assassinate them when they are tired or nervous."

THE Northern Territory's first ever indigenous minister says criticism of CLP Minister Bess Price's performance has nothing to do with race and is not patronising, as her family suggested on Tuesday. 
 
John Ah Kit, who managed seven portfolios for Labor in 2001, said he respected Ms Price personally and did not want to offend her family, but that she was fair game for criticism when she became a minister.

"You need to have your head around the issues and abreast of what is happening within your department and the government in general," he said. "I don't see that happening with Bess Price. I don't believe I would be racist, nor am I patronising."

Ms Price's daughter Jacinta Price defended her mother's showing during Estimates hearings by calling the Opposition "racist and patronising" for demanding she be stood down over a flubbed answer around statehood and numerous "no comments" for months around her housing portfolio.



The younger Ms Price told the Centralian Advocate that the criticism levelled at her mum was "bullying ... it's racist".

Mr Ah Kit did not agree.

"(Her performance) is woeful," he said. "If anyone is patronising it's the CLP. I think the CLP has patronised her to a level where she's accepted ministerial responsibilities that she's not capable of doing properly."

Minister Price responded yesterday by saying she worked hard as a minister and has delivered on her election commitments.

She also implied Labor was being disrespectful by calling for her to be sacked.

"If Labor believes respectful communication is not applicable in the political environment, it makes it difficult for any Aboriginal person with a non-English dominant background to feel they are welcome at the table," she said in an email.

Mr Ah Kit said: "You're not there because of what colour, race or creed you are. You're there to represent Territorians and you're there to prove yourself, that you're capable."

TERRITORY Senator Nova Peris is under investigation for claiming "family travel" allowance on trips to Canberra at the same time as she was attending last year's Garma festival in Arnhem Land. 
 
The Department of Finance has also carried out recovery action against Ms Peris for an unspecified amount for other trips her family members took to Cairns and Alice Springs late last year.

Public travel documents show Ms Peris charged taxpayers two airfares from Darwin to Sydney and a further two airfares from Sydney to Canberra on August 2 last year under her parliamentary allowance. Ms Peris, however, was at Yirrkala for the Garma Festival at the time. On August 4, she appeared on national television from Arnhem Land on a special episode of the ABC program Q&A.

Parliamentary travel rules state "family reunion travel" can only be claimed where children or spouses are travelling to meet politicians working away from home. Parliament was in the middle of a four-week hiatus at the time and Ms Peris was on the other side of the country.

HOUSING Minister Bess Price excluded two indigenous-owned businesses and ignored Commonwealth and Territory procurement principles to gift nearly $16 million of work to two regional councils. 
 
Contracts to upgrade more than 180 remote homes across Central Australia were given to MacDonnell Regional Council and Central Desert Regional Council last month without tender, despite Aboriginal-owned, non-government operators in the region claiming even better capabilities.

Ms Price's decision came at the expense of indigenous business enterprises (IBE), Ingkerreke Commercial and Tangentyere Construction, which had expected to be given the opportunity to bid against each other for the lucrative contracts.

In emailed responses, Ms Price said she used a Certificate of Exemption to gift the work because of previous "excellent work done at Docker River by MacDonnell Regional Council and the opportunity for local employment".

She based the validity of the Certificate of Exemption on a Territory Government procurement direction stating governments should ensure regional councils had "adequate opportunity'' to get work if they could guarantee a minimum of 30 per cent indigenous employment.


But Ms Price's call runs counter to stated procurement principles of "open and effective competition'' and "enhancing the capabilities of local business and industry''.

Procurement directions also state "Government-owned businesses; Local, Territory, State and Federal Government Agencies and Authorities are not to operate in competition with the private sector on Government-funded projects without the prior approval of the Procurement Review Board".


Ms Price said changes to procurement rules implemented on July 1, 2014, meant the department was no longer required to obtain PRB approval.

She said the IBEs had been reasonably excluded from the process because the regional councils had a shown a "proven commitment and ability" to do the work and meet the 30 per cent employment target.

The regional councils will now subcontract most of the work – in the communities of Kintore, Docker River, Areyonga, Nyirippi and Mt Liebig – to businesses based in Alice Springs. Central Desert has said it planned to include work-for-the-dole participants at Nyirippi, which Ms Price said would provide "CDP participants a great opportunity to enter the workforce''.

Member for Nhulunbuy says he doesn't feel qualified to make decisions for the town the electorate is named for.

The township of Nhulunbuy is one of the biggest populations centres in the electorate. Home to about 4000 people in 2011, its population has dwindled significantly since the aluminium refinery, which was its major employer, closed in 2014.

Speaking to the NT News before the outcome of the election was known, its now-local member Yingiya Mark Guyula said he didn't want to govern for the community.

"This (the remote communities) is where I want to work. I don't want to make decisions for a white community," he said.

When asked to elaborate, Mr Guyula said he wanted to work with Nhulunbuy residents to govern for the town.

"I'd rather let them make the decision and then we can sit down together and listen to those people," he said.

Mr Guyula narrowly beat former Labor deputy Lynne Walker to win the seat.

Labor president Syd Stirling yesterday said the party would not contest the close election result that Mrs Walker reported lost by eight votes.

Mr Guyula said too many decisions relating to indigenous residents of remote communities were made in the past by outsiders purporting to speak for senior elders. He said he didn't want to do the same thing to the predominantly white Nhulunbuy community.

"That is the mistake that made me stand up put my hand up and say 'no you are not really representing us, you are not telling the right story that we want you to tell'," he said. "I'm not going to speak up for them, but speak up with them."

Mr Guyula campaigned on the promise to fight for a treaty and the recognition of customary law.

"People have been afraid in the town of Nhulunbuy when they hear treaty," he said.

"We are only saying let Nhulunbuy stay as Nhulunbuy and be how they want it to be."

In the remote wilderness of East Arnhem Land, a quiet political revolution had been brewing.

A traditional man named Yingiya Mark Guyula, a pioneering pilot with family members scattered across the vast tropics off the Gulf of Carpentaria, was campaigning through the bush, preparing to make his entrance into parliament.

He made headway in July's federal election. By August, he was ready. What happened next rocked Territory politics.

Yolngu voters — Guyula's countrymen — were to play a part in the greatest upset of the 2016 Northern Territory election and help hand what was believed to be a safe Labor seat to this widely unknown independent.

Guyula won the seat of Nhulunbuy in spectacular circumstances. Perhaps, it now appears, in controversial circumstances. And he did it by just eight votes.

In taking this triumph for the bush, feathers were substantially ruffled in the region's biggest township.Guyula's slim victory meant the incumbent of eight years, respected Nhulunbuy local and would-be deputy chief minister Lynne Walker, was knocked out of office. The townsfolk were aghast.

The bush was elated. An Aboriginal leader from a remote community was to become the highest authority over the sprawling electorate — including the majorly white populated mining town.But in a twist to the saga, a possible NT Electoral Act breach could see Guyula turfed out before he's even gotten started.Now, people on both sides of the fence — the town and the bush — fear their isolated region could become racially divided over the issue."There are a lot of concerns from people in town that unless we're very, very lucky, this will play out as black versus whitefella," one Nhulunbuy resident told NT News. "And nobody wants that."

AUTHOR and advocate Richard Trudgen picked up his phone this week to the bewildered voice of a senior Yolngu elder. The man was confused. Why were rumours swirling that Mark Guyula might not be leader? Even though we voted for him — and he won? "Don't elections work? Doesn't their Whitefella law work? That was where the old man was (coming) from," Trudgen said yesterday.

Countrymen were shaking their heads, mystified.They couldn't understand how, through a fine print clause — a possible breach of law — Guyula's election could be, as the NT Electoral Commission wrote in their submission to the Court of Disputed Returns, "wholly void".In his Milingimbi homeland prior to the election, Guyula had been signed up as a paid member of a local authority which, regulation suggests, he would've had to officially resign from to legally run for the seat of Nhulunbuy."In Mark's mind, he wasn't on the committee," Trudgen said."He hadn't been to so many meetings ... he assumed he wasn't on the committee."

He then, as I understand, went to a special meeting which they called him to, to deal with post-cyclone plans. Now, they probably paid him a sitting fee for being there ... but in his mind, he wasn't a committee member."Whether or not this was so, the matter now sits before the court, awaiting resolution.The case against Guyula has triggered widespread animosity across the homelands, says Trudgen."There's a lot of anger out there now ... I say to them, 'why do you hate balanda (whitefellas)?'

And they're saying 'because balanda hate us ... every time we win, they push us back'."A bearded scholar, Trudgen has been closely connected to the Guyula campaign.The groundswell in the bush, he says, was more than anything stirred by the candidate's impressive background."He is the only Yolngu person who ended up with an engineering certificate in aircraft engineering, the only Yolngu person that's had a pilot licence," he says.

"He's been a major achiever, a very quiet major achiever."Lynne WalkerTrudgen's son, Kendall, has been an integral figure in Guyula's election — he's taken on the role of his electoral officer and spokesman.The younger Trudgen has become a somewhat divisive figure in Nhulunbuy — some in the town view his role as a sort of puppeteer, essentially acting on the MLA's behalf.Kendall, who himself took a tilt for the seat of Nhulunbuy as an independent in 2012, disputes this notion.

"They don't understand that Yolngu people can think for themselves and speak for themselves, they think I'm the mastermind," he said."I didn't get him elected ... it's not my agenda. It is hard work what I do — I play an intermediary role."Central to the argument is a view of many in Nhulunbuy that Guyula doesn't represent their interests — with his headquarters in Milingimbi, he won't be as present in the town as Walker was.

"Yingiya is intimately connected to the (bush) community in the electorate," says Kendall. "And that's just life, what can you say."FOR months, if not years, a clock tower stood in the centre of Nhulunbuy town square, devoid of any faces — just a hollowed out metal head on a stand.

Then, early in 2014, the timepieces were finally restored; fresh new faces were inserted and the long-missing clock finally began ticking.This repair coincided with an ending era — the closure of Gove's Rio Tinto alumina refinery.The plant's wind down had been formally announced in November 2013, rounding up months of tense speculation.Once booming at around 4000 people — the NT's fourth biggest town — more than 1000 workers were to lose their jobs, take their redundancies and families, and move on.This month marks three years since the announcement and, despite the population drop, Nhulunbuy is still ticking along.But some amenities have been stripped away; local newspaper the Arafura Times, the newsagency, IGA supermarket and private doctors' clinic are all casualties.With the dwindling numbers, Guyula's time had arrived — and the townsfolk were taken by surprise.

"Kendall and Mark ran a very good, quiet race," said Dave Suter, a committee member of East Arnhem Chamber of Commerce.A major blow to Walker's chance was the redistribution of electoral boundaries in 2015 which, to account for the slipping population of the town, were widened to take in the remote hubs of Ramingining and Milingimbi — Guyula's heartlands.

"She was a new face to a couple of these communities where she hadn't represented before," Suter says."And they didn't know what she could do for them."Lynne was well-respected by a lot of people in the town for the tireless work she had done in Nhulunbuy ... but also out on the communities, she's worked very hard out on the communities."Despite this, Walker was destroyed by the remote vote.

The bush mobile polling stations, plus booths on Elcho Island, saw Guyula storm home with 1181 first count votes compared with Walker's 481.In the township, a relatively low voter turnout — blamed now on the complacency of those who thought she was a shoo-in for the seat and failed to vote — saw her poll less than 1000. Guyula scored just over 100 votes in Nhulunbuy.As the final postal votes trickled in, and with a margin of less than 20 votes between the two candidates, Walker posted a subtle message to those who forgot to cast their ballots: "Please, no more calls or PMs telling us you forgot to vote and asking is it too late ... you are waaaaay too late to vote."

In the final count on September 10, post-preferences, Walker was defeated 1648 votes to 1640.IF the court finds Guyula's candidacy was void, a by-election for Nhulunbuy could loom in 2017.Or, in what would no doubt be judged harshly by pundits across the homelands, Walker could be restored to the seat as the legitimate victor."At the end of the day, he won by the votes — whether it was one vote or 5000 votes, mate, he won, and people should get behind him," Dave Suter says."

Then again, if he's done something wrong, then the electoral commission needs to do what they have to do."Because whether he was a black candidate or a white candidate, or a yellow candidate or a green candidate, those rules apply to everybody.

INDIGENOUS groups say Scott Morrison's Federal Budget has failed Aboriginal people.

Australians for Native Title and Reconciliation director Andrew Meehan said little had been done to meet the government's closing the gap targets, despite Prime Minister Malcolm Turnbull acknowledging earlier this year "at a national level, progress needs to accelerate".

"The government is failing to adequately address the disadvantage experienced by the nation's First Peoples, failing to inject any sense of urgency in turning around these issues, and failing to adequately listen to and work with First Peoples," Mr Meehan said.

He said if the government was serious about ending disadvantage, it needed to be prepared to cough up cash to fix problems in health and housing, and pay for a national inquiry into racism in the health system.

The Budget's indigenous strategy was largely business focused, extending support for indigenous entrepreneurs.

It also outlined a plan for the Productivity Commission to evaluate policies affecting indigenous people through a specialist commissioner.

The Budget also sets out a plan to subject welfare recipients to drug tests. If they fail, they could be booted off the dole or have payments quarantined. Social Services Minister Christian Porter said unemployed people were 2.4 times more likely to use illicit drugs than those with jobs.

The new compliance regimen was expected to save the government $632 million over four years.

A GOVERNMENT program aimed at providing incentives to companies that hire indigenous workers has been suspended over allegations of fraud.

The full extent of the fraud is unknown at this time, but is suspected to involve tens of thousands of dollars, but most likely more.

Infrastructure Minister Nicole Manison suspended the Indigenous Employment Provision Sum program Friday afternoon after being informed of "potential widespread fraud" by the Department of Infrastructure, Planning and Logistics following an audit.

Ms Manison said six companies have been referred to NT Police for investigation. More could be referred later.

"The program was well intentioned, well meaning and was all about ensuring we had more indigenous Territorians in jobs," she said.

"However, there have been cases brought forward that the Department has now had to refer to police.

"In the meantime, we are working to look at what can replace this program.

"We're still targeting making sure we are enhancing employment opportunities for indigenous Territorians."

It is alleged companies were improperly claiming indigenous employees who weren't indigenous in order to qualify for construction contract tenders.

Ms Manison said there was no independent oversight of the program to check on the individual companies' employment claims.

"However some questions have been raised around that," she said.

NT POLICE have executed search warrants on Territory companies accused of rorting millions from an Aboriginal employment scheme.

Police would not reveal what businesses have been searched or how many.

"Police are investigating the Indigenous Employment Provisional Sum after receiving a referral from (the Department of Infrastructure)," a spokeswoman said.

"Search warrants have been executed on Northern Territory businesses as part of this investigation."

THE national $5.4 billion Remote Housing Strategy, meant to improve the indigenous housing crisis, has received a bleak review assessment, which says outcomes have been affected by "poor governance and constantly changing policy settings".

A study into the scheme, led by the former head of Northern Territory Health Robert Griew, reveals the housing program has not fostered indigenous homeownership or business growth.

A News Corp report says the study predicted the 10-year scheme, that began under Labor in 2008, would succeed in delivering about 4000 new homes and 7500 refurbished homes by the time it ends next year.

But even then, the study warned the national Remote Housing Strategy would have cut overcrowding only from 52 per cent in 2008 to 37 per cent next year.

The report said that while an original goal of the scheme was to increase indigenous home ownership, this had "not been a big success".

It said only 15 remote homeowners were identified in the NT, 16 in NSW and 37 in Queensland. It said short deadlines and political pressure had led to missed opportunities for Indigenous employment. In the NT, only about 100 Aboriginal people were employed for repairs, maintenance and tenancy management.

The report said a minimum of 5500 additional new homes would be required by 2028 just to reduce overcrowding to the "acceptable level" of 25 to 30 per cent, still 10 per cent above the average elsewhere. The NT alone would account for half of those homes. The next 10-year agreement is likely to cost about $3 billion.

National Aboriginal Community Controlled Health Organisation chief executive Pat Turner said she was surprised "white NGOs" continued to play a "huge role" in child protection in the NT.

"Those days are over. They need to get out of that space and the Government needs to provide the resources directly to Aboriginal community controlled organisations. We are much more strategically placed and our service delivery is much wider than those NGOs," she said.

"If (the Government) listen with us, engages with us, our organisations in the NT are the best placed to make sure the reforms that should be in place are in place."

She advocated for a changing of the guard within the relevant departments to oversee the changes to youth justice, rather than the "same old stale people who've been there 20 years".

Danila Dilba chief executive Olga Havnen said federal cash would be critical to ensuring the recommendations were successfully implemented. With the NT expected to lose out under flagged changes to GST distribution reform, Ms Havnen said the Commonwealth needed to stump up cash.

"The Territory is a small jurisdiction, we've got a small capacity to generate our own revenue," she said.

"I'm really conscious if (the Territory loses GST cash) then the NT Government on its own will not be able to implement the recommendations that have been made in this report. So it's really incumbent the Commonwealth to commit to the Territory and commit long term."

North Australian Aboriginal Justice Agency chief executive Priscilla Atkins said the implementation of the recommendations would lead to a significant cost saving. She called on the Government to immediately shut Don Dale.

"Most of the children in Don Dale are on remand so the majority of them can actually be released tomorrow and go into supported bail accommodation that the NT Government has established," she said.
