Note: In most Australian states, reduced sentencing laws for Aboriginal offenders means that an Indigenous Australian offender receives a mandatory reduced sentence, with the race of the victim being a non-issue.

Meanwhile, a White or European Australian offender in the same situation would receive maximum sentencing determined by 1. his own race (White Australian) and 2. on the race of the victim being other than White being justification for harsher sentencing.

The Australian Bar Association is right in stating that the over-representation of Aboriginal people in the criminal justice system has nothing to do with racial discrimination.

The belief that most Indigenous people are in jail because they have been unfairly targeted by police and arrested for relatively minor "social nuisance" offences is not true.

Data from the Australian Bureau of Statistics on prisoner characteristics shows that of the 9,885 indigenous prisoners in 2015, only 1,069 Indigenous prisoners were in jail for offences against justice procedures, such as non-payment of fines. Most (56 per cent) were in jail for serious crimes such as homicide, assault and sex offences.

... although many social justice advocates claim "the criminal laws and sentencing regulations unfairly target Indigenous people", if there is any discrimination it tends to be in favour of Indigenous people. Overall, Indigenous offenders receive shorter sentences than non-Indigenous offenders for most crimes.

Aboriginal sentencing punishes the victims
"Is Aboriginal offending somehow less serious, because, for some reason, Aboriginal offenders are not as culpable for their actions as others? Or are their victims somehow less in need of the system's albeit limited protections? Are their injuries and needs less deserving of serious attention and response?"

Reduced sentencing discriminates against Aboriginal victims who have the right to sentencing that reflects the seriousness of the crime against them. It gives the wrong message that the courts regard violent offenders as the "victim" by reason of Aboriginality. It risks the threat of retribution on the part of the aggrieved victim's family, who may not feel that justice has been properly done.

A TEENAGER who killed her boyfriend found out she was pregnant with his child on the night she stabbed him with a kitchen knife.

The offender was sentenced in the Northern Territory Supreme Court in Alice Springs last week after pleading guilty to manslaughter.

The court heard the teenager was treated in hospital for injuries sustained from payback, after she stabbed her partner in the left thigh, severing the femoral artery.

On the night of the stabbing the offender had been drinking with friends when she and the deceased, who had been in a relationship for about six months, had a jealous fight at Hidden Valley Town Camp.

The court heard the deceased told the offender he did not want to continue the relationship, and would return to Willowra, 340km northwest of Alice Springs.

The court heard the case was yet another incident of violence in Aboriginal communities where alcohol played  significant part.

A female backpacker was tricked into a conversation by a man so his acquaintances could rob her vehicle at East Point Reserve about 7.20pm on Saturday.

Watch commander Greg Pusterla said an Aboriginal man approached the woman while she was cleaning her van in the car park and started a conversation with her.

Sen-sgt Pusterla said the woman noticed another two men near the door of her vehicle and later discovered cash, personal cards and other property had been stolen.

"It seems the first man had distracted her while working with the others," Sen-sgt Pusterla said.

One of the men was later located and identified after he was found in possession of some of the stolen property.

"Some of the possessions were recovered," Sen-Sgt Pusterla said.

A 26-year-old woman was arrested for allegedly smashing three feature but non-stained glass windows and punching her boyfriend for threatening to dob her in.

Church dean Jeremy Greaves allows itinerants to sleep in church grounds if they don't drink.

He is leaving for a small, quiet parish in Queensland next month after nine years in Darwin.

Mr Greaves said one of his reasons for going was "compassion fatigue".

TWO men have been charged over the death of a man after an incident in a bar in Katherine.

Detectives from Katherine and the Major Crime Squad have charged the men - aged 24 and  35 -  over the death of a 30-year-old man we cannot name for cultural reasons - in Katherine on Wednesday.

Acting Assistant Commissioner Richard Bryson said the two men, aged 24 and  35, have been charged with manslaughter.

The fence outside Nigel Scullion's office

CLP senator Nigel Scullion has been forced to build a fence around his office to keep his staff safe from "itinerants and drunks".

Senator Scullion denied the fence was related to his party scrapping the Banned Drinker Register seven months ago and he said he had decided to build it in March last year.

"My office has had an issue with itinerants and drunks since moving to our location in 2005," he said.

"A constituent had their car window smashed and most of the windows in the office complex had been damaged. There were also concerns for the safety of cleaners, who were coming in after hours."

Senator Scullion says the fence was built to protect staff and constituents from "ongoing anti-social behaviour".

Two women who manage businesses next to the senator's office - near the corner of Rothdale and McMillans roads in Jingili - agreed there were too many drunks on the streets, but they said it had become worse since the register was scrapped. Caltex Jingili manager Christine Norris said her staff had been eye-gouged, verbally abused and forced to escort frightened customers to their vehicles after the number of problem drunks escalated.

"We have had some staff that start one day and walk straight out. They can't handle it," she said.
"They feel like they have to be security guards at the same time."

Ms Norris said one female staff member had been attacked by a drunk couple just a few months ago.

TROUBLED AFL star Liam Jurrah has been refused bail after being charged with four counts of aggravated assault.

The 24-year-old was allegedly involved in a violent incident at a 24-hour shop in Alice Springs early yesterday, just days after he was acquitted of a serious harm charge in the NT Supreme Court.

Jurrah and another man, aged 33, have been charged with four counts of aggravated assault over the incident on Gap Rd.
